No Immigration Law Enforcement In Washington

Someone should be happy, perhaps Steve Sakuma.  Sakuma is not an apple farmer, but the principle remains the same. The principle being farmers lie about their ever present illegal alien farm laborer shortage.  And it proves, again, the Obama Regime's ending immigration law enforcement in the United States.  (h/t NRO)

Washington Apple Pickers Miraculously Defeat the Invisible Farm Labor Crisis of 2012
Remember the great farm labor crisis of 2012?
Of course you don't. Because there was no farm labor crisis in 2012.
A report from Capital Press, which bills itself as "The West's Ag Site," makes it clear that Washington's apple growers—one of the most frequent alleged victims of the farm labor crisis—actually wound up with a record number of pickers. But somehow this still counts as a shortage.
A record number of people worked in Washington's record apple harvest this past fall, but still some apples were left on trees because more pickers were needed, sources say.
There were 55,653 seasonal apple workers working in October, 54,543 in September and the previous high was 48,065 in October of 2009, said John Wines, an economist for the state Department of Employment Security in Olympia. Among other duties, Wines has been tracking tree fruit labor for 18 years.
The 55,653 workers is indicative of the record 129.2-million-box crop requiring more workers but does not mean there was not a shortage, he said.

The department's monthly survey of 1,100 growers of all crops, not just tree fruit, showed the shortage peaked at 8.8 percent more workers needed in September 2012 while peaking at 8.6 percent in September 2011, Wines said.

It does tell us that despite the vocal complaints of the illegal alien lobby in Washington, there has been no immigration enforcement in Washington if the supply of illegal alien farm labor increased in 2012.  That is a pretty big amnesty for illegal alien farm laborers to go with the other Obama Regime amnesties.

Rubio, Liar Or Ignorant

Marco Rubio was on Rush Limbaugh today.  He tried to sound reasonable and claimed he would not be bum rushed by Obama outbidding the RINOs on what will be provided in the upcoming amnesty proposals.

I don't believe a word he says, but to the end he made a claim that those aliens "lawfully present" had only one welfare program that they are eligible for.  Of course he did not note that most illegal aliens qualify in one way or another for all welfare programs.

But he claimed that Obamacare was the only welfare program for which certain aliens qualified for.  And he used "lawfully present."  Well, that just is not true.  So-called lawfully present aliens qualify for many welfare programs, including food stamps (Supplemental Nutritional Assistance Program (SNAP)), Section 8, Temporary Assistance for Needy Families (TANF), Supplemental Security Income  (SSI),  Medicare, Medicaid, and Obamaphones, among other programs.  Now there are regulations that govern these and other programs.  Some programs have a 5 year wait period for legal permanent residents, one class of "legally present" aliens, others don't.

But one is not certain what Rubio meant by "legally present."  This means an alien who has been admitted or paroled, and has not violated the conditions of admission or parole.  In fact Obamacare is open to any alien who can show they were admitted and the period of admission has not expired.  There is obviously no attempt to verify that an alien who is applying for Obamacare has not violated the terms of admission, such as working illegally.  This means that those lawfully admitted as tourists on a B-2 non-immigrant visa, for example, are lawfully present.  There is, of course, no reason for a tourist to need Obamacare and any tourist who applies is by definition not a tourist, but a resident who is most likely working illegally, but minimally not planning on leaving when the period of admission expires.

It is strange that Rubio brought up the issue of Obamacare relating to amnesty for illegal aliens.  While illegal aliens are not eligible for Obamacare, these illegal aliens get free medical care anyway by using public hospitals, subsidized clinics and Medicaid.  Rubio claimed that allowing the 11 million illegal aliens into Obamacare will bankrupt the system, but they are already in the system.

More likely it was Rubio's dishonesty that was his motive to make these statements.  One way or another, aliens, legal or illegal, use the full panoply of the Welfare State, whether it is the Women, Infants, Children (WIC) program that is legally open to illegal aliens, to SNAP that is available indirectly to illegal aliens if they have a legal alien or citizen in the household.  It appeared that Rubio was trying to deceive or downplay the problem illegal and legal aliens present as welfare recipients.  He did this by seeking to deceive Americans about the access that "lawfully present" aliens have to the welfare system.  And that also implied to the public that illegal aliens don't have any access to the welfare system.  And that is not true.

Now the ignorance of politicians is legendary, but I just don't believe that Rubio thinks that the welfare system is restricted to Americans for the most part.

It is clear then that Rubio is nothing more than Spanish for RINO.

Let's Not Be Stupid, People

Alot of nonsense is out on the internet.  The latest is the paranoid fantasies of some on the right who think that FEMA and DHS are building armored fighting vehicles to put us all in camps.  Well, Obama does want to do that, eventually.  But his psycho-sexual fantasies have nothing to do with the Department of Homeland Security buying lots of .40 caliber pistol ammunition.  And while U.S. Immigration and Customs Enforcement Special Victims Unit (ICE SVU) is buying armored vehicles, those are not for hunting down white gun owners, at least not yet, but for arresting child porn suspects, and not for arresting illegal aliens.  But they are not FEMA armored vehicles, they are ICE SVU armored vehicles.  Check out the episode of National Geographic's Border Wars where ICE SVU in Puerto Rico show up at a search warrant on a child porn suspect with an armored vehicle.

A recent posting on the usually good Gateway Pundit is quite weird, claiming that FEMA is also buying armored fighting vehicles.

Gateway Pundit January 28, 2013 by Jim Hoft
Obama Administration Repositioning Homeland Security Ammunition Containers
The containers (like those pictured) are usually painted olive drab and are unmarked except for indistinguishable numbers/letters probably for inventory, routing, etc.
Reader Don sent this in recently:
Jim – I passed a convoy of olive drab unmarked 40 foot tractor trailers each with four 10 yard ammo bunker boxes chained to them and unmarked armored Hum-Vee’s heading north on I-95 in Brevard County, Florida this past Thursday morning. The “govt” is positioning these ammo storage boxes, I have been told, in strategic places in population centers around the country. They are usually painted olive drab and are unmarked except for indistinguishable numbers/letters probably for inventory, routing, etc.
Obama’s Homeland Security Department has purchased 1.4 billion rounds of ammunition – that is not a typo — during the last six months.
ATK is one company that won a contract with the Department of Homeland Security to provide 450 million rounds of .40 caliber ammunition in 2012.
Previously it was reported that people around the US have begun reporting the site of strange, new, heavily-armed FEMA fighting vehicles this past year.
One set of images made available by Rense.com shows trailer after trailer carrying these new DHS and FEMA armored fighting vehicles, complete with machine gun slots. They’re labeled with the usual backward American flag and the title, ‘Homeland Security’. Below that and the DHS logo, it also reads, ‘Immigration & Customs Enforcement’. Joining those markings, the black vehicles with white lettering also display ‘POLICE/RESCUE’ on one side and ‘Special Response Team’ on the other.

Sorry Charlie...ehr Don, ATK does not deliver ammunition in 10 yard (30 feet) shipping containers, except perhaps to the military.  Deliveries to Federal agencies, including the FBI, as ATK is the largest manufacture of small arms ammunition in the United States using many brand names like CCI and Federal Premium.

However, for deliveries to Federal agencies, ATK uses not olive drab shipping containers and unmarked DHS HUMMVEES, but by using brown shipping containers or as you see on the streets large brown panel vans.  Yes, ATK delivers to various Federal agencies directly to the Federal consumer, which means hundreds of Federal law enforcement field offices throughout the United States by Big Brown, UPS.

This is how DHS and other agencies' ammunition gets out to its agents:

Nothing sexy, nothing mysterious, but the most efficient delivery service in the world.  Now ATK does deliver by other means in large amounts, such as to the Federal Law Enforcement Training Center (FLETC), Brunswick, GA.  Just off I-95 near the Golden Islands of the coastal waterway of Georgia. Now FLETC has other training centers and those go through lots of ammunition each year as the various FLETC training centers train almost all Federal law enforcement agencies, from the U.S. Border Patrol of 20,000 agents to the National Park Service Rangers.  Most carry a .40 caliber firearm, so that is alot of ammunition just for formal training, not including the quarterly qualification on issued firearms by in-service personnel.  Try a little multiplication.  20,000 Border Patrol Agents, qualify 4x a year and shoot a minimum of 100 rounds a qualification (usually at least two courses each qualification).  2,00,000 a quarter, times 4, which is 8,00,000 rounds a year just for the in-service training for the USBP.  This does not include any other DHS agency, like ICE SVU, ICE Enforcement and Removal Operations, Office of Inspector General, Office of Field Operations, Federal Protective Service, etc.  This is not initial training where trainees fire thousands of rounds in basic training. Now ATK might deliver in bulk to the FLETCs and that might be what the mystery reader saw, but DHS does not deliver to itself.  ATK delivers direct, so that might be their security. And those deliveries could be to any military base on the I-95 corridor.

But the lesson folks is to not be stupid.  Barak Hussein Obama is an enemy of the United States, but it has nothing to do with lots of pistol ammunition or armored vehicles that ICE SVU uses to arrest child porn suspects.  Let's be smart people.  Dumb can be embarrassing and babbling about FEMA armored vehicles makes one look a bit loony.

Don't Believe The Lies

There will be no enforcement of any immigration laws or any restrictions placed on the upcoming amnesty.  Why?  Because Barak Hussein Obama is cutting back on enforcement as we speak.  And I don't here Marco Rubio complaining.

Border Patrol Looking Into Allegations Of Targeting Day Laborers
The Customs and Border Protection’s San Diego sector has promised to look into complaints voiced by labor and immigration advocates that Border Patrol agents are targeting day laborers in Home Gardens.
“CBP is committed to enforcing the nation’s laws according to established policies and guidelines,” Chief Patrol Agent Paul Beeson is quoted in an email from a Border Patrol spokesman. “We are looking into news reports regarding enforcement actions referenced in the news conference.”
He was referring to the roadside news conference held Friday in Home Gardens near a large pine tree where day laborers, including some undocumented immigrants, gather in hopes of being recruited for day jobs.
A coalition of labor and immigrant rights groups claimed that about 25 suspected undocumented immigrants have been rounded up by Border Patrol agents over the last two weeks...
Border Patrol critics say the alleged roundups run counter to Obama administration priorities that do not put a premium on pursuing workers who have lived in the United States for years, do not commit crimes after crossing the border and are working to support their families.

So, the Border Patrol is investigating itself for enforcing the laws of the United States?  If it will not enforce the laws of the United States now, how do we know it will enforce any part of the upcoming amnesty that it disagrees with?  The Regime will not.  It will be a free-for-all for criminals, terrorists, welfare cheats, fraud and any provision of law that restricts the amnesty will be ignored.

More Welfare Fraud By Democrat Constituents

Hot on the heels of news of the obvious Medicaid and Obamacare cost increases due to expansion to 20 million more welfare recipients due to amnesty is the continued fraud from criminals and illegal aliens.

NYT January 24, 2013 by the Associated Press
Medicare Improperly Paid for Immigrant and Inmate Care
Medicare paid more than $120 million from 2009 to 2011 in violation of federal law for medical services for inmates and illegal immigrants, according to two reports issued Thursday by federal health officials. The program was billed for more than $33 million in inmate care and more than $91 million in illegal-immigrant care over that period, according to the reports from the Department of Health and Human Services inspector general... The reports recommend that federal health officials establish a better system to automatically flag charges for inmates and illegal immigrants to stop illegal payments before they are made.

The tipping point is fast approaching.

Stupid And Evil

What a combination.  The slave power is at it again.  The Chamber of Commerce wants more and more aliens available to drive down wages, which, at least for them makes some sense, not in the long term when all those workers of ethnicity start voting for more and higher taxes.  Sooner or later the Chamber will be going Galt.

But back to the stupid part.  Just what does Thomas J. Donohue mean by this:

U.S. Chamber Of Commerce Website
State of American Business, Remarks by Thomas J. Donohue President and CEO, U.S. Chamber of Commerce
In addition, our laws must be revised to welcome needed labor and talent into our economy through thoughtfully-designed guest worker programs. This includes provisional visas for lesser-skilled workers. It also includes expanding the caps for high-skilled visas, and, expanding green cards for foreign nationals who graduate from our colleges and universities with advanced degrees.

Just what is a "provisional visa" pray tell?  This is just part of the problem with the immigration issue.  Supposedly intelligent people just don't know anything about the issue.  There is no such thing as a provisional visa.  You either get a visa or not.  No half measures here.  Of course it is hard to tell if Donohue is just stupid or he is intentionally deceptive here.  Perhaps he hopes that the rubes reading this will think that "provisional" means something restrictive; that the alien entering the United States will be followed closely to see that he leaves, or doesn't get on welfare, or only gets a green card if he behaves.

One does not know whether this is mendacity or stupidity, or more likely both.  Because just as there is no room for gun rights with increased immigration, so there is no room for the free market with people seeking the protections of a generous welfare state.  Something where business will have no place in the growing socialist collective.

Donohue is just as stupid as Hugh Hewitt who seems to think that amnestied illegal aliens will either be voting Republican or amnesty will cause the under 30 demographic to vote Republican.  Someone should point out that under 30 white people voted Republican, it was just the under 30 of color that are the problem.  And you can solve that by an Operation Wetback.

NYPD Looking To Enforce Federal Gun Ban

The New York Police Department has apparently decided that it will participate in any upcoming Federal crackdown on firearms ownership.  It is in stark contrast to the NYPD's hands off approach to illegal aliens.  It refuses to arrest or hold illegal aliens, but it wants Americans's guns.

CBS New York December 22, 2012
Police Wonder If They’ll Need To Confiscate Assault Weapons In Event Of Ban
NEW YORK (CBS New York) — Amid talk of reinstating the assault weapons ban that expired eight years ago, police departments nationwide are thinking of ways to confiscate such weapons.
As WCBS 880’s Marla Diamond reported, among the departments considering taking action is the NYPD. Police Commissioner Ray Kelly said if Congress were to reinstate the ban, police are wondering whether it will be their responsibility to confiscate them.

Of course there is no real question as to whether the NYPD will participate in gun confiscation. They will do so with relish.

One of the failings of Second Amendment supporters is that they are single issue voters.  Unfortunately there is no such thing as a single issue in politics.  You might not be interested in other politics, but other politics is interested in you.  In this case it is the illegal alien boosters such as Mayor Michael Bloomberg support illegal immigration for a reason: the overwhelming Hispanic vote for Obama.

20 million illegal aliens are waiting in the wings for amnesty and they will be voting for politicians who support gun control.  Hispanic groups are pushing gun control, but diversity advocates in the Second Amendment community are have their heads in the sand about the impact of Hispanics on the gun issue.  They treat any race reality on the issue with accusations of racism.  The reality is that immigrants oppose gun rights and support the Demoncrat Party.  Some crow that sheriffs are openly stating that they will not be enforcing any ban, but big city chiefs, many black and Hispanic, are ecstatic about any gun ban and will be providing the foot-soldiers to shoot down gun owning white people.

Just look at the color of the so-called law enforcement leaders at Dianne Feinstein's gun ban announcement:

Amnesty will be the death knell of the Second Amendment.

Enforcement Declines As ICE's Priorities Are Also Ignored

The ongoing Obama Regime Administrative Amnesty accelerates as the one-time priorities of U.S. Immigration and Customs Enforcement  (ICE) are also ignored.  Previously deported illegal aliens were one of John Morton's priorities.  Not so much anymore as the mother of a DREAMer who has been previously deported got amnesty.

HuffPo January 23, 2013 by Elise Foley
Janet Napolitano Defends Arrest Of Mother Of Erika Andiola, DREAMer
Department of Homeland Security Secretary Janet Napolitano responded on Tuesday to allegations that the agency targeted an undocumented immigrant's family as retribution for her activism.
Immigration and Customs Enforcement officers detained the mother and brother of Erika Andiola, who is active in the immigrant rights movement and the founder of activism group DRM Capitol, on Jan. 10. The mother, Maria Arreola, and brother, Heriberto Andiola Arreola, were quickly released from custody after an outcry from advocacy groups.
Napolitano told Phoenix NBC affiliate KPNX that Maria Arreola was taken in because of a previous deportation in 1998 and traffic arrest last year. Maria Arreola was therefore considered a priority case, she said...
Barbara Gonzalez, a spokeswoman for the agency, said in a statement at the time that ICE would use prosecutorial discretion in the case and likely would not pursue deportation.
"Although one individual had been previously removed from the country, an initial review of these cases revealed that certain factors outlined in ICE’s prosecutorial discretion policy appear to be present and merit an exercise of discretion," she said. "A fuller review of the cases is currently on-going. ICE exercises prosecutorial discretion on a case-by-case basis, considering the totality of the circumstances in an individual case."

It is compelling evidence that even the so-called priorities of the Regime are not that, but merely boob-bait-for-bubbas, designed to hide the Obama Regime Administrative Amnesty behind a cloud of lies.

New Responsibilities For ICE SVU

Janet Reno Napolitano has decided that the Department of Homeland Security will not just be America's Special Victims Unit.  Deciding to further ignore customs and immigration law enforcement and not content with child porn and prostitution arrests, DHS, presumably in the person of ICE SVU, will now be preventing or responding to school shootings.

Government Security News January 16, 2013 by Mark Rockwell
New Sweeping Gun Control Policy Proposals Involved Efforts From DHS, DOJ And FBI
The Department of Homeland Security Secretary Janet Napolitano said her department had worked with the Justice Department and the FBI to identify measures that could be taken to reduce gun violence as part of the president’s new set of gun control policy proposals and executive actions.
Napolitano attended the White House gathering in which the new proposals and orders were unveiled. “In the aftermath of the tragic Newtown shooting, the Department of Homeland Security (DHS), together with the Department of Justice (DOJ), and the FBI have worked to identify measures that could be taken to reduce the risk of mass casualty shootings,” she said in a statement issued after the event.
“In the coming days, DHS will expand and formalize coordination of ongoing efforts intended to prevent future mass casualty shootings, improve preparedness, and to strengthen security and resilience in schools and other potential targets,” she said, adding that her department would work with all levels of government “to address five critical areas intended to reduce the risk of mass casualty shootings in the United States:  Prevention, Protection, Response, Education, and Research/Evaluation.”

This search by DHS for a mission other than that which it was created, customs and immigration law enforcement, is of no surprise given the opposition to immigration law enforcement evidenced by the Obama Regime, nor is it surprising given that DHS' enabling legislation, the Homeland Security Act of 2002, is treated with contempt.  Neither the law nor the Constitution has been considered a restraint the the Obama Regime.

Harry Reid recently announced that any immigration reform, e.g. amnesty legislation, will not include any border security spending or enforcement mechanism.

The Hill January 18, 2013 by Daniel Strauss
Reid: No Immigration Reform Bill Will Pass Senate Without Pathway To Citizenship
Reid said the emphasis in a new immigration reform bill should not be on border security.
"We have spent a huge amount of money on border security, and both our northern and southern borders are more secure," Reid said. "Frankly, Mexico is doing much better economically, and that has helped the issue a lot. We can’t build a fence of 3,000 miles because no matter how high we build it, they can build a ladder taller than that fence. So I think we have about expended our energy on border security."

The fix is in.  DHS will no longer make an effort to enforce immigration law, its budget will be cut and the resources it retains will be redirected to ICE SVU agents and Border Patrol Agents standing post at elementary schools.

Border Arrests Down

Flow of illegals down, and border arrests are down as well:

The Washington Times January 9, 2013 by Stephan Dinan
Interceptions Of Immigrants Stubbornly Low
Despite massive increases in manpower, the U.S. Border Patrol is still intercepting only about 61 percent of would-be illegal immigrants along the U.S.-Mexico border, according to an audit that the investigative arm of Congress released Wednesday.
The findings, which for the first time show a broad estimate of how many illegal immigrants the Border Patrol fails to catch each year, emerge as pressure builds on Congress to move past border security and begin to grant legal status to the estimated 11 million illegal immigrants in the U.S.
The Government Accountability Office report found that an estimated 208,813 illegal immigrants escaped capture along the nearly 2,000-mile border. Slightly more than half of them turned back to Mexico, and the others proceeded deeper into the U.S., the report said...
“The bottom line is we are far from having operational control of our borders, particularly the southwest border, and as the GAO reports, there still are no metrics to quantify progress,” said House Homeland Security Committee Chairman Michael McCaul, Texas Republican. “Meanwhile, the threat from groups ranging from Islamist extremists to drug cartels continues to grow.”
Border security has been a chief focus of immigration efforts since 2007, when the last major immigration reform bill failed in Congress. After that failure, Republicans said voters wanted the border secured before any legalization took place, and President Bush poured resources into the Border Patrol.
According to the GAO, the number of illegal border crossings has dropped, as has the number of illegal immigrants the Border Patrol apprehends. It’s unclear how much of that is a result of stricter enforcement and how much is because of the slumping U.S. economy and changes in Mexico.
But the GAO report painted a picture of an agency struggling to come up with ways to measure its effectiveness.

What it does tell us is that on the border, the USBP needs to finish building the fence along all the 2,000 miles of border with Mexico.  It also tells us that ICE SVU has failed miserably in its immigration enforcement mission inside the United States.  Therefore large numbers of Border Patrol Agents can be taken from the border with Mexico and deployed to the interior of the United States for aggressive enforcement action that ICE SVU refuses to perform.

Deporting Piers Morgan

There has been much recently about Piers Morgan, an alien apparently legally present in the United States.  It is uncertain as to which status he entered the United States, as either an immigrant or a non-immigrant with employment authorization.

His recent and continuing assault on the Second Amendment has brought his otherwise low rated interview show that replaced Larry King to the attention of the public and a group that has been sitting out the immigration battle until now as well as the battle against Black Run America; gun nuts.  And that, by the way, is not a pejorative.  This blogger counts as one, in fact this blogger is also a firearms instructor.  Never mind that Morgan claims to support the Second Amendment, but thinks it is restricted to owning a pistol.  Apparently rifles of any sort are not what our Founding Fathers were thinking about when they resisted another British assault on the right to keep and bear arms.

Many have since decided to seek the deportation of Morgan, and with good reason.  Morgan's assault on our rights, leading the attack on the Second Amendment, is not only an affront to our Founding Fathers who pledged their lives, fortunes and sacred honor in our fight for independence and self-determination, two states that only an armed people can claim.  Liberty is seldom given and only an armed people can obtain or retain national independence and individual liberty.

The communists who now occupy the Executive have, of course, rejected the petition posted on the White House website that calls for Morgan's deportation.

The Daily Telegraph January 10, 2013
Piers Morgan Deportation Calls Dismissed By US
Morgan, the former editor of the Daily Mirror, has become a vociferous opponent of America's gun laws in the wake of the Sandy Hook school massacre.
Since arguing for tighter gun control, gun enthusiasts launched the petition in December 21 accusing him of being "engaged in a hostile attack" against the Second Amendment to the US Constitution, which guarantees the right to bear arms.
US citizens are able to file petitions on the White House website. If they collect at least 25,000 signatures within 30 days the White House is obliged to issue a response.
Jay Carney, the White House spokesman, has now commented on the petition, saying that Morgan would not be deported.

Of course, sedition and a failure to adhere to the basic principles of nation, as well as a failure to support and defend the Constitution of the United States should disqualify any alien from entering or remaining in the United States.  Which was in fact previously that authority was exercised by the United States when confronted with aliens who were inimical to the Constitution.

The Palmer Raids and the deportation of numerous communists and their detritus often referred to as radicals, anarchists and socialists, showed the principle that immigrants should be required to adhere to the Constitution and the rights given to man by our Creator.  Those, like the communists deported in the aftermath of the Palmer Raids, who are contemptuous or hostile to our rights have no place here.

Interestingly enough, the neo-cons, not usually known for supporting gun rights, have pointed out the fact that the Obama Regime will not deport the illegal alien Morgan, just as it will not deport another member of the media, Jose Antonio Vargas, also an illegal alien.

The Daily Caller December 23, 2012 by Patrick Howley
Wall Street Journal Columnist Explains On Twitter How To Deport Piers Morgan
Wall Street Journal columnist James Taranto Saturday night joined in the chorus of American voices suggesting that British-born CNN host Piers Morgan could legally be deported from this country for his televised attacks on the Second Amendment, and pointed out the legal precedent that leaves Morgan vulnerable to deportation...
“Your opinion is protected, your presence in the U.S. is not. See Kleindienst v. Mandel (1972),” Taranto replied to Morgan.
Taranto linked to transcripts from a 1972 U.S. Supreme Court ruling that the U.S. Attorney General’s refusal to allow a foreign journalist into the United States did not violate the First Amendment. The case resulted from Nixon administration attorney general Richard Kleindienst’s refusal to grant a temporary non-immigrant visa to Marxist Belgian journalist Ernest Mandel.

The irony is that the old enemy of immigration law enforcement, the execrable James Tarantoad is suddenly El Patrullero.  But we take what we can get from the the neo-cons.  Take what you can get and run with it until it drops in its tracks.

The Toad is correct though.  The First Amendment does not extend to enemy aliens.

Held: In the exercise of Congress' plenary power to exclude aliens or prescribe the conditions for their entry into this country, Congress in 212 (a) (28) of the Act has delegated conditional exercise of this power to the Executive Branch. When, as in this case, the Attorney General decides for a legitimate and bona fide reason not to waive the statutory exclusion of an alien, courts will not look behind his decision or weigh it against the First Amendment interests of those who would personally communicate with the alien.

However, such plenary power to exclude aliens is also matched by similar powers to remove aliens.  In the case of Morgan he has unfortunately already been admitted to the United States and is ostensibly legally present, though it will be shown that is not correct.

Of course, the first issue has Morgan been lawfully issued a visa, either immigrant or non-immigrant.  He is either here as a legal permanent resident or in a non-immigrant working visa, perhaps the O-1B category for such types as movie and television types, and has he consequently been legally admitted to the United States.

This brings us to his visa application and the issue of good moral character.  All aliens entering the United States must meet the standard of good moral character.  From the Treason Bar itself:

What is “good moral character”?
Good moral character is defined in INA § 101(f) which provides a list of bars to good moral character.  These bars are either permanent in nature or apply only if they occurred during the period during which the applicant is required to have maintained good moral character.
Permanent Bars: Convicted of murder at any time, Convicted of an “aggravated felony” (defined in INA § 101(a)(43)) on or after 11/29/1990, Nazi persecution, participation in genocide or acts of torture at any time, habitually drunk, convicted of two or more gambling offenses, obtained income primarily from illegal gambling, two or more convictions of any type for which the aggregate sentence was 5 years or more, incarcerated for 180 days or more, given false testimony in order to obtain an immigration benefit, prostitution, polygamy, alien smuggling, drug trafficking, and crimes involving moral turpitude.

But more importantly:

The definition of good moral character also includes a catch-all provision which states “the fact that any person is not within any of the foregoing classes shall not preclude a finding that for other reasons such person is or was not of good moral character.”  INA § 101(f).  In other words, the adjudicating immigration officer or the immigration judge can consider any factor in determining whether the person has good moral character.  These are discretionary factors. They do not bar good moral character, but they can when considered together with any positive factors.
Some of these discretionary factors are listed below.  Discretionary Factors: extra-marital affairs, willful failure to support dependents, being on probation or parole, receipt of public benefits via fraud, failure to file taxes, tax fraud, failure to register for the selective service, unlawful voting, and false claim to U.S. citizenship.

Which brings us back to Morgan.  Before his failing stint with CNN, he was editor of the Daily Mirror and the News Of The World, both hack of a Fleet Street rags, which was recently involved in a scandal where it was hacking into cellular telephones of persons it was reporting stories on, which is of course a serious crime both in the UK and in the United States.  Morgan as editor knew of and accessed hacked voice mails.

Listen to Morgan's testimony on the issue.  He is asked directly if he ever listened to hacked voice mails.  His response is that he "did not believe so."  Translated it means "Yes, I did, but I am lying to save my skin without directly denying the allegation."  Such responses by criminals to direct questions are quite common.  Note that he does not have a direct unequivocal denial that identifies a person telling the truth, but uses a modification based on his "belief," a common behavior pattern used by those who are lying.

This in addition Morgan admits he heard a voice mail obtained from Paul McCarthy but states that he cannot divulge when and where he heard it.  Which is an open admission that he participated in an ongoing criminal conspiracy.  Something that negates good moral character.

Former employees such as James Hipwell testified that hacking was widespread under Morgan's editorship.

Which tells us that Morgan did not have the good moral character to enter the United States as either an immigrant or non-immigrant.  Therefore his visa was or is invalid and fraudulently obtained.  Consequently he is unlawfully present in the United States and should be deported, just as Jose Antonio Vargas should be deported.

But that ain't happening anytime soon under the Obama Regime Administrative Amnesty.
