Kritarchs Strike Again, Put Them In Their Place

But eventually Trump and the GOP Congress must act to reclaim immigration policy from these would-be “kritarchs”—who increasingly act as if they are the only meaningful branch of government...

Australia Climbs The Height Of Hypocricy

Australia has insultingly claimed that President Donald J. Trump has a moral and legal responsibility to accept as refugees the economic migrants detained by Australia in off-shore camps because of an unwritten and unverified agreement with Barack Hussein Obama, who is no longer President of the United States.  However, besides the fact that Australia has rejected the refugee claims of the detainees, Australia has rejected the alleged moral obligation to adhere to unwritten agreements.  This time, Australia has been called out by the United Nations (UN) on an apparent unwritten agreement that Australia entered into to accept a certain number of refugees.

The United Nations High Commissioner for Refugees has accused the Australian government of reneging on a “clear understanding” that some refugees detained offshore who have close family ties in Australia could be resettled in the country.
In a statement on Monday, the commissioner, Filippo Grandi, said the United Nations agency had agreed in November to help with the relocation to the United States of refugees in detention centers on Manus Island in Papua New Guinea and on the island nation of Nauru after Washington agreed to take in hundreds of refugees being held by Australia at those centers. But the agency did so, Mr. Grandi said, on the condition that some refugees would be resettled in Australia.
“We agreed to do so on the clear understanding that vulnerable refugees with close family ties in Australia would ultimately be allowed to settle there,” Mr. Grandi said.

But despite the claim by the UN that a written agreement existed which they could not release, the Ozzies were quite adamant, no refugees allowed!

As recently as Sunday, the Australian immigration minister, Peter Dutton, said refugees would “not be coming to Australia.”
In a statement on Monday, a spokeswoman for the immigration department said: “The position of the coalition government has been clear and consistent: Those transferred” to regional processing centers “will never settle in Australia.”

One applauds the stand by Australia, but fobbing off their problem on the United States is not acceptable, and the Aussies should be held accountable to their own standard when they hold us to that same standard.

President Trump should have stuck to his guns on his initial reaction and pledge to reject those refugees.  And this new revelation about Aussie double dealing should be the basis for Trump to order the Department of State (DOS) and the U.S. Citizenship and Immigration Services (USCIS) not to return to the Australian camps on Nauru and Manus Island.  At this moment, Trump had the courage to withdrawal those officers from the Islands once the 50,000 cap on refugees was reached, but Australia is claiming that the officers will return once the new fiscal year starts in October to renew processing.

Mr Dutton, who will soon take responsibility for a newly announced super portfolio overseeing Australia's domestic security, said he would close the centre "tomorrow" but was at the mercy of an American timetable.
An agreement was struck between Australia and the United States in the dying days of the Obama administration to resettle up to 1250 of the asylum seekers detained on the island.
Donald Trump has said he would honour the deal but the president has slashed the US's overall refugee intake, which has bumped the Manus Island resettlement to October 31.
'We have been caught up in the US process, they have a quota each year," he told Sky News.

The end of the fiscal year, the insults from Turnbull, and the news that Australia is reneging on a commitment to the UN should be sufficient political cover to end the agreement, if there ever was a need for cover.  American national interests should have been enough reason for ending the bad deal. National interest is enough reason for Australia to refuse refugees, why not the United States?

ICE Must Do Sweeps, Raids, And Roundups To Succeed

The Dallas Field Office of U.S. Immigration and Customs Enforcement (ICE) Enforcement And Removal Operations (ERO) is doing much better than the Deep State saboteur who is running the Los Angeles Field Office of ICE ERO.  Arrests there have doubled, while David Marin's arrests are only up 17%.  That's good, but only a good start.  They need to do better, but crying and taking strategies off the table won't help.  The Dallas metro area has 475,000 illegal aliens.  "Targeted operations" won't solve that problem.

On a recent morning in Texas, Fort Worth police arrested a man who threatened to burn down his girlfriend's apartment. The officers also detained two Mexican nationals at the apartment complex because they suspected them of being in the country illegally.
Then police called ICE Fugitive Operations. Soon men with guns and dark ballistic vests swarmed the parking lot.
Under former President Barack Obama, Immigration and Customs Enforcement would not have bothered with either of these immigrants. During the previous administration, ICE agents primarily targeted more serious felons and recent arrivals.
"We would have had to let them go because they did not meet our enforcement priorities at the time," said Chuck Winner, the supervisory detention and deportation officer at the scene.

Well, don't try, do.  It appears that Dallas ERO is off to a good start, but they still have a problem, they aren't just not thinking outside the box to find illegal aliens, but they aren't doing the tried and true successful tactics of years gone by. Raids, roundups, checkpoints, and more of all three.

They still have an attitude there, obviously a hangover from the Bush-Obama years.

ICE Officer Gerry Hutt insists that the agency does not conduct sweeps or roundups. "We don't do raids. We do targeted enforcement operations," he says...
"We have a lead on someone that's in the country illegally or is a criminal alien who's been convicted of a crime and is in this country, we target that person for arrest. We don't go set up checkpoints on the highway. We don't do mass raids at employers, we don't do that," deportation officer Gerry Hutt said.

Unfortunately, "targeted enforcement operations" will just not cut it, those actions will not find or frighten away 475,000 illegal aliens.

Nor will crying about it.

Flores said that over her nearly 30-year career as a federal immigration officer, she always has used discretion. Agents might not detain a single mother, for example, if she is the sole provider for her children. Flores said her decisions are informed by her own difficult upbringing in San Antonio.
"I know what poverty is like. I know what hunger is like," she said, wiping away tears. "I know what physical abuse is like in the household. But I also know what love is like. And I know that personally, professionally, I want this world to be a better place."
She added: "We listen to every case by case when it's brought to our attention that might need special attention."

Nor will wasting time evaluating pleas for leniency on a case-by-case basis.  That isn't your job, your job is finding and arresting illegal aliens, and using enforcement to encourage compliance with the law, which is to frighten illegal aliens into leaving.

But there is a reason Dallas ICE ERO is doing better than David Marin's Los Angeles office:

"Now if we encounter someone in the house that is illegally in the country, in violation of the law, we will go ahead and arrest that person."

David Marin prefers to not arrest illegal aliens, and Dallas does, that is the difference between a 17% increase in arrests and a 100% increase in arrests. What is needed is to go back to the policies of the 70s, 80s, and 90s: raids, checkpoints, and sweeps.  Of course in those years, the Border Patrol did the checkpoints and since Jorge Bush, Border Patrol stations in the interior have been shuttered.  But this is no excuse for ICE ERO and their sister component, ICE Homeland Security Investigations (HSI) to not do the raids and sweeps that they used to do as part of the legacy Immigration and Naturalization Service (INS).



The David Marin Administrative Amnesty

New information has come out about Deep State operative David Marin and his personal campaign to aid and abet illegal aliens, including allowing illegal aliens to remain in the United States and work illegally.  This is surprising since such aid to illegal aliens is, well, illegal.  Such assistance David Marin gives to illegal aliens is a violation of Title 8 United States Code Section 1324, Harboring Illegal Aliens.  We know all this because David Marin, Field Office Director, U.S. Immigration and Customs Enforcement (ICE), Enforcement and Removal Operations (ERO), is a one man public relations campaigner, for himself and illegal aliens.  ERO is the component of the Department of Homeland Security (DHS) charged with finding and removing illegal aliens. Marin appears to be campaigning for something, what that is does not appear to be readily apparent, perhaps a promotion to ERO headquarters.

However, what should be happening is Marin's removal from his office. In another of his guided tours for the press, Marin shows not vigorous enforcement of immigration laws, but the studied sabotage of immigration enforcement.

But I.C.E. is in some ways operating in enemy territory in California, home to more than two million undocumented immigrants and hostile to the idea of mass deportations. Because local law enforcement often will not turn over undocumented immigrants in their custody, I.C.E. must make most of their arrests at homes, at workplaces and out on the street, which is more complicated than simply picking people up from jails — and potentially more dangerous.

So when a team of immigration agents gathered at 4:30 on one already warm morning in June, their chief, David Marin, warned them to stay away from any sign of danger.

Portrayed as a story of enforcement, however the details of the story show something else, a story of wasted resources, non-enforcement, catch-and-release, and a miniature amnesty program for illegal aliens administered by Marin.

First, wasted resources.  While the report does not mention the number of ICE Deportation Officers assigned to the arrests, clues suggest, such as the number of vehicles and the video, suggests ten or so agents.  All to arrest six illegal aliens, but with only 5 arrests in the end.

By lunchtime, the agents had five immigrants in custody: three of their six targets of the day, as well as Mr. Delgado and another man they found in the home of a target. Typically, officers successfully arrest about half the people they are looking for, Mr. Marin said, so this was a good day.

This is a waste of resources for the results of the day.  There are, as the story described, 2 million illegal aliens in the Riverside and Los Angeles county area.  And we know why, buried deep in the story was a deliberate policy not to find too many illegal aliens.

Mr. Marin, 48, has worked in immigration enforcement for more than two decades, starting when the agency was called Immigration and Naturalization Services. In the 1990s, he said, officers would spend much of their time rounding up immigrants in front of home repair stores, routinely arresting people so many times that they would know them by sight. Within hours of a bus ride returning them to Mexico, Mr. Marin said, they would be on their way to the United States again.

So, instead of sending out a ten man team to the sites where day laborers congregate, basically any Lowes or Home Depot, or the day labor centers run by local government that openly cater to illegal aliens, where dozens of arrests could be made, Marin decides to keep his office's arrest numbers as low as possible by assigning resources to the least productive targets as possible, targets that require days of surveillance for example.  In any event, all that day's arrests could have been done by 4 agents.  And in the past would have been done by two agents.

Worse yet, during this little adventure, Marin found out where one illegal alien worked, surprise, a dairy, and did not raid the dairy that undoubtedly has many more illegal aliens working there.

And we know Marin's strategy is not working.  Arrests in the ICE ERO Los Angeles District Office are up only 17%, whereas nationwide arrests are up 40%.

More than 65,000 people have been arrested by the agency since Mr. Trump took office, a nearly 40 percent increase over the same period last year and as sure a sign as any that the United States is a tougher place today to be an undocumented immigrant...
But the agency is under a microscope here. Arrests in the Los Angeles region are up only 17 percent since Mr. Trump took office, far less than in the rest of the country, according to I.C.E. statistics.

And Marin doesn't appear to enjoy doing his job.

“People want to know if we’ve gone into schools, if we’re standing in the market, but that’s not what we do,” Mr. Marin said, driving before dawn. “We know an arrest is a traumatic event for a family. We know the impact it has, and we take it very seriously.”

Not what we do! Well why not?  That is where the illegal aliens are. And any trauma to them is none of your concern.  That is the price of the crimes these illegal aliens are committing.  Marin appears to be on the other side.

Worse yet, Marin has brought back catch-and-release.  Some of those Marin is so proud to have arrested, he released immediately, and with some sort of illegal amnesty as well.

By the afternoon, Mr. Delgado had been released by the immigration agents, who decided that he was not a threat to public safety. He was given a notice that he must comply with any orders from immigration agents and returned to work the next day.

So, David Marin released a previously deported illegal alien with some strange requirement to "comply with any orders from immigration agents" instead of deporting this illegal alien.  There is no such legal program for illegal aliens, there never was, with emphasis on the legal part, and the illegal program was the Obama Regime Administrative Amnesty, the one that caught and released illegal aliens rather than deporting them.  Does David Marin have that authority? No.  And the illegal alien is back working illegally at a dairy that David Marin refused to raid, because that is not what he does.

David Marin actually added to the population of not just run-of-the-mill illegal aliens, but a special class of illegal aliens, absconders.  Fidel Delgado will not be reporting to ICE or following any orders, he will disappear just as his son did.

And to add to the beneficiaries of the David Marin Administrative Amnesty, he failed to see that the wives of two of those aliens arrested were arrested as well.

A couple of officers debated what to do: Should they take both parents and call Child Protective Services for the boy?..
They left the wife behind and led Mr. Delgado to a van, where he was soon shackled. The handcuffs would leave marks.

So, despite the option to call Child Protective Services, Marin ordered his officers to not arrest Maria Rocha.  And that would not be the only illegal alien that got the David Marin Administrative Amnesty that day.

Mr. Lucero, 51, and his wife, Jamie, 47, arrived from a small village in the Mexican state of Puebla more than three decades ago. He had built a thriving landscaping business, tending to yards of homes in upscale Orange County...
Hours after his arrest, Jamie Lucero, her eyes red with tears, pulled out a blue folder with Mr. Lucero’s papers neatly organized, including documents showing he had completed an anger-management program and followed the rules of probation from his domestic violence case. She was planning to take the folder with her when she visited him in detention, though the papers are unlikely to have a bearing on his new deportation case.

So, now we know why arrests in the Los Angeles District Office of ICE ERO are only up 17%. David Marin is conducting an one man amnesty program for illegal aliens.  Time for him to go.  Or be prosecuted.

More Evidence Deep State Operative David Marin Is Fighting President Trump

VDare recently remarked on the Trump Effect on the Weekly Standard and their previous public contempt for immigration enforcement and the "yahoos" who dare to support action against illegal aliens.  [Trump Effect–WEEKLY STANDARD Cover: “On The Immigration Front Lines,” by James Fulford, VDare, July 13, 2017]  James beat me to the punch on this article, but I was happy to see he missed the real import of the article, which gave me the opportunity to provide to VDare and readers of my blog.  Not to take away from James' analysis, which is ever so important, the NeoCons are feeling the heat and acting to protect their position by some Boob Bait For Bubbas, a mildly pro-enforcement article.  Perhaps to match their recent article on Japan, concluding that Japan doesn't need more immigration, yet.

The real import of the article though is that while this writer was confident that U.S. Immigration and Customs Enforcement (ICE) Enforcement and Removal Operations (ERO), will be at the forefront of support for President Trump, along with the U.S. Border Patrol (USBP), there still are Deep State saboteurs in ERO that are fighting a rearguard action against the new enforcement program.  And leading those Deep State agents is David Marin, Field Office Director, Los Angeles Field Office, ICE ERO.

Back during the Obama Regime Administrative Amnesty, Marin was one of the enforcers of the amnesty among his staff in Los Angeles, mandating only criminal aliens will be deported.  And he was happy to be the face of that policy.

Now he plays the tough guy to the public, though not as tough as he plays in public statements.

Although ICE could arrest Delgado and his wife, the presence of the 16-year-old boy creates a problem. By law, they can’t leave him by himself. Instead, officers decide to arrest just Delgado and follow up later with his wife. They let him put on jeans and a shirt, handcuff him, and lead him across the street into the back of a Dodge Grand Caravan. A half-mile away, to avoid any crowds that might form at his house, officers take Delgado out of the van, search him thoroughly, attach a waist chain, and remove his belt.
David Marin, a former marine who is the head of enforcement and removal operations for ICE’s L.A. field office and is one of the two agents media are allowed to identify from this ride-along, explains the decision to take Delgado into custody: “Both have been previously deported. This is somebody who shouldn’t be in the country.” he says. “We explained to him, ‘You have no right to be here. You’ll have to come with us.’ And he asked, ‘What about my wife?’ ”

And worse yet, Marin would be happy with fewer arrests that those described in the article:

Looking back on the day’s work, Marin, the local ICE head of enforcement, says catching three of six targets and two others is “representative of our daily operations. That’s what our guys are doing every single day.” He says it was a success because nobody got hurt.
He says he would be happy even if his team didn’t catch as many as they did today: “Even if we just caught one, that’s still one criminal alien who we removed from the country who is not going to commit any more crimes.”

And that should not come as a surprise.  The Los Angeles Field Office of ICE ERO has been a black hole of immigration enforcement ever since Marin came on as a senior manager there.  His career there has been one of managing declines in arrests.  There are over 1 million illegal aliens, officially, but obviously more, in the geographic area covered by the ICE ERO Los Angeles Field Office.

And look at the accompanying graphic that the Weekly Standard provided.  From 2012 to today, arrests under Marin's management have declined precipitously, from over 25,000 a year to a little more that 5,000 so far this year.  If this rate continues, Marin will have made the number of arrests close to the total in 2005.


These numbers show that David Marin is not only enthusiastic about arresting illegal aliens, but is part of the problem.  He just doesn't like doing his job and will do what is necessary to keep arrests down.  He doesn't want to frighten the illegal aliens, he doesn't want to do raids, he doesn't want to do sweeps, he just doesn't want to do what is necessary to deport 1 million illegal aliens under his jurisdiction.

Time for Thomas Homan, ICE Director, to find someone who does.

New Evidence Vindicates Lonnie Schwartz

Lonnie Schwartz is the victim of a deliberate campaign by the Obama Regime to intimidate Border Patrol Agents and other immigration law enforcement officials into backing off doing their job. The Obama Regime and the Cultural Marxists in the #LyingPress started a campaign in 2014 to augment the Obama Regime Administrative Amnesty by discouraging immigration arrests by public intimidation and false accusations of excessive force.  [Violence Against The Border Patrol: Whose Side Is Obama On?, by Federale, VDare, June 27, 2017]  The campaign was #FakeNews as all the shootings that were so controversial were all later declared justified two years later.  [News, Good And Bad, In The Obama Regime War On The Border Patrol, by Federale, Federale Blog, July 30, 2016]

However, the Obama Regime decided to single out a Border Patrol Agent for punishment by process, Lonnie Schwartz.  The Regime knew he was innocent, and allowed and encouraged the press to print lies about the shooting incident.  The plan was to lie to the public and sacrifice a straight white male to the Mexican lynch mob.  In this case, the alleged victim, Jose Antonio Elena Rodriguez, also known as The Rat, innocent teenager at 16, was just walking home from the store, much like the thug Trayvon Martin.

Elena Rodriguez’s family claims that at the time of the shooting, the teen was simply walking to his home four blocks away. The ACLU has since filed a federal civil lawsuit on behalf of his family, arguing that the agent used excessive force when he opened fire.
“The Elena Rodriguez Family is grateful to the DOJ [Department of Justice] for this first step in the pursuit of justice, and remain steadfast in their resolve to seek full transparency from the U.S. Border Patrol on behalf of Jose Antonio,” Luis Parra, the attorney representing Elena Rodriguez’s mother, told the Associated Press.

We now know that Araceli Rodriguez, Jose Elena Rodriguez' mother was lying.  The whole story was contrived.  Little Jose was a thug throwing rocks at Border Patrol Agents as part of an apparent drug smuggling attempt.

A Mexican teenager killed by a Border Patrol agent in Nogales five years ago was throwing rocks at agents before he was shot to death, prosecutors concede in recently filed court documents. 
Documents filed by the U.S. Attorney's Office prosecuting Agent Lonnie Swartz for second-degree murder confirm for the first time that 16-year-old Jose Antonio Elena Rodriguez was throwing rocks from Nogales, Mexico, onto the Arizona side of the border before he was shot.
"The government will not dispute at trial, that (Elena Rodriguez) was one of apparently three individuals who, based on the video, were throwing rocks over the fence," the motion by the U.S. Attorney's Office states. "Likewise, the government will not dispute that this conduct was apparently an effort to assist the two subjects on top of the fence who were trying to successfully drop down onto the Mexican side of the border after smuggling two bundles of marijuana into the United States."

So, despite years of claiming that there was no rock attacks on Schwartz, other Border Patrol Agents, and police officers at the scene of the drug smuggling attempt, the government now admits their lie: Schwartz and others were under attack with deadly force.  Rocks can kill. And they are a strategy by drug and alien smugglers to prevent arrests and seizures.




Now that the lies spread by the U.S. Attorney's Office for the District of Arizona have been exposed, it is time for Attorney General Jefferson Sessions to order Elizabeth Strange, the Acting United States Attorney for the District of Arizona to drop the charges against Schwartz and end this travesty of justice.  Stop Strange from becoming the latest Angela Corey, the harridan who persecuted George Zimmerman.

This prosecution of Schwartz was a lie from the beginning and he was a sacrificial offering to the demons of diversity and illegal immigration, the two lodestars of the Democrat Party.  Free Lonnie Schwartz!

And it is time to prosecute Rodriguez for lying about what Jose Rodriguez was doing during the smuggling attempt.  She should be prosecuted for violation of Title 18 United States Code, Section 1001, False Statements.

She should also have her visa revoked.  And to no one's surprise the vile racist Mexican thugs who championed Jose Rodriquez' cause, claiming he was an innocent youth, are now saying his criminal and deadly attacks on Border Patrol Agents does not matter.  They just play the race card, or La Raza card.

Legally speaking, this revelation is a big deal because the family and their lawyer had disputed that Elena Rodriguez was throwing rocks before he was shot in 2012. They shouldn't have done that. Already the family is facing an uphill legal battle to bring their son's killer to justice.
But there is no dispute now. A kid threw rocks and was gunned down by a good American soldier...
Does anyone really believe the agent’s life was in danger by rocks being thrown from across the border that couldn’t reach him?
Because we’re talking about a Mexican being killed on Mexican soil. And we know that a Mexican life isn’t worth much – not even our outrage, right?

An Opportunity Presents Itself For ICE

U.S. Immigration and Customs Enforcement (ICE) Enforcement And Removal Operations (ERO) has an opportunity in Colorado.  The Colorado program for illegal alien driver's licenses is about to start and the offices for the tens of thousands of illegal aliens to apply for those licences is limited.  This presents ICE ERO the opening to make thousands of arrests and discourage illegal aliens from remaining in Colorado and the United States.

Colorado’s driver’s license program for people living in the U.S. illegally has been hobbled since its start three years ago, and efforts to fix and better fund the initiative have been caught in partisan gridlock.
An application backlog, possibly years long for some, is estimated to run in the tens of thousands. Just three Division of Motor Vehicles branches across Colorado offer the licenses, and in a year only one in the Denver area might be left to serve the entire state.
Now things are scheduled to get even worse: During the next few months, the program — which one national observer called a “nightmare scenario” — will send about 11,000 people who need to renew their licenses back into the jam-packed line.

Sabotage Confirmed, Deep State Operatives In ICE Fighting Trump

The radical left and Cultural Marxists have obtained the February U.S. Immigration and Customs Enforcement (ICE) Enforcement And Removal Operations (ERO) memorandum that repealed the whole of the Obama Regime Administrative Amnesty.  It is a radical document that ends what this writer identified as non-feasance in the enforcement of immigration laws, the failure to perform official duties, as the major issue at the source of the Obama Regime Administrative Amnesty, and originating in the Jorge Bush Administration.

While this memorandum dates back to February 2017, it expands on the repeal of the Morton Memos and the other various attacks on immigration law enforcement by the Obama Regime.

The head of the Immigration and Customs Enforcement unit in charge of deportations has directed his officers to take action against all undocumented immigrants they may cross paths with, regardless of criminal histories. The guidance appears to go beyond the Trump administration’s publicly stated aims, and some advocates say may explain a marked increase in immigration arrests.
In a February memo, Matthew Albence, a career official who heads the Enforcement and Removal Operations division of ICE, informed his 5,700 deportation officers that, “effective immediately, ERO officers will take enforcement action against all removable aliens encountered in the course of their duties.”

This is a significant expansion of ICE ERO's mandate to fully enforce the immigration laws of the United States.  Importantly, no leeway is given to the field to ignore certain "sympathetic" illegal aliens.  However, for some reason main DHS did not let the public know about the extent of the expansion of the arrest responsibilities of ICE.  It is significant as many ICE ERO officials have been publicly denying any such expansion and even denying that non-criminal aliens would be targeted, but only arrest if casually encountered during arrests of criminal aliens.

At the forefront of a public face denying the intent to target and arrest all illegal aliens is David Marin, Field Office Director, ICE ERO, Los Angeles, CA.  He has been identified before by this writer as someone actively sabotaging immigration enforcement by encouraging non-criminal illegal aliens to no fear being arrested.  [Is ICE Field Office Director David Marin A Deep State Agent For Illegal Aliens?, by Federale, VDare, April 25, 2017]

Also identified as less than enthusiastic in enforcing immigration laws was Clinton Johnston, Assistant Field Office Director for ICE ERO in San Diego.  [Enforcement Is Up Under Trump, But Not Up ENOUGH, by Federale, July 4, 2017]  Both Johnston and Marin seem less than enthusiastic about arresting illegal aliens.  That is a problem.  I identified ICE ERO as a Trump ally in the DHS bureaucracy, and I stand by that, as evidenced by whinings of the Peruvian Rochabrun.

The top leadership at ICE is on board with immigration enforcement, as is the rank and file, as this writer described, much to the chagrin of the illegal alien lobby personified by Rochabrun.

A spokesman with ICE said Albence’s directive did not represent a break with Kelly’s stated aims, and was consistent with current agency policies.
“The memo directly supports the directions handed down in the executive orders and mirrors the language ICE consistently uses to describe its enforcement posture,” the spokeswoman, Sarah Rodriguez, said in a statement. “As Secretary Kelly and Acting Director [of ICE] Homan have stated repeatedly, ICE prioritizes the arrest and removal of national security and public safety threats; however, no class or category of alien in the United States is exempt from arrest or removal.”

And the Cultural Marxist Rochabrun and his ilk are not happy that civil servants are enthusiastic about the work they do:

Both Homan and Albence are career employees who have worked for decades helping the government enforce immigration laws. Before Homan was promoted to lead ICE, he led ERO, with Albence as his assistant director.
“I expect that the agency believes that there is no one in the White House or DHS that is going to tell them ‘No. Don’t do this,’” Bier said. “And without an effective check in the administration we are going to see arrests being made without any regard to prioritization...”
Homan has so far served as a vocal supporter of Trump’s ramped up immigration enforcement. Last week, he even made an appearance at a White House press briefing.

So, it is time for Homan and Albence to call Marin and Johnston on the carpet for their lack of enthusiasm.  Homan, as head of ICE, which includes both ERO and Homeland Security Investigations (HSI), also needs to address the failure of HSI to increase arrests of illegal aliens. This writer knows that HSI Special Agents-in-Charge in the field and the ICE Office of the Principal Legal Advisor in headquarters, including the Principal Legal Advisor Offices in the field, are actively sabotaging administrative and criminal arrests of illegal aliens by HSI Special Agents by requiring prior approval of administrative arrests of illegal aliens, while at the same time Deportation Officers of ERO are free to make arrests of illegal aliens for both administrative and criminal offenses.  I would suggest to Homan that he have a frank discussion with his SACs and Tracy Short, the ICE Principal Legal Advisor, about their sabotage and failings.  Perhaps they would be more happy working elsewhere.  Homan should also have a word with Peter Edge, Executive Associate Director of HSI, who has failed to see that HSI gets back in the immigration enforcement business.

Racist Trump Deports White Man, But Lets Hispanic Woman Stay

Not certain what is going on with the Trump Administration.  Recently a high profile illegal alien was deported.  The press and politicians were screaming for his protection, but the Trump Administration held firm, and John Cunningham was deported.  Kudos to U.S. Immigration and Customs Enforcement Enforcement and Removal Operations (ICE ERO).

A prominent Boston man nabbed by ICE last month for overstaying his visa by more than a decade has been sent back to Ireland, and the city’s Irish community is still worried about further deportations, an advocate said.
John Cunningham, 38, was a Brighton-based electrical contractor and chairman of the Gaelic Athletic Association before he was detained June 16 for overstaying a 90-day visa that he used to enter the U.S. in 2003. Cunningham left on a commercial flight Wednesday night, according to Immigration and Customs Enforcement spokesman Shawn Neudauer.

Cunningham entered on the Visa Waiver Program (VWP), a legal means for certain aliens from certain countries to enter the United States for business or tourism for 90 days without obtaining a non-immigrant visa, and that program prohibits those aliens who use it from any appeals system in deportation cases.  Cunningham was unceremoniously removed with no appeals, and as it should be, because that is what the law says.  There was a great hew and cry after his arrest, but he was soon deported.  The real question is why has the Trump Administration continuously released illegal aliens who are not white like John Cunningham, even those aliens who entered on the VWP and are subject to deportation without appeal?

Case in point, the, dare I say White, Hispanic Lesbian Daniela Vargas. who entered the United States on the VWP, was arrested by ICE ERO, but eventually released.  She was not deported like Cunningham was.  Why not?  Is there a double standard for Hispanics and other non-Whites who violate immigration law or the terms of the VWP?

Or is it that the Trump Administration is slowly getting tougher on illegal aliens?  I hope it is the later, as this story shows:

Under Operation Streamline, a fast-track prosecution program for illegal alien border-crossers will seek criminal prosecution for first-time border-crossers.
During the Obama years, only repeat border-crossers were prosecuted as criminals under Operation Streamline.
Now, the Departments of Homeland Security and Justice seek to deter first-time illegal crossers.

Time for Trump to go whole hog on immigration enforcement.  As his success in the campaign against #FakeNews and CNN is successful, RussiaGate fall apart, and his Alt-Right speech in Poland, he has inoculated himself against attacks by the media if he ends the Deferred Action For Childhood Arrivals (DACA) program.  It was more than likely the possibility of bad PR was the major reason that Trump did not end DACA immediately, and the pernicious influence from certain quarters of course.  It was just too big an issue.  But now with the Meme Wars going well and the bias of the media showing, he has an opening. Time to end DACA! Si Tu Puede!

Time To Arrest Mark Zuckerberg And Priscilla Chan

Mark Zuckerberg and his wife, Priscilla Chan, have donated millions of dollars via the Chan-Zuckerberg Initiative to TheDream.US, a program that will award over 100 college scholarships to illegal immigrants in the Bay Area.
The donations have been spread out over the past several years, and the 139 scholarships given out are part of a concerted effort to ensure that 400 young illegals will attend college in the region by 2020. The “dreamers,” as they are commonly known, are not eligible for federal financial aid, private scholarships, or other grants, so cannot generally afford college. TheDream.US believes that it is a shame to “waste [their] talent.” Tania Wilcox, the program’s director for college partnerships, said that the organization “truly believes that an education is so important for people to be able to contribute to this community and this nation.”

Mary Papazian, the president of San Jose State University, argued that the illegal students have a “real sense of drive and purpose… with just a little support, it’s really incredible what they can do.” San Jose State is set to receive more than 40% of the scholarship recipients this year.

Sadly, the Trump Administration has not yet moved against these criminals.  Zuck, Chan, and Papazian are liable under Title 8 United States Code, Section 1324(a)(1)(A)(iv). Bringing In And Harboring Illegal Aliens:

(iv) encourages or induces an alien to come to, enter, or reside in the United States, knowing or in reckless disregard of the fact that such coming to, entry, or residence is or will be in violation of law

All three, and the others identified previously should be arrested and prosecuted.  President Trump can also move against those schools that enroll and provide assistance to illegal aliens administratively by striking at their revenue stream, legal foreign students in the United States on F-1 visas.  San Jose State is particularly vulnerable to cutting off foreign students.

Next in line were UCLA and UC Berkeley, which each had more than 6,000 international students in 2014, or close to 15 percent of their student body. In the California State University system, San Jose State had the highest number of international students, at 3,600, or 11 percent of its student body.

President Trump can order the Department of State to stop issuing student visas to colleges and universities that enroll illegal aliens.  He has this authority as part of his authority to see that the laws of the United States are faithfully executed and his plenary authority over the issuance of visas.  In the recent Supreme Court decision, Kerry v. Din, the court said that aliens outside the United States have no constitutional claim to even an immigrant visa, much less a temporary non-immigrant visa. Moreover, persons or institutions in violation of the laws have no right to government largess.

It is time for President Trump and Attorney General Sessions to act against the plutocrats and bureaucrats who think they are above the law.

It's Only A Mediocre Start

Supposedly immigration arrests and deportations have skyrocketed.  That is not true.  Immigration enforcement in general has only increased slightly.  Despite much hooplah, DHS has not deployed it's forces for a concerted crackdown on illegal immigration.  And various enforcement components continue to administer some aspects of the Obama Regime Administrative Amnesty.

The number of targeted immigration arrests in San Diego has returned to levels from before former President Barack Obama changed enforcement priorities in late 2014.
That’s in large part because of the broadened priorities mandated by President Donald Trump in a January executive order, according to Greg Archambeault, San Diego field office director for Immigration and Customs Enforcement’s Enforcement and Removal Operations.
Obama’s priorities focused on people convicted of felonies or multiple misdemeanors. Trump’s policy includes people charged with any level of crime and those who have final orders of removal, meaning an immigration judge has already signed off on their deportations.

Now the uninitiated might see that as a major improvement, arrests doubling from the Obama years, but a closer reading is that arrests have returned to a level under Obama, a level from 2014.  While early 2014 had a higher level of arrests than 2015 and 2016, still under Obama, one must remember that the Obama Regime Administrative Amnesty began immediately in 2009, and this writer identified the policy of non-enforcement, the Obama Regime Administrative Amnesty, in April 2009, only three months into the Obama Regime.  Early in the Obama Regime the word went out to U.S. Immigration and Customs Enforcement (ICE) to back off enforcement.  And as the years went by more and more illegal aliens, and where illegals were physically, were off the table as enforcement targets or areas where enforcement was allowed to take place.

So, doubling arrests, to a level only three years ago, is not much of an achievement.  One understands that not everything can be done in a few months, but bringing arrests up to a previous Obama level is not much of an achievement, even though staffing levels at ICE Enforcement and Removal Operations (ERO) is at its highest level ever.

From February through May of this year, San Diego’s fugitive operations team has arrested 547 people, according to data from ICE. That’s more than double the total for the same months last year, at 242, or the year before, at 267. In 2014, before Obama narrowed immigration enforcement’s priorities, San Diego’s fugitive operations team arrested 540 people in the same time frame.

And we have a few hints as to why.  The Trump Administration is continuing to target criminal aliens, rather than illegal aliens in general.

“We’re still focusing on criminals, but we’re not confined to them,” said Clinton Johnston, assistant field office director for Enforcement and Removal Operations in San Diego. “It’s the ability for us to enforce the law across the board.”

Focusing but not confined.  Hardly the words that express a systematic plan to enforce immigration law.  It is more half assing it.  If we run across a generic illegal alien we will arrest them, but were not looking for them is a better way of putting it. Furthermore, there is not much enthusiasm for the regular illegal aliens as evidenced by a policy continuing certain aspects of the Obama Regime Administrative Amnesty, to whit, immunity from arrest for illegal aliens who are single parents or who are with children.

Depending on the situation, ICE officers don’t always take a target into custody, Johnston said. If the person is a sole caregiver to children, officers weigh that with the likelihood of a public safety issue. They might give the person a notice to appear in court instead of driving them downtown. Since Sotomayor’s partner was home, this wasn’t an issue in his case.

Now in criminal law enforcement, whether State, local, or Federal, whether a person subject to arrest is the sole "caregiver" to dependants is not a consideration when making an arrest for a crime, nor should it be one in immigration enforcement.  Local cops routinely arrest single parents.  If the children are present, such as if the arrest occurred in a home, or away from home, such as at a car stop, the police call a relative to come get the children or whatever is the local child protective services agency.  The policy of not arresting illegal aliens with dependant children is a new policy, an Obama policy, part of the Obama Regime Administrative Amnesty.  It exists only to limit the number of arrests of illegal aliens, not for any "public safety" concern.  Nothing is stopping Deportation Officers from ICE ERO from picking up their cell phones and calling the county agency charged with dealing with abandoned children.  For Clinton Johnston's information, San Diego County Child Welfare Services (CWS) can be reached at (858) 694-5191.  All the other law enforcement agencies in San Diego County use it, why not ICE ERO?

What needs to be done is to begin targeting illegal aliens in general.  Missing from the current DHS plan, if you can call it a plan, is worksite enforcement.  Note the absence of complaints of worksite raids in the press.  Why, because ICE has yet to develop and implement a strategy of worksite enforcement of laws that prohibit illegal aliens from working in the United States. This is again symptomatic of the Obama Regime Administrative Amnesty.  Worksite enforcement declined precipitously under the Obama Regime and nothing has changed of late.

Additionally, President Trump has not prepared and issued the necessary executive orders to the Commissioners of the Social Security Administration and the Internal Revenue Service to begin information sharing with ICE to identify illegal aliens using fraudulent Social Security Numbers, those numbers assigned to other persons, or using Taxpayer Identification Numbers for unlawful employment or tax returns filed by illegal aliens. Such a executive order could identify not only employees but employers of illegal aliens and do so with little or no cost to the government.  But it is not been done, nor has this writer heard of any orders to the field to increase worksite enforcement.

It is understood that the Trump Regime is just beginning. But unlike with other hostile Departments, ICE, especially ICE ERO is generally staffed by Trump supporters.  There is no Resistance in ICE ERO to deal with.  There is enthusiasm in ICE ERO for their mission of arresting illegal aliens.  But merely getting back to the highest level of Obama Regime arrests is no accomplishment and they could be doing much better.  How about targeting illegal aliens in general? Create a panic, use tactics that are off the board right now, such as checkpoints, which are currently used by the Border Patrol. Almost all of that which is holding back expanded immigration enforcement is self-imposed. A limited mind and imagination.  This I say to President Trump: Free your mind!

Time For President Trump To Fire The Commission On Civil Rights

The radical racists who dominate the U.S. Commission On Civil Rights (USCCR) have inserted themselves in the immigration law enforcement issue, something outside of their jurisdiction, and in a manner unrelated to any concerns about misconduct or abuse by law enforcement agents, but because the commissioners object to immigration laws.  To whit, they have decided to violate Federal statute by aiding and abetting illegal aliens to remain in the United States and assist others engaged in that crime of aiding illegal aliens, including violating the Constitution and Federal law with regards to rebellion and insurrection.  The USCCR, which claims it is bipartisan, has joined the criminal Resistance to the Trump Administration.  It is time for all but one of the commissioners to be fired and criminally prosecuted for their treason and sedition.

The Commission is concerned that some of the most vulnerable individuals’ access to justice is hindered by the recent actions of the federal government. The Commission urges Attorney General Sessions and Department of Homeland Security Secretary Kelly to consider the fair administration of justice when determining how and where they send Immigration and Customs Enforcement (ICE) agents.
In the last few months, troubling reports have emerged of federal immigration agents following, confronting, and in some instances, arresting undocumented immigrants in state and local courthouses when some of those immigrants were seeking help from authorities and the local justice system.

Dishonestly and partisanly, the USCCR has adopted the radical language of the Democrat Party in violation of the legislative mandate to be bipartisan in its investigations.  The commissioners referred to illegal aliens as immigrants.  That is neither legally valid, in Federal statute, illegal aliens are just that, not immigrants.  The commissioners also dishonestly confuse the public by suggesting that immigration law enforcement officers are harassing or illegally arresting legal immigrants to the United States.

Furthermore, the commissioners illegally claim that there are legal sanctuaries for illegal aliens where they are free from arrest.  That claim has no basis in law.  In fact, the commissioners are acting illegally when they suggest such sanctuaries exist and that Federal authority to make arrests is limited.  Statute is quite clear, there are no time or place limitations on Federal law enforcement officers making arrests, nor are there on making immigration arrests.  To suggest so is again dishonest and a lie.  Furthermore, to suggest so, and to make a demand that arrests of illegal aliens at courthouses stop is flagrantly illegal and not within the authority of the USCCR.  Moreover, the commissioners are acting to assist illegal aliens to remain in the United States in violation of law, Title 8 United States Code (USC) Section 1324(a)(1)(A)(iii):

(iii) knowing or in reckless disregard of the fact that an alien has come to, entered, or remains in the United States in violation of law, conceals, harbors, or shields from detection, or attempts to conceal, harbor, or shield from detection, such alien in any place, including any building or any means of transportation

The commissioners are legally liable because they are illegally and without authority seeking to interfere with the lawful execution of Federal statutes.  Furthermore, the commissioners further cite local officials who are seeking to usurp the authority of the Constitution and Federal law by interfering with the enforcement of Federal law, including threats of force and violence.  Such activity is in violation of Title 18 USC Section 2383, Rebellion or Insurrection.

Arresting illegal aliens, including mentally ill trannies, is not a violation of any "civil right" and therefore outside the jurisdiction of the Commission.  The commissioners have no authority to comment on such activity, and is therefore illegal use of Federal monies, and constitutes a theft of Federal funds, in violation of Title 18 USC 641 Theft of Public Money.

The clearly partisan attacks on immigration law enforce are also a violation of the legislative mandate of the commission to be non-partisan, as supporting illegal aliens is a Democrat Party official policy.

It is also a violation of the Hatch Act, that prohibits partisan activity by Federal employees, such as Michael Yaki, who runs a political consulting firm contracting with companies and local governments, when he is not acting as a commissioner. Shockingly, Yaki was renominated to the commission by Paul Ryan.

Time for President Trump to fire all the commissioners except Peter Kirsanow, the sole Republican on a Commission that has four Democrats and three Democrats in all but name.  It should have more Republicans, but Paul Ryan and Mitch McConnell could not bring themselves to appoint Republicans.
