Making America A Dictatorship

Xavier Becerra wants an Obama dictatorship, much like there is in Bercerra's homeland of Mexico. According to the Mexican Congressman if something is popular then American Presidents have dictatorial power.

The Daily Caller June 29, 2014 by Scott Greer
Chris Wallace Confronts Dem Congressman On Obama’s Executive Actions: ‘Is He Rewriting The Law?’
Things got heated on Fox News Sunday when host Chris Wallace forcefully demanded answers on the questionable executive actions of President Obama from California Democratic Rep. Xavier Becerra.
In a segment that also featured Republican congressman Bob Goodlatte, Wallace discussed House Speaker John Boehner’s recent lawsuit against the Obama administration over the actions it has taken without Congressional approval.
After listing off specific actions the administration has taken without Congress — including deferred deportations and raising the minimum wage for federal contractors — Wallace turned to Becerra and asked, “What is the president’s legal authority to take all of these unilateral actions without going back to Congress?”
The California lawmaker responded that all of these actions met with popular approval and the American public wanted to see these things happen. “The list you showed are all things the American public wants to see.”
Becerra then tried to explain how the president decided to take action since Congress wasn’t doing “its job.” This prompted the Fox host to cut him off before he finished his statement to state that the Constitution does not grant power based on popularity.

There we have it.  The future of America with a "minority" majority of Mexicans and blacks, a dictatorship.  This is why the neo-Marxists want to replace the historic American people.

Obama Running Scared, But Not Backing Down

The Juvenile Delinquent Jihad by Central Americans, the rushing of the border, has the Obama Regime and amnesty supporters rolling back on their heels like a punch drunk boxer.  The Regime clearly overreached on their plan to flood the border with illegals and their conspiring with Eric Cantor to similarly rush amnesty through the House has been quashed for the moment.  Clearly hubris has claimed the Obama Regime.  And the Regime is planning a response, a jujitsu move designed to keep amnesty opponents on the defensive.

Obama to Seek Funds to Stem Border Crossings and Speed Deportations
President Obama will ask Congress to provide more than $2 billion in new funds to control the surge of illegal Central American migrants at the South Texas border, and to grant broader powers for immigration officials to speed deportations of children caught crossing without their parents, White House officials said on Saturday.

Of course, the monies do not include a fence, but the intriguing part is the changes to the law:

Mr. Obama will send a letter on Monday to alert Congress that he will seek an emergency appropriation for rapidly expanding border enforcement actions and humanitarian assistance programs to cope with the influx, which includes record numbers of unaccompanied minors and adults bringing children. The officials gave only a general estimate of the amount, saying the White House would send a detailed request for the funds when Congress returned after the Fourth of July recess that began Friday and ends July 7.

It is not clear yet what exactly the provisions of law will be as there has been no release of the proposed legislation changing what may be the William Wilberforce Trafficking Victims Protection Reauthorization Act of 2008, which is at the heart of the problem.  It was a parting gift of Jorge Bush which interfered with the use of expedited removal for juvenile delinquent illegal aliens.

It appears that something like expedited removal will be proposed, as described by Henry Cuellar, former Supervisory Border Patrol Agent and current Representative.

Representative Henry Cuellar, a Democrat whose district includes a long stretch of the South Texas border, on Saturday visited about 1,000 migrants detained at the Border Patrol station in McAllen. He urged Congress to approve quick changes to laws on the handling of unaccompanied minors.
“When it’s Central American countries, there is a different process,” Mr. Cuellar said. “One of the things we need to do is tweak the law, to give Border Patrol the power to treat anybody the same as we treat Mexicans.”

However, this appears to be "boob-bait-for-bubbas." The Regime proposed strong language for the press, but immediately backtracked:

White House officials said they were not asking Congress to change other existing legal protections for children apprehended without their parents.

So, perhaps this proposed legislation will be a big nothing burger, but these "changes" to speed deportation might be the vehicle for the Gang of 8 amnesty.  Stand by for betrayal by John Boehner. And don't expect any real changes, deportations of juveniles are falling precipitously

Latest On VDare: War On The Border Patrol

My latest up on VDare.  It is Part I of my review of the war on the men, yes, the men, as few women are able to pass the most demanding law enforcement training in the United States, enforcing immigration law at the border.

Violence Against The Border Patrol: Whose Side Is Obama On?
Today’s headlines are about yet another Mexican border outrage: Mexican law enforcement helicopter fires at U.S. agents, by Richard A. Serrano, Los Angeles Times, June 27, 2014.
But the real outrage: Barack Hussein Obama hasn’t just encouraged mass illegal immigration and unilaterally imposed Amnesty—he’s also systematically disregarded the pattern of physical attacks against those law enforcement officers who defend America’s borders. Indeed, the Obama Regime has even imposed new restrictions on Border Patrol Agents and Customs and Border Protection Officers so they cannot effectively defend themselves against violent illegal aliens.  (Read On)

For the more adventurous, see the longer draft (Which I think is better documented, but I am a mere scribbler not a learned editor.  Editing is something I have learned to leave to my betters both here and professionally.):

The war on immigration law enforcement is well known.  The Obama Regime has been subverting the law and the Constitution in an effort to administratively end the enforcement of immigration law in the United States, whether it be above-board such as the DACA amnesty, under-the-radar massive decline in arrests and deportation, the encouraging of new illegal immigration by the catch-and-release of adult and child illegal aliens at the border, or a secret amnesty for criminal aliens.  Across the board, the Obama Regime is determined to elect a new people by aiding and abetting illegal immigration in all its forms.

Accompanying the open support for illegal immigration is the other part of the Obama Regime Administrative Amnesty.  This is the open war the Regime is waging on those who enforce the immigration laws of the United States.  As part of the ongoing Administrative Amnesty the Obama Regime is seeking to assist illegal aliens who enter the United States by subverting immigration law enforcement by carving out no-go areas for the U.S. Border Patrol (USBP), encouraging physical attacks on Border Patrol Agents (BPA) and Customs and Border Protection Officers (CBPO), and attempting to discipline BPAs and CBPOs based on false allegations of abuse by illegal aliens.
One of the strategies of drug and alien smugglers is to use violence to carve out no-go areas for the U.S. Border Patrol by denying access to an area by use of violence.  The tool of choice is the use of juvenile delinquents to attack BPAs and CBPOs with rocks.  This is called rocking.  Rocks are weapons that can cause death or serious bodily injury and attacks on Federal law enforcement officers is a felony, a violation of Title 18 United States Code (USC) Section 111 and the murder of a Federal officer in the course of his duties is also a felony and is punishable by death under Title 18 USC 1114. And rocking is deadly in its result and a common tactic.  Rocking has even brought down USBP helicopters.  And it is deadly.

The usual response of BPAs to rock attacks was to use deadly force, e.g. shooting the attacker with the issue pistol.  Attacks have increased in frequency as the increase in USBP staffing has interfered with alien and drug smuggling.

The use of firearms by law enforcement officers when confronted by deadly force long established in America law.  Law enforcement officers may use deadly force when their life or the life of another is threatened with an act that appears to a reasonable person a threat to life or may cause great bodily injury.

From the Department of Justice standards for DOJ employees, but followed by all Federal law enforcement agencies, with only minor differences on the use of warning shots at sea by CBP and U.S. Coast Guard:

I. Permissible Uses. Law enforcement officers and correctional officers of the Department of Justice may use deadly force only when necessary, that is, when the officer has a reasonable belief that the subject of such force poses an imminent danger of death or serious physical injury to the officer or to another person.

Rocking attacks are of course covered by that standard.

With regards to the USBP, this standard has been under attack since two shooting incidents where violent Mexican nationals attacked BPAs on our southern border.  The most famous was that of Sergio Adrian Hernandez Guereca who attacked a BPA in 2010 and was shot for his troubles.  This incident was much like this other incident:

The deaths of Mexican criminals who acted to support illegal aliens crossing the border has enraged the radical left and in response the Obama Regime has decided to support this tactic used by smugglers to carve out and create no-go areas for the USBP to aid in successful illegal crossings of the border.

In response to aggressive action by smugglers the Obama Regime recently announced a new standard for use of force by BPAs and CBPOs.

USA Today May 31, 2014 by Bob Ortega

PHOENIX -- Customs and Border Protection tightened restrictions on when and how agents and officers will be allowed to use deadly force — changes that, had they been in place, critics say, might have prevented many of the 45 deaths at the hands of agents on duty since 2005.

Following months of mounting public pressure, CBP Commissioner Gil Kerlikowske on Friday also released an uncensored, scathing report on the agency's prior use-of-force policies. That report, kept secret for 15 months, revealed that in at least two use-of-force deaths since 2010, agents violated CBP policies. The report also states that investigations into use of deadly force often lacked "diligence."

Kerlikowske also released CBP's new use-of-force handbook, which includes many — though not all — of the changes called for in the critical report.

The report, by a liberal group of politically appointed big city chiefs of police and similar command staff, both current and retired, The Police Executive Research Forum (PERF), hardly a group that supports immigration law enforcement, was not, however, as scathing as claimed.

However, the purpose of the report was implicitly drawn to encourage no-go areas and discourage aggressive immigration law enforcement and serve the purpose of the ongoing Obama Regime Administrative Amnesty.

But the police-forum report goes further. When agents shot at rock throwers, "too many cases do not appear to meet the test of objective reasonableness with regard to the use of deadly force," it said. The report looked at four cases involving rocks thrown at agents on boats, and said "the tactics and strategies agents are using may unnecessarily put them in harm's way."

The report raised suspicions that in many vehicle-shooting cases, agents "intentionally put themselves into the exit path of the vehicle," to justify the use of deadly force and that "the cases suggest that some of the shots at suspect vehicles are taken out of frustration" when agents on foot see no other way to stop suspects.

There-in lies the key to the report and the new use-of-force policy. The PERF writers, big city political appointed police chiefs and other executives, don’t like to make arrests of the mainly black and Hispanic constituents of big city mayors who appoint these same police chiefs and command staff.

Correspondingly, the Obama Regime does not like the idea of aggressive immigration law enforcement. And the PERF report reflected that concern, BPAs are too “aggressive” in the execution of their immigration law enforcement duties.  The Obama Regime does not want aggressive immigration law enforcement and to discourage BPAs from doing their job, the agents are being told that they should not do their duty.  More importantly the agents are told that if they do their duty too well, they will be either be disciplined by the Regime or violently attacked by the drug and alien smuggler constituency of the Obama Regime.

As evidence of the aim of the Regime to less enforcement and create no-go areas, consider this case of the shooting of Jose Antonio Elena Rodriguez, known as the Rat, a Mexican illegal alien and drug gang member, who was shot while throwing rocks at BPAs in an effort to recover a lost load of drugs.

HuffPo By Brian Skoloff 02/07/13
Border Patrol Shot Mexican Teen Jose Antonio Elena Rodriguez 8 Times: Autopsy
The Border Patrol has said several agents responded the night of Oct. 10 to reports of suspected drug smugglers along the border fence in Nogales, Ariz. The agents watched two people abandon a load of narcotics, then run back to Mexico, according to the agency. The agents were then pelted by rocks thrown from across the border. The Border Patrol said the people ignored orders to stop, and an agent opened fire.
Rodriguez's body was found on a sidewalk in Mexico not far from the fence.
Border Patrol agents generally are allowed to use lethal force against rock throwers, as the agency considers stones deadly weapons. It's a common all along the border for agents to be hit with rocks, often to distract them from making arrests. Several investigations into similar shootings are under way in Arizona and Texas.

Case closed.  This was no innocent teenager as the left has claimed, but a drug smuggler using deadly violence in support of his criminal activity.  And he is clearly the Obama Regime constituency in the controversy over the use of deadly force.

And it is also clear in the case of another Mexican “teen,” Sergio Adrian Hernandez Guereca, who in this case was rocking a BPA who had arrested an illegal alien who ran across the border.  Clearly Guereca was acting in support of alien smuggling just as Rodriguez was acting in support of drug smuggling.

HuffPo June 10, 2010

The U.S. has insisted the border patrol agent was defending himself after being pelted with big stones while trying to detain illegal immigrants on the U.S. side of the Rio Grande. Both governments have hinted at misconduct by the other country's law enforcement.
The video shows 4 people running from the U.S. side underneath a railroad bridge linking the two nations. A U.S. border agent then emerges on his bicycle and manages to detain one of the individuals, who he then drags along the concrete. The agent then lifts his arm, holding what appears to be a firearm, and points it toward the Mexico side in the direction of one of the other suspects. A few moments later, 2 shots are heard being fired toward the Mexican side. A third shot is heard later in the video.
According to CNN, witnesses can he heard on the video, in Spanish, saying "they're throwing rocks" as well as "they hit him... they hit him."
Both cases, while decried by the illegal alien lobby, were clear and convincing justified uses of force as the agents were under violent and deadly attack by Mexican nationals throwing rocks, deadly weapons.  Something the Obama Regime does not care about.

More importantly, in both cases, the agents were doing what law enforcement is supposed to do: go in harm’s way to enforce the laws of the United States.  Law enforcement is not for shrinking violets.  It is a job for men.  It is not the purpose of law enforcement to run when confronted with violations of law.  Their purpose is to move forward to engage a law breaker and bring that law breaker to justice, not run and hide.  The profession and purpose of law enforcement is to be “aggressive.”

However, the Obama Regime does not want an aggressive response to immigration law violations and the new use-of-force policy is specifically designed to discourage the enforcement of immigration laws by threatening those who enforce the law with discipline and dismissal for executing their Oath of Office, to see that the laws of the United States are faithfully executed.

More Evidence The Children's Border Jihad Is Fraudulent

The neo-Marxist left is claiming that social conditions in Central America are driving the exodus to the Rio Grande Valley and refuge in the United States.  Of course, the social conditions in Central America have always been the same, poor, nasty, and brutish.  There have been no changes. What has changed is the foolishness of Americans who will accept any lie from a poor brown person.  And the fraud has been expose.  The claims of oppression from illegal aliens from Central America are lies.  Lies because the illegal aliens flooding the border need a cheat sheet to remember to give the correct answers in claiming asylum in the United States.

The Blaze June 26, 2014 by Sara Carter
This Is a ‘Cheat Sheet’ Found at the Border to Coach Illegals on How to Stay in the U.S.
U.S. law enforcement officials have been finding “cheat sheets” along the border used by illegal immigrants to try to stay in the United States and not get deported after they’ve been caught.
The notes, believed to be supplied by human trafficking groups, give pointers in Spanish on what immigrants should say when confronted by border authorities.
One federal law enforcement official dubbed them “illegal alien cheat sheets.”
A copy of one sheet obtained by TheBlaze lists a series of questions that U.S. authorities will consider in granting someone an immigration hearing.
“It’s proof they are told what to say,” a Department of Homeland Security official told TheBlaze. Often times, the sheets get “destroyed or thrown away before illegal aliens are apprehended.”

It also proves the illegal aliens have very low IQs and will not be contributing to this country because of their stupidity.  If you can't get these questions correct without a cheat sheet, you aren't going to be able to be anything more than a welfare cheat.

FBI Battles Back Against ICE SVU

The Federal Bureau of Investigation (FBI) has taken up U.S. Customs and Immigration Enforcement (ICE) Special Victims Unit's (SVU) challenge and is hitting back in the area of child prostitution. Well, not child, but teenage, prostitution.  Essentially emancipated or runaway teenagers who don't like their parents.

Breitbart June 23, 2014 by Daniel Nussbaum
FBI Snares 281 Pimps, Rescues 168 Children In Nationwide Sex-Trafficking Sting
The Federal Bureau of Investigation (FBI) rescued 168 child victims of sex-trafficking and arrested 281 suspected pimps in its annual countrywide sex-trafficking crackdown last week.
Operation Cross Country was carried out in 106 U.S. cities, according to an official FBI press release. This year's effort marks the eighth time the FBI has carried out its national child sex-trafficking sting; since 2003, approximately 3,600 sexually exploited minors have been recovered as part of the agency's Innocence Lost program.
"These are not children living in some faraway place, far from everyday life," FBI Director James Comey said in a press conference Monday. "These are our children. On our streets. Our truck stops. Our motels. These are America's children."
The FBI has established 70 Child Exploitation Task Forces (CETFs) nationwide as part of its efforts to reduce violent crime against children. FBI Special Agent Steve Vienneau said these task forces coordinate with all levels of law enforcement: local, state, and federal.

So, the FBI has task forces that deal with the exploitation of teenage prostitutes.  Why does ICE SVU then target this same crime?  ICE SVU duplicates the work of the FBI because it does not want to enforce immigration laws, plain and simple.

Asians Make All Cell Phones

The world is commenting on the lack of diversity in the Facebook workforce. The most interesting comment is the observation by Jessica Guynn, the reporter at USA Today, who claims that Facebook, Apple, and Google make cell phones.

USA Today June 26, 2014 by Jessica Guynn
Status Update: Facebook Not So Diverse
"We build products to connect the world, and this means we need a team that understands and reflects many different communities, backgrounds and cultures," Maxine Williams, Facebook's global head of diversity, said in a blog post.
Technology is a key driver of the U.S. economy. It makes the products from iPhones to Google search that Americans use every day. Yet the companies that make these products do not mirror the demographics of the United States in race, gender or age.

In fact, Apple does not make iPhones, nor does Google make cell phones, nor does Facebook make anything.  The actual product being sold under the Apple brand name, and to a lesser degree the Google brand name, are made by contractors, in the case of iPhones, a Taiwanese conglomerate, Foxconn.  All Apple products are made by Foxconn and other contract suppliers in the Peoples Republic of China.  All of the manufacturing staff at Foxconn facilities are Chinese citizens and of the East Asian race, specifically ethnic Han Chinese, no Mongols, Tibetans, Manchus, or Uighurs are employed at Foxconn plants. Foxconn management itself is dominated by Taiwanese nationals, who also of the Han Chinese race. Even worse, Foxconn has a policy of only hiring women on the assembly line, so an iPhone is made by Han Chinese women.  And for the record, words have gender, human beings have two sexes, male and female.  Words have a masculine, feminine, or neutral gender.

Google has a cell phone line as well,  those sold under the Google name, as well as those running the Google created Android operating system, and all are also almost made in China, though some are made in Taiwan or Korea.  Samsung branded phones are only made in Korea and China.  There are some minor exceptions for other manufacturers, such as Nokai still manufacturing some models in Finland but most are made in Red China. RIM (Blackberry) manufactures phones in several different countries, but if you want a cell phone it is unlikely to be manufactured by a diverse workforce.  It will be manufactured by a singularly un-diverse workforce.

One wonders why Foxconn need not be diverse, but other companies like Facebook, Google, Yahoo, and Apple, engaged in products that connect the world, must have more diversity?  Those companies are more diverse than the manufacturing plants in China and the contract companies that produce those world connecting cell phones.

Is Guynn in the pay of Red China?  Why is she diverting our attention from the racism and lack of diversity at Foxconn?  Does she hold stock in Foxconn?  Is she just a white Uncle Tom?  Is she a man-hating lesbian?  What is her motivation?  Is she working to cover-up the rampant suicides at Foxconn plants? Does she get paid to write this tripe?

Julie Myers And The Children's Crusade

My latest up on VDare.  Contribute here.

The Children’s Crusade—Gravy Train For Treason Lobbyists, Including Bush Turncoat Julie Myers Wood

While the Children’s Crusade against the historic American nationcontinues, powerful forces are arguing that America needs not just more illegal immigrants, but more lawyers to represent them. And the very people arguing for yet another wealth transfer away from Americans are those who were once trusted to enforce the laws.
Julie Myers Wood was the head of U.S. Immigrations and Customs Enforcement from 2006 to 2008 under “conservative” President George W. Bush. Now that she’s done her time failing to enforce immigration law, she’s moved on to lobbying for more illegal immigration, to the cheers of the liberal Main Stream Media. One Mary Sanchez in the Kansas City Star fawns...

Another Winner In The Criminal Alien Amnesty

Another criminal alien has won the Obama Regime Criminal Alien Amnesty.  And it appears that the Regime is conspiring with government officials at the local level to not only end deportation of convicted criminals, but overturn the convictions based on their immigration status.  So, all the soul brothers who are doing time are out of luck, Mexican and Asian immigrants are getting better treatment from an ostensibly black president.  But lets face it, Michelle and Barack only use black people for votes; they really don't like associating with blacks, except as servants, or hobnobbing with celebrities.

Washington Times June 23, 2014 by Alan Zagier
US Changes Mind About Deporting Missouri Woman
ST. LOUIS (AP) - A Missouri woman who faced deportation to her native Thailand after losing her green card over a felony theft conviction will remain in the U.S. following a last-minute reversal by immigration officials.
Komdown “Dow” Boyer, who moved to the U.S. as a child after her mother married an American soldier, was convicted late last year of stealing money from the pizza restaurant where she had worked a decade, most recently as general manager. Boyer, 44, was sentenced to probation and ordered to pay about $51,000 in restitution after pleading guilty to felony theft. She said she needed the money for bills after her husband, a mechanic, had his legs crushed by a car.

Talk about a crime involving moral turpitude.  Komdown was stealing from her employer for over ten years.

And guess who was instrumental in obtaining her release, a former DHS employee and Muslim:

Defense attorney Javad Khazaeli told The Associated Press his client was taken suddenly on Monday from a Missouri county jail to an international flight preparing to leave Chicago’s O’Hare International Airport before the decision was overturned less than one hour before the scheduled takeoff. Khazaeli, a former federal counter-terrorism prosecutor for the Department of Homeland Security, said the government has that discretion in some low-level offenses.

Now, there are no "counter-terrorism prosecutors" in the Department of Homeland Security.  All criminal prosecutions in the Federal criminal justice system are the responsibility of the Department of Justice.  Probably what the not very well educated reporter was referring to was DHS Immigration and Customs Enforcement (ICE) Office of the Principal Legal Advisor (OPLA), the office for ICE attorneys who "prosecute" deportation cases before the Executive Office for Immigration Review (EOIR), the so-called immigration courts.  Which implies that Khazaeli was illegally lobbying his former employer, the OPLA, for special treatment of his client.

Since Khazaeli is both a former DHS attorney and a currently practicing attorney he should know that such preferential treatment received by his client was illegal as well, as it was the result of an illegal act by a DHS employee, the failure of a DHS employee to do their duty, remove criminal aliens.

“It took awhile, but we got the case in front of the right people,” said Khazaeli, who coincidentally was driving to St. Louis from his former home in Chicago Monday when Boyer’s husband left a series of messages on his cellphone. “They exercised discretion at the last minute.”

If discretion was available, why at the last minute?  Except that there is no "discretion" for ICE to not deport a deportable alien, especially one with a major felony conviction.  And it is clear that Khazaeli used his DHS employment and contacts to get it "in front of the right people."  Certainly that option is not available to other convicted alien felons.  There is no "who you know" provision in immigration law, especially since "shall" is part of the Immigration and Nationality Act regarding convicted felons, as in "shall" remove said aliens from the United States.

Shawn Neudauer, a spokesman for U.S. Immigration and Customs Enforcement in Washington, said the agency released Boyer from custody and placed her on supervised release while it “conducts a further review of her case.”

Further review?  What further review?  She is a convicted felon and has been ordered deported by the EOIR.  There is nothing for ICE to investigate.

But we soon find collusion between DHS and local prosecutors:

St. Francois County Prosecuting Attorney Jerrod Mahurin told the Daily Journal newspaper of Park Hills, Missouri that he will join Bower’s attorneys in asking a judge to set aside her conviction, which both the prosecutor and the defense lawyers said was obtained without Boyer, who was represented by another attorney at trial, being fully informed that a guilty plea could mean a forced separation from her family.

The fix certainly is in.  A local prosecutor agreeing to have a case thrown out even though there is a guilty plea? And throwing it not because she is innocent, but because allegedly did not realize that she could be deported?  But even if you believe the nonsense that she did not believe a confession would result in her deportation, then you refile the case based on the evidence you had that led the defendant to plead guilty.  Proprietorial ethics prevent a prosecutor from bringing cases unless the prosecuting attorney has evidence beyond a reasonable doubt as to guilt.  Clearly Mahurin is an unethical prosecutor.  The only question remains as to where he is erring in his ethics.

Even worse, this criminal has learned her lesson.  Not the lesson about right and wrong, about not stealing $51,000 from your employer, but about getting naturalized so one cannot be deported.  She knows now to commit the next crime after naturalization.

Khazaeli said the legal case against Boyer continues as he negotiates with the local prosecutor to get her conviction vacated.
“This case is nowhere near over,” the attorney said, adding that Boyer plans to change her status from legal permanent resident to naturalized citizen once the criminal case is resolved.

And I don't think Cici's Pizza is going to get their money back.  And it serves them right for supporting their criminal employee.  And for the record, she cannot be naturalized because she has admitted to essential elements of a crime involving moral turpitude.  She is not of "good moral character," a requirement for naturalization.  Also it is fraudulent to naturalize to avoid deportation.

ICE: Missing in Action XIX

As part of the ongoing criminal alien amnesty, U.S. Immigration and Customs Enforcement (ICE) has dropped the ball again.  This time a multiple offender Muslim from Algeria.

Ars Technica June 13, 2014 by Joe Silver
Motorcyclist Who Filmed, Uploaded Police Flight Video To Serve Hard Time
In a bizarre (but somewhat unsurprising) twist of fate, a motorcyclist who recorded video of himself speeding away from a police car while wearing a court-ordered GPS anklet for an unrelated offense—and who then proceeded to post the video footage to YouTube—has been apprehended, tried, and sentenced to a four-year prison term.
Hamza Ali Ben Ali, of Plainfield, Illinois, successfully evaded a police officer’s attempt to stop his vehicle back in October 2012. Ali then waited two weeks before uploading to YouTube the seven-and-a-half minutes of uncut video footage shot from a camera affixed to his Honda CBR 1000 motorcycle, reports The Chicago Tribune.
The footage shows Ali’s motorcycle accelerating away from a police car with flashing lights after the officer signaled for him to stop at a gas station. The video footage then shows the officer break away from the pursuit only to catch up to the motorcyclist before again losing sight of the 31-year-old suspect as he sped away.

And a long criminal record that ICE has apparently ignored.

Ali—an Algerian citizen with prior convictions, including aggravated battery against a police officer and possession of a stolen motor vehicle—might have gotten away scot free since his motorcycle did not have plates, but the combination of information gleaned from the YouTube video and the GPS anklet led the cops to his doorstep.

So, ICE which claims that criminal aliens are its "priority," has let this illegal alien from a terrorism source country remain in the U.S. for years.  More evidence of the Obama Regime Administrative Amnesty For Criminals.

On a happier note, this rice-rocket scientist did get 4 years in the not very pleasant Illinois State Prison system.

Cover For Criminal Alien Amnesty

The Obama Regime's amnesty plans appear to be emerging from the juvenile illegal alien fiasco emerging in Texas.  Complete amnesty appears to be the plan as the mask slips from the Regime's plans.  And juvenile gang members are the latest beneficiaries.

First:

Breitbart June 14, 2014 by Tony Lee
Report: Obama Admin Knowingly Letting Illegal Immigrant Gang Members Into US
President Barack Obama's administration is knowingly allowing illegal immigrant gangsters from Mexico and Central America into the United States, and some are even being reunited with their family members.
The gang members reportedly belong to some of the most dangerous gangs in Central America and Mexico, like MS-13, but Border Patrol agents are handcuffed, especially if the illegal immigrants are deemed to be "minors."
According to National Review, Border Patrol agents who "recognize the gang-affiliated tattoos of minors crossing the border must treat them the same as anybody else." An Arizona Border Control agent said that it was upsetting that a lot of the gang members are "16 or 17 years old and a lot of them are not going to face deportation."
Chris Cabrera, the vice president of the National Border Patrol Council Local 3307 in the Rio Grande Valley told National Review that Border Patrol agents have reunited dangerous gang members with their families in the United States. He asked, “If he’s a confirmed gang member in his own country, why are we letting him in here?”

Teen Gang Members Set Free After Illegally Entering U.S.
Covered from head to toe in tattoos, MS-13 gang members are easy to point out.

National Border Patrol council spokesman Chris Cabrera said the MS-13 gang is notorious for violence in Mexico and Central America.

"They will usually have MS-13 tattooed they are usually pretty predominant with their tattoos a lot of face tattoos," said Chris Cabrera with the National Border Patrol Council.

Action 4 News confirmed through an investigation that members of the gang and others in Mexico are now sending their young recruits here.
And to the surprise of many, those that are under the age of 17 are detained and later set free on U.S. soil.

Criminal aliens appear to be a priority for the Regime, but the priority is for their release into the country.

More Evidence Illegal Aliens Are Economic Migrants

The recent surge of illegal aliens to the border is both orchestrated by the Obama Regime and the illegal aliens are motivated by economics, not persecution.  Most are coming to join relatives already here and use well established infrastructure that assists illegal immigration.

Immigrants Recently Released In El Paso Tell Their Stories
EL PASO Jasuri Hernandez left her home in El Salvador in mid-May on a 2,000-mile trek to reunite with her husband.
Her traveling companion through the perilous journey was her 6-year-old daughter.
"I had friends who had made it to this country and it had been easy for them. I wanted a better future for my daughter, but I never realized how hard it was going to be," she said in Spanish on Wednesday, as she waited at the Downtown Greyhound station for a bus to San Antonio and then Austin, where her husband has worked in construction for two years.

And:

Josselin Iria of Honduras is one of those apprehended June 7 at the Paso del Norte port of entry. She was released Tuesday.
"The reason why we left is because there's no work," Iria said in Spanish. "Getting a job there is difficult. There is violence, extortion and war."

And there is a well funded support network for illegal aliens:

Ruben Garcia, the executive director of Annunciation House, which helps immigrants, said he was aware that immigration officials were releasing undocumented immigrants and leaving them to fend for themselves.
ICE officials coordinated with Annunciation House during the processing of the 270 undocumented immigrants brought to El Paso.
After their release, the organization provided the immigrants with food and shelter. Despite the effort, ICE still is releasing some immigrants without informing local shelters.
"We are aware that has happened," Garcia said. "We've have been saying to ICE there's no need for it to happen that way. Drop them off at Annunciation House."

"Drop them off." That means that there is large amounts of money for illegal aliens.

And even enough money to buy plane and bus tickets:

Once undocumented immigrants were released by immigration officials, staff of Annunciation House offered them food and shelter.
The organization also assisted many immigrants by buying plane and bus tickets so they can unite with family members who live in other U.S. cities.

And, again, they are coming to join relatives already here.  That means that the failure of the Obama Regime to arrest illegal aliens already here just encourages more illegal immigration.

And Mexico is providing infrastructure for these illegal aliens to pass through to the United States.

Once she reached Mexico, Hernandez said she felt relief to find a building that's known for helping undocumented immigrants.
"I don't know the name of it, but it's a beautiful building and they can house hundreds. And they treat us very well, giving us a place to sleep, take a bath and feed us for 72 hours," she said.

And Mexico ignores the smuggling of the illegal aliens over its own border:

From Mexico City, Hernandez bought another bus ticket to Nuevo Laredo. Once there, she knew the only way to cross into the United States was to swim or on a "flotador" (a makeshift raft).

And she plans to game the system in a hope to stay:

"I know that you can make a better life here. My friends have done it," she said.
After a weeklong journey that took her from Honduras, through Mexico and then El Paso, Iria and her 5-year-old daughter, Valery Ramirez, planned to arrive in North Carolina on Thursday. Iria's mother, Rosadilia Leon, lives there and that's where Iria has her court date. She said she had every reason to appear at her deportation procedure June 30 because she would rather exhaust her options through the immigration system than to go back to Honduras.
"It was worth the risk because I want a better future for my daughter," Iria said in Spanish. "I wasn't able to give her everything over there (Honduras).

Endless appeals until the alien wins.  Given that the Obama Regime is dismissing deportation cases in records numbers, this is very likely.

And the back-up plan is asylum applications based on being a crime victim.

Patrick Timmons, a human rights lawyer in Mexico, on Monday said in El Paso that Honduras was the most violent country in the world, with a homicide rate of 90 people per 100,000.
"I think it's important to point out that Honduras is a terrible country when it comes to statistics of violence against women," Timmons added. "Which means to say that each one of these statistics is a human story. A human story where people are fleeing for their lives because they have no other choice left to them in order to maintain their survival."
Timmons said this year, 54 women died each month in Honduras as a result of violence. That number, Timmons said, is up from 32 women per month in 2010.

I am thinking that even more men die as a result of violence in Honduras.

It is clear that this surge of illegal immigration is orchestrated with well briefed illegal aliens offered a support network, coaching, and a strategy to avoid deportation.  In fact it is a conspiracy to violate the laws of the United States where the government of the United States is working with the government of Mexico to violate the laws of the United States.

More Proof That The Juvenile Surge Was Planned

More evidence is coming in providing evidence upon evidence that the Obama Regime planned the "Invasion Of The Ninos."

First, despite Vice President Joe Biden's trip to Guatemala to discourage the influx of juvenile illegal aliens, while there Biden did not include deportation as part of his effort to discourage illegal immigration.

Fox News Latino June 20, 2014 by Associated Press
Biden Dispatched To Guatemala, Warns U.S. Will Start Detaining Immigrants
GUATEMALA (AP) –  The U.S. will start to detain families at the border instead of releasing them on their own recognizance, warned Vice President Joe Biden in Guatemala City, where he held a multilateral meeting Friday with Guatamala's president Otto Perez Molina, Salvadoran President Salvador Sanchez Ceren and high-ranking ministers from Honduras and Mexico.

Detention does not do much to discourage illegal immigration unless it is backed up by certain deportation, which Biden conspicuously did not announce.  There has been no evidence that the Regime is planning to deport these illegal aliens and therefore it appears that most of the juvenile illegal aliens and their mothers will be allowed to stay.

Which leads up to the second part of the Obama Regime plan:

Roll Call June 9, 2014 by Jennifer Scholtes
White House Ducks Questions on Deporting Child Migrants
The Obama administration stressed Monday that child migrants entering the country illegally must go through deportation proceedings, but continued to avoid answering questions about how many of them actually show up and end up getting deported.
On a background call with reporters, senior administration officials reiterated that the unaccompanied minors are ineligible for “deferred action” waivers from deportation.
But officials moved on without offering statistics or estimates about how many kids are ultimately being sent back to their home countries.

Even on background, the Regime will not promise deportation, which is within its authority.  More telling is that the Regime keeps reiterating that the juvenile illegal aliens are ineligible for the Deferred Action For Childhood Arrivals (DACA) Amnesty, as if the DACA Amnesty was the only part of the Administrative Amnesty available to illegal aliens.  The Regime long ago announced that only convicted criminals would be a "priority" for deportation and these juvenile illegal aliens are not within any of the Regime "priorities," especially now that recent illegal entry is now another former "priority."  It appears the "priority" of deporting recent illegal entrants is going the same way of the "priority" of deporting criminal aliens.

But the final piece that exposes the intent of the Regime in this crisis is that it was planning as far back as January 2014, and given how slow the government moves, well before January 2014, for this manufactured "crisis."  (h/t Weasel Zippers)

FedBizOpps.gov
Escort Services for Unaccompanied Alien Children
U.S. Immigration and Customs Enforcement (ICE), a component of the Department of Homeland Security (DHS), has a continuing and mission critical responsibility for accepting custody of Unaccompanied Alien Children (UAC) from U.S. Border Patrol and other Federal agencies and transporting these juveniles to Office of Refugee Resettlement (ORR) shelters located throughout the continental United States. ICE is seeking the services of a responsible vendor that shares the philosophy of treating all UAC with dignity and respect, while adhering to standard operating procedures and policies that allow for an effective, efficient, and incident free transport. The Contractor shall provide unarmed escort staff, including management, supervision, manpower, training, certifications, licenses, drug testing, equipment, and supplies necessary to provide on-demand escort services for non-criminal/non-delinquent unaccompanied alien children ages infant to 17 years of age, seven (7) days a week, 365 days a year. Transport will be required for either category of UAC or individual juveniles, to include both male and female juveniles. There will be approximately 65,000 UAC in total...

It is clear that the Obama Regime manufactured the crisis as part of its general plan to elect a new people, but John Boehner plans to acquiesce in allowing this surge of juvenile illegal aliens and their parents to remain in the United States.

The Daily Caller June 20, 2014 by Niel Munro
Letter: Boehner Blames Obama For ‘Overwhelming’ Border Flood
[Pay no attention to the title, the DC is fronting for a Boehner Amnesty.]
There are several steps that we call on you and your administration to take immediately to enforce our laws, stem the tide of migrants, protect the victims, and ensure that these individuals are dealt with in a humane manner that is consistent with American ideals of compassion and family unity...
We believe that all families should be detained in clean, safe facilities that are in compliance with existing federal statute and case law.  Until adequate housing is made available, Alternatives to Detention (ATD) should be deployed to ensure compliance with court appearances and deportation hearings.

There are, however, no alternatives to detention that ensure compliance with the appearance of aliens in deportation hearings.  Most released never appear at hearings, at least 59%, but likely much more. Detention is the only means to ensure an illegal alien appears at their hearing and John Boehner wants to give away the store.  But it doesn't matter since he supports family unity for these illegal aliens in the United States.

More Lies From The Sandwich

Ruben "The Sandwich" Navarrette is at it again.  The alleged "conservative" professional Mexican is spreading lies about the Border Patrol and the Department of Homeland Security regarding the flood of illegal alien juveniles crashing over our border.

CNN June 12, 2014 by Ruben Navarrette
Border Detention Of Children Shames America
San Diego, Calif. (CNN) -- Where did our country go? Americans are known around the world as a good and compassionate people -- with a soft spot for children.
And, although you wouldn't know it from watching a ghastly detention drama currently playing out in the Southwest, law enforcement and the legal system have built-in safeguards that acknowledge the simple fact that children are different from adults, and thus cannot be treated the same.
The Department of Homeland Security and Immigration and Customs Enforcement seem to have forgotten that. These agencies are currently warehousing hundreds of children from Guatemala, Honduras and El Salvador who have, in recent months, streamed across the Texas-Mexico border.
According to media reports, the group is a mixture of unaccompanied minors sent by their parents, toddlers traveling with their mothers, and children who are alone and trying to reunite with their parents in the United States.

Well, The Sandwich does not offer a solution to this warehousing problem.  What should be done with these criminals who enter illegally.  In any even, The Sandwich does not know that as soon as the juveniles are processed, they are turned over to the Department of Health and Human Services, so there is no fault here with DHS and the Border Patrol.  These juveniles have to be held somewhere and a jail cell it is until the welfare department picks them up and starts spending tax-payer dollars on The Sandwiches relatives.

Next The Sandwich tells more lies:

According to immigration attorneys who represent some of these children, many are being held in freezing holding cells intended for fewer inhabitants and shorter stays. These aren't jail cells as much as temporary holding rooms nicknamed "hieleras," or ice chests. CNN has reported that the border facilities lack "enough food, beds or sanitary facilities to provide for the children."

These are the lucky ones. Federal immigration officials have loaded hundreds of others on buses and transported them across state lines, only to drop them at bus stations in states like Arizona with nothing more than a notice to appear before an immigration judge -- a scribbled piece of paper representing a feeble attempt at accountability, which most of these people are likely to ignore as they wander off and fade into society.

No juveniles are being released. The only aliens being released are those who are adults, and  their children.  And these aliens know that they will be released if they have children with them.  That is part of the plan.  But The Sandwich is in denial.  He denies that these aliens are gaming the Obama Regime Administrative Amnesty, but we know from the local press in Central America, that is the plan.

Interviews with the juveniles proves it so:

US News And World Report June 3, 2014
Child Migrants Crossing Border Into US Southwest Driven By Violence, Poverty Back Home
[Ignore the headline, the first paragraph of the story proves it is the Obama Regime Administrative Amnesty that is causing the influx.]
REYNOSA, Mexico (AP) — Before 14-year-old Brian Duran set out from central Honduras in mid-April, he heard that child migrants who turned themselves in to the U.S. Border Patrol were being cared for and not deported.
He knew that a couple of friends who left before he did had given themselves up after crossing and been reunited with family in the U.S. Sitting inside the walled compound of a migrant shelter in this Mexican border city across the Rio Grande from Texas, Brian wonders if that is still the case as he seeks a way to make his own crossing.

The Sandwich claims the influx is caused by Central American failed states, but none of the countries of Central America are failed states.  They are poor, but not failed states, unlike Somalia or Pakistan.

Why are they coming? They're fleeing countries like those in Central America that are quite literally falling apart, with little or failed infrastructure in the military or law enforcement, and thus unable to fend off encroachment by Mexican drug cartels looking for new outposts from which to operate.

The most far-fetched theory comes from restrictionists and nativists who insist that what enticed these children from Central America to cross the U.S.-Mexico border is an expectation that Obama is poised to use his executive power to grant a kind of "amnesty" to millions of undocumented.

If people in Central America believe that, they could be the only folks in this hemisphere who do.

Someone needs to introduce The Sandwich to Brian Duran.  Duran set out on his journey because he knew he would be set free to remain, as have all those obese Mexicans and Central Americans released in Arizona.

The Sandwich says these juveniles and their parents are refugees from violence:

Besides, from all appearances, the border kids aren't immigrants. They're refugees. They're here because they couldn't be anywhere else, and they had no choice but to come. We're supposed to take in people like this, and offer them safe haven.

But according to those who know, like Guatamalen officials, that is not true.

Guatemalan Ambassador Says Children Not Fleeing Due To Violence
Julio Ligorria, the Guatemalan ambassador to the United States, said the surge of Guatemalan children traveling to the U.S. is not due to violence, as the Obama Administration has suggested.
Appearing on the Univision Sunday talk show "Al Punto" he said the surge is the result of: an interest in being with their parents; few opportunities at home; and the claims of smugglers who promise illegal-alien parents in the U.S. that the government will deliver their children.
Jorge Ramos, the host of the talk show suggested that children were leaving because of increased gang violence. But Ligorria rejected that notion saying the Guatemalan children were coming from north Guatemala, not the eastern part where gang violence has been concentrated. He said, "So violence is not the reason. It's essentially a matter of lack of opportunities, of trying to reach the American dream, but also to achieve family reunification. Many of the parents of these children are in the United States, and the children go to find them…The coyotes are taking advantage of the circumstances and conditions."

What is shameful about this is the Mexican government allowing these illegal aliens to cross its borders on the way to the United States.  What is shameful is the illegal aliens who pay smugglers to bring their children on such a perilous journey.  What is shameful is a liar like Navarrette blaming Border Patrol Agents for the criminal acts of illegal aliens.  What is shameful is Navarrette lying to cover up for the Obama Regime.

Another Gift From Mexico

The old adage is that Mexico is cursed by its distance from God and it proximity to the United States. In fact, the opposite is true.  Mexico is blessed by its proximity to the United States.  It is Divine Punishment for America to be so close to Mexico.  Exhibit 1,476 in the indictment of Mexico for its crimes against the United States; a flood of high quality heroin.  Gracias por nada, caballeros.

USA Today by Paul Giblin June 12, 2014
Heroin's Hidden Journey
Nearly All Heroin Fueling A U.S. Resurgence Enters Over The 1,933-Mile Mexico Border.
Nearly all of the heroin fueling a U.S. resurgence enters the country over the 1,933-mile Mexico border, according to the U.S. Drug Enforcement Administration.
Customs officers in Nogales have seized more heroin in the first six months of fiscal 2014 than during each of the past three full fiscal years, Agosttini said.
Most is hidden in vehicles crossing through ports of entry like the bustling Nogales gate. Smaller amounts are carried in on foot by men dubbed "mules," hiking established desert smuggling routes. Some is ferried in by plane or boat.
Most is taken to stash houses in cities near the international line — San Diego and Los Angeles; Tucson and Phoenix; and El Paso, Laredo, McAllen and Brownsville, Texas. From there, operatives drive loads along interstate freeways to destinations across the country. The operations are highly compartmentalized, said Douglas Coleman, special agent in charge of the Phoenix Division of the DEA.

Heroin, cocaine, Central American juveniles.  What accursedness is our proximity to Mexico.

The Accidental Arrest

In a curious event, at least for the outsider, U.S. Immigration and Customs Enforcement Special Victims Unit (ICE SVU) arrested a number of illegal aliens, mostly Hispanic illegal aliens, but some Chinese as well, and, no, not Chinese spies or hackers, but poor slubs working for sub-minimum wage at Chinese restaurants in College Park. Although the press reported it as an immigration raid, ICE SVU was in denial mode, and participation of other agencies suggest that these are accidental, or more accurately, immigration arrests incidental to another non-immigration related criminal investigation.

Feds Raid State College Area Asian Restaurants, Target Undocumented Workers
STATE COLLEGE — It was just before 11 a.m. Thursday, but at a number of Asian restaurants in State College, the lunch rush never happened.
Instead, doors were locked, employees were questioned and some people were taken away by authorities.
Local, state and federal law enforcement detained at least 13 people in what U.S. Rep. Glenn Thompson said is an investigation of undocumented workers...
He quickly realized that they were law enforcement vehicles, about 25 of them, from various agencies.

Twenty five agencies?  And only 13 arrests.  Sounds like overkill.  Certainly not for a mere work-site enforcement raid.  Perhaps a slavery or peonage investigation, where the "victims" will win the green card lottery.

Notice though that ICE SVU is apologetic and evasive on whether this was an immigration enforcement raid.

Investigators said the activity is part of a “targeted federal investigation,” but declined further comment. A U.S. Department of Homeland Security truck parked behind the State College Police Department. Officers from the state Attorney General’s Office joined them. A large van blocked visibility to the department’s sally port, the secured gateway where people in custody are brought in by police.

State Attorney General's office?  For a work-site enforcement raid?  Suspicious. But why is ICE SVU so quite about these arrests?  It usually touts to the world its arrests.

Thad Cochran’s Unanswered Questions
If Thad Cochran wins tomorrow, all of the questions that he has avoided during the primary will continue to fester in the general election. And when the answers finally do come out, Travis Childers and the Democrats will reap the rewards.
Does Cochran actually own a home in Mississippi?
Who paid for the building in Washington where he “rents an apartment”?
Why has Kay Webber, his executive assistant, hosted Democratic fundraisers in the same building where Cochran lives?

Courthouse Amnesty Confirmed

The black Secretary of Homeland Security has confirmed that the Department of Homeland Security will no longer be arresting illegal aliens at courthouses.  Apparently illegal aliens have the "right" to go to court with out being arrested.  That right does not apply to Americans, who can and will be arrested at courthouses on a daily basis.

Washington Times May 29, 2014 by Stephen Dinan
DHS Chief Jeh Johnson To Ease Fears On ‘SecureCommunities’ But Won’t Scrap Deportation Program
Mr. Johnson said he doesn’t want agents trying to capture illegal immigrants at courthouses because those who try to access government services deserve special protection at such facilities.

And in a fit of incoherence, Johnson said there was a limit to the Obama Regime Administrative Amnesty.

He also said there are limits to prosecutorial discretion, though he gave mixed messages about whether the administration’s Deferred Action for Childhood Arrivals, a nondeportation policy for young adult illegal immigrants, should be applied case by case or to a whole class of people.

Such a non-denial denial preceded the DACA amnesty as well.

Johnson also appeared incoherent with a statement that Secure Communities was on the chopping block, wanting it to be modified to meet the demands of States and localities who oppose it.

“I want a fresh start to this program, and I want a fresh conversation with mayors and governors around the country to make this program work more effectively,” Mr. Johnson told Congress in a wide-ranging hearing in which the secretary laid out some of his broadest public thoughts yet about how immigration laws should be enforced.

It appears that the incoherence of Johnson's statements are just public relations fig leaf  to enable John Boehner to push through amnesty in the summer.
