The Obama Regime Administrative Amnesty continues apace. The Regime has reveived no pushback from the Republicans in Congress, including after his unconstitutional appointment of the head of the consumer protection agency and several members of the National Labor Relations Board. The Republicans have aquiesced to the Regime's attack on the Constitution, whether it be Obama's failure to uphold his oath of office, the administrative repeal of Acts of Congress, or unconstitutional non-recess recess appointments.

Encountering no resistance, the Regime is proceeding apace with the Administrative Amnesty. It is no in talks with the State of Kansas Agriculture Secretary to authorize the widespread employment of illegal aliens. (h/t Stein Report)

Kansas Ag Secretary Asks DHS To Legitimize Illegal Immigrant Farm Labor

Faced with a shortage of hired hands, Kansas ranchers and farmers are appealing to their state’s secretary of agriculture for a solution. And he says he has one: hiring illegal immigrants.

It’s an idea that’s unorthodox enough to turn heads but, practical enough to justify a series of meetings with the U.S. Department of Homeland Security — a meeting which Kansas Agriculture Secretary Dale Rodman told the Topeka Capital-Journal he has attended.

His goal is for the state government to organize a network of illegal immigrants and willing employers into a hiring network. No such arrangement, of course, can go forward without the federal government’s approval, since Washington, D.C. is tasked with enforcing immigration laws.

“I need a waiver,” Rodman said. “It would be good for Kansas agriculture.”

As talks continue off-and-on in Washington, D.C., state lawmakers in Topeka are expected to unveil their own legislative fix soon: A federal government-approved program that would allow businesses to hire illegal immigrants who have lived in Kansas for at least five years. Prospective workers with criminal records would be disqualified.

Unorthodox indeed. Positively illegal. There is no "waiver" of an Act of Congress available. One cannot hire illegal aliens. DHS cannot approve such a scheme, but DHS is negociating with the State of Kanas to do just that. And the spineless Republicans in Congress and on the Presidential campaign trail are silent.

The United Mexican States (Yes, that is it's real name, not Republic of Mexico, etc.) has a very strict voter identification system. There is one and only one voter identification card. There is no voting without it. And it is used as the defacto national identification card. And if a person fails to renew or obtain a card, there is no "amnesty" for the lazy and indolent. Mexico's National Voter IDs Part Of Culture

MEXICO CITY – Office worker Ana Martínez lined up at 7 a.m. on a recent Sunday to renew her voter credential, a document required at a polling station to vote.

But voting was not the main reason she was getting it. The free photo ID issued by the Federal Electoral Institute had become the accepted way to prove one's identity — and is a one-card way to open a bank account, board an airplane and buy beer.

Voting was almost an afterthought to Martínez.

"They ask for it everywhere," she said. "It's very difficult to live without it."

But the Mexican government demands personal responsiblity from its citizens as well:

Though some U.S. states allow people to vote without IDs, Mexico makes no exceptions for individuals lacking the proper documents. The Federal Electoral Institute also refused to extend the registration period or grant an amnesty for those applying late, leaving more than a million people ineligible to vote.

"It is a matter that has to do with a culture of respect for the law," Francisco Guerrero, one of the nine commissioners on the institute, told the newspaper Reforma.

The agency makes no apologies for the tough rules or requiring photo identifications, given Mexico's history of troubled elections. "We started from such a point of distrust, especially in the electoral system," institute commissioner María Marván said.

"In order to strengthen democracy, we have to start believing in our own institutions. That's a big challenge in Mexico."

Personal responsibility, mandatory identification, and, more importantly, no amnesty. No amnesty for its citizens at home, but the government of Mexico demands it of us?

The Department of State (DOS) and U.S. Immigration and Customs Enforcement (ICE) colluded recently to issue a visitor's visa, B-1 or B-2 Non-immigrant visa to Seyed Mojtaba Atarodi, an Iranian computer researcher and academic, closely tied to the Iranian nuclear program. He provides the computer technology necessary to control the nuclear weapons and weapons delivery systems for the Islamic Republic of Iran.

Since being issued a visa by DOS, with the approval of ICE's Homeland Security Investigations (HSI) Visa Security Officers (VSO) stationed at American dipolmatic posts overseas, Atarodi entered the United States and promply conspired to purchase computer technology prohibited for export to Iran.

US Has Arrested Iranian Scientist

WASHINGTON (AP) — The United States has arrested and charged an Iranian semiconductor scientist with violating U.S. export laws by buying high-tech U.S. lab equipment, a development likely to further worsen Iranian-U.S. tensions...

But a Sharif University spokesman said he has been charged with buying instruments from the United States. The university official spoke only on condition of anonymity because of the potential repercussions of the case.

Even more of interest, this is not the first Iranian intelligence agent that DOS and ICE have approved visas for:

What the Indonesian Army was doing was raping and beheading communists, leftists, and trade unionists. Many people were savagely tortured to death by the military and its right-wing Muslim allies in the Nahdlatul Ulama and the Muhammadiyah. A number of those butchered were fingered by U.S. intelligence.

Seizures of Pirated Goods Rose Sharply According to CBP and ICE

US Customs and Border Protection (CBP) and US Immigration and Customs Enforcement (ICE) seized 24,792 counterfeit and pirated goods during fiscal year 2011, a 24 percent increase over 2010, according to its annual report Intellectual Property Rights, Fiscal Year 2011 Seizure Statistics.

Despite the significant increase in the number of seizures, the report found, the domestic value for seizures in fiscal year 2011 decreased by five percent to $178.9 million and the manufacturer’s suggested retail price (MSRP) declined slightly to $1.1 billion. CBP and ICE said that this was primarily due to a shift toward using international mail, express courier and consolidated shipping services to import counterfeit and pirated goods.

It was not releasing a soon to be triple-murder, but failing to follow up when deportations resumed.

Kesler Dufrene was a Haitian immigrant of some sort, legal or illegal, who soon after release by U.S. Immigration and Customs Enforcement (ICE), murdered three innocents. The real crime is that the Regime halted deportations to Hait after an earthquake devestated the capital, Porte-au-Prince. Interestingly enough, most of the rest of the country was little effected. Haiti's countryside is one of tiny shacks and small agricultural plots outside the capital little affected by earthquakes. But the Regime decided that it wanted to keep as many Haitians as possible in the United States. ICE had its hands tied in this case as the Regime suspended deportations to Haiti. Unlike another situation where ICE happily released a criminal, Jose Manuel Gonzalez-Sandoval, who went on with his criminal career.

Immigration Authorities Released Man Who Went On To Kill 3 In North Miami

When burglar Kesler Dufrene became a twice-convicted felon in 2006, a Bradenton judge shipped him to prison for five years. And because of his convictions, an immigration judge ordered Dufrene deported to his native Haiti.

That never happened.Instead, when Dufrene’s state prison term was up, Miami immigration authorities in October 2010 released him from custody. Two months later, North Miami police say, he slaughtered three people, including a 15-year-old girl in a murder case that remains as baffling today as it did the afternoon the bodies were discovered...

In August 2007, records show, a U.S. immigration judge ordered him deported. He was released from state prison in September 2010, and handed over to immigration custody at West Miami-Dade’s Krome Detention Center.

The federal government annually deported hundreds of Haitians convicted of felonies in the United States.But after the devastating January 2010 earthquake in Haiti, the Obama administration announced it was indefinitely halting deportations to the country.

“Under binding Supreme Court precedent, ICE’s authority to detain any individual is limited when the removal of that individual is not likely in the reasonably foreseeable future,” the immigration agency’s statement said.

But here is the real failure by ICE, it made no effort to find Dufrene after deportations to Haiti were resumed:

The U.S. Supreme Court ruled in 2001 and 2005 that foreign nationals who cannot be deported may not be held in detention longer than six months. Deportations resumed in mid-January 2011 — three months after Dufrene was released from custody under ICE supervision. The agency did not specify what that supervision entailed.

Clearly there was no active monitoring of Dufrene's conditions of release and no effort was made to find and arrest him after deportations were resumed.

Clearly violent criminals, one of ICE's "priorities," were not a real priorites. Especially not Haitians who vote overwhelmingly for Demoncrats.

FBI Arrests Suburban Denver Man Indicted On Charges Of Supporting Terrorist Organization

AURORA, Colo. — The FBI arrested a refugee from Uzbekistan at Chicago’s O’Hare airport on charges that he planned to travel overseas to fight for a terrorist group and give up his life if necessary, an official said Monday.

However, there was no evidence that suspect Jamshid Muhtorov was plotting attacks inside the United States, authorities said.

Muhtorov, 35, of Aurora, Colo., was arrested Saturday by members of the FBI’s Denver and Chicago Joint Terrorism Task Forces.

Muhtorov, who goes by several other names, was indicted for providing and attempting to provide material support to a designated foreign terrorist organization. Prosecutors allege he planned to fight for the Islamic Jihad Union, which has been blamed for suicide attacks in Uzbekistan and claimed responsibility for numerous attacks against coalition forces in Afghanistan.

Arizona Sting Catches 2 Officers

PHOENIX (Reuters) – A U.S. Border Patrol agent and an Arizona jailer trapped in a sting operation have been arrested on charges they conspired to help traffickers smuggle drugs from Mexico, authorities said on Friday.

Ivhan Herrera-Chiang, 29, a Border Patrol agent in Yuma, Ariz., and Michael Lopez-Garcia, 28, a corrections officer at the Arizona State Prison Complex in San Luis, Ariz., were arrested on Thursday, the U.S. Attorney's Office for the District of Arizona said.

They are accused of conspiring to help traffickers smuggle drugs from Mexico into far western Arizona between September 2010 and January 2012.

The two officials were fingered by a confidential informant working for a drug- and human-smuggling network in Mexico, according to the criminal complaint.

Ingrate Immigrant Blames America

She is the former television star from Venezuela who married a local San Francisco politician who was just recently elected Sheriff of San Francisco City and County, Ross Mirkarimi, himself the first generation descendant of Iranian and Jewish-Russian immigrant or daughter of immigrants. He is also a radical hate America leftist. The typical leftist who supports extreme anti-male laws regarding domestic battery. Such laws were allegedly passed to control the epidemic of wife-beatings in California and throughout the country. Part of these laws are mandatory arrest requirements for any allegation, however minor. Of course Mirkarimi is not the stereotypical abuser who beats his wife at the drop of a hat to the point of severe or even minor injury. And it is well known that false accusations of domestic abuse are legion among vengeful women. Especially women who are not quite stable from the beginning. In fact, real abuse has been untouched by the laws, as they are mostly deployed against middle class white males. In the end, because of their workload and the reality that most incidents of abuse are minor and of no real consequence, most accused are let off with anger management courses and deferred prosecution. And of no use against the real abuser, most of whom are from the lower classes and not usually white.

But there is a real San Francisco twist here. Accusations of racism and blame America first have appeared. No surprise because San Francisco denizens hate America. And no one hates America more than immigrants in the Golden State and on the Golden Mountain.

Which brings us to the ingrate immigrant Lopez. She blames America for her minorly abusive commie husband, the crazed leftist domestic violence laws, and her own personal problems that set her husband off, typical of those from Venezuela.

Mirkarimi Wife: 'This Country Is Destroying My Family'

Despite the impassioned pleas of Sheriff Ross Mirkarimi’s wife, a judge has renewed a court order barring him from seeing or contacting his spouse or son until his domestic abuse trial is over.

“This country is trying to pull my family apart,” Eliana Lopez told Judge Susan Breall at her husband’s arraignment Thursday. “This is the real violence, I believe...”

Outside court, an emotional Lopez told reporters that “this country has not allowed me to work on my marriage in a healthy way. I feel like … everybody is using my family, myself, in a political game just to destroy Ross.”

She added, “This country is destroying my family.”

It appears that Lopez was at one point playing her own game. Planning to leave with their child to Venezuela and since there is no extradition treaty with the communist run coutry and Venezuela is a signatory to the Hague Convention on the Civil Aspects of International Child Abduction but not a member of the Hague Conference on Private International Law, there is not any real legal recourse for Americans in Venezuelan courts. Once she left with the child, he would never see his son again.

That videotape, which police later seized along with texts and emails between the women, shows a tearful Lopez describing how her husband bruised her arm that day, according to court documents. Lopez also reportedly discussed earlier physical abuse, and made the tape to ensure that her husband couldn’t obtain sole custody of their 2-year-old son.

A delicious aspect of this is seeing leftists hoisted on their own petard. The interesting reaction is that of the so-called conservative talk station in San Francisco, KSFO, and the screechy co-host of the morning show, Melanie Morgan, who replaced the much more intelligent Officer Vic, who are playing the poor abused woman card. Perhaps just because Mirkarimi is a commie, but in the long run, men are loosing out on the false or exaggerated claims of abuse by women. And most of the victims of this injustice are white males. Though Mirkarimi is not one of use, either by blood or belief, it is always nice to see a leftist get the business that they so much enjoy dishing out, but in the end, he is learning how it is to be at least perceived as a white male in America.

In the end though, Lopez, like most immigrants, goes to the same well. Blame America for everything, including her own personal problems and patterns of behavior. Shame on her and her ilk.

Labor Dept. Settles Racial Discrimination

WASHINGTON -- The Labor Department's Office of Federal Contract Compliance Programs has announced that government contractor JacintoPort International has agreed to settle allegations of hiring discrimination on the basis of race involving 48 African-American and 21 Caucasian job applicants rejected for longshoreman positions at the company's Houston facility."

In this day and age, it is shocking that any company would allow race to be a factor in determining who gets hired," OFCCP Director Patricia A. Shiu said. "This settlement should put all federal contractors on notice that, in the Obama administration, we will be persistent when it comes to rooting out workplace discrimination and will vigilantly monitor employers who violate the law until they get it right."

DOL previously cited JacintoPort for violating requirements of Executive Order 11246 by failing to implement an applicant tracking system for new hires, and to develop and execute action-oriented programs to recruit women and
African-Americans. This matter was settled on June 6, 2006. JacintoPort agreed to correct the violations and produce semiannual reports on the company's progress in employing women and minorities.

Whites only got justice by accident. I can tell you from personal experience that the EEOC just does not consider white males and Americans to be protected by the laws of the United States. An no evidence that ICE looked into the status of the Hispanics who benefited from the discrimination. And the most likely reason the Hispanics benefited was that they worked long hours for little pay or benefits. Probably because they were illegal and happy to have any job.

Brick Attack Leaves Man Comatose

Friday night brawl injures two others. A trio of suspects are arrested.

A San Clemente man remained in a coma Tuesday after being hit with bricks in a Friday brawl.

Three suspects -- Filiberto Thomas Cordova, 23, Francisco Javier Sanchez, 29, and Gilberto Velazquez, 29 -- have been charged with attempted murder and assault in the case. In addition, Velazquez and Sanchez face felony street terrorism charges for their alleged affiliation with the San Clemente-related Varrio Chico street gang, according to the Orange County District Attorney's office.

And notice the names of the victims, and the unmentioned race of perpetators and victims.

Dan Jacobsen, one of the victims, got involved after hearing a commotion outside his apartment and running outside, where he saw his 19-year-old son and two friends arguing with several other men.

Suddenly, a white, two-door Chevy pickup sped to the stop sign at the end of Rosa from the direction of El Camino Real, and several men got out, he said.

Jacobsen, who pulled away some of the attackers and was injured in the process, said he dragged his son -- who had been knocked unconscious -- to the concrete stairs of their apartment, where a faint bloodstain remained Tuesday.

This is not the first, nor will it be the last. The LA Times, of all newspapers, has been documenting the quite public and unashamed rise of Varrio Chico, the primary Mexican gang involved in the Obamaesque cleansing of San Clemente of dem ebil racciss white crakas. Another city lost to immigrants and their descendants. Federal Immigration Chief: Cook County Jail Policy May Be Illegal

Cook County’s controversial illegal immigration policy, which critics say paved the way for a suspect in a deadly drunken driving crash to bond out of jail and disappear, may very well violate federal law, the nation’s immigration director said in a letter to County Board President Toni Preckwinkle.

“This ordinance undermines public safety in Cook County,” U.S. Immigration and Customs Enforcement Director John Morton wrote in a Jan. 4 letter to Preckwinkle. “In addition to undermining local public safety, the [ordinance] may also violate federal law.”

Interestingly enough, it was Morton who has ordered the release of numerous criminals in ICE custody and instructed that they be returned to the community. Just remember Jose Manuel Gonzalez-Sandoval and Edwin Ramos, two criminal aliens who were released from custody by ICE itself.

The City and County of San Francisco have been releasing criminals for a long time with no objection from Morton or ICE. Suddenly when the Administrative Amnesty is giving the Obama re-election campaign a black eye, Morton is moved to act.

Preckwinkle shook her head over the immigration chief’s letter, requesting an amendment to the ordinance “to avoid any legal conflict with federal law.”

“I just got this letter last night, and we’re crafting a response to Mr. Morton, and we will be happy to talk to him,” Preckwinkle said. “I will just tell you I have not heard a word from him — not a phone call or letter in the last four months — so it’s fascinating I get this in the last few days.”

Yes, a sudden concern and shock over illegal alien criminals released into the community.

Supreme Court Upholds Ban on Candidate Campaign Contributions and Expenditures by Non-Permanent-Resident Foreign Citizens

Yesterday, the Supreme Court summarily affirmed Bluman v. FEC (D.D.C. Aug. 8, 2011), an opinion by a three-judge District Court that upheld the ban on non-permanent-resident foreign citizens’ candidate campaign contributions and independent expenditures supporting or opposing candidates.

So we don’t know exactly what reasoning the Supreme Court used, but we do have the reasoning of the three-judge District Court (which may well have some persuasive precedential effect on other courts deciding on other restrictions on non-citizens’ speech and other activity, even though it has no binding precedential value). Here is what strikes me as the key part of the analysis:

We know from more than a century of Supreme Court case law that foreign citizens in the United States enjoy many of the same constitutional rights that U.S. citizens do. For example, aliens are generally entitled to the same rights as U.S. citizens in the criminal process, among several other areas.

From the affirmed lower court decision:

But we also know from Supreme Court case law that foreign citizens may be denied certain rights and privileges that U.S. citizens possess. For example, the Court has ruled that government may bar foreign citizens from voting, serving as jurors, working as police or probation officers, or working as public school teachers. The Court has further indicated that aliens’ First Amendment rights might be less robust than those of citizens in certain discrete areas. See Harisiades v. Shaughnessy, 342 U.S. 580, 591–92 (1952) (First Amendment does not protect aliens from deportation because of membership in the Communist Party). Beyond that, the Constitution itself of course bars foreign citizens from holding certain offices.

In those many decisions, the Supreme Court has drawn a fairly clear line: The government may exclude foreign citizens from activities “intimately related to the process of democratic self-government.”...

Now some, basically the La Raza types, Demoncrat mayors, and some gun nuts think that aliens, legal and illegal, have the same rights as citizens. The Supreme Court has affirmed again that is not true. Aliens don't have the same rights as Americans. Why, because they are not part of our nation. They are alien to it.

And it has just said that aliens may be not only deported for their political views, but that they may be barred from participating in the political process. Now the gun nuts say that the 2nd Amendment is the penultimate expression of self-government, it is the physical application of self-government. It is watering the Tree of Liberty with the blood of tyrants. As the gun nut Mike Vanderboegh says: "When Democracy Becomes Tyranny. I STILL get to vote." And by voting he means armed resistance to tyranny. Well, that is a right "intimately related to the process of democratic self-government." The ultimate expression of self-government, the application of armed violence for political ends. Power does come out of the barrel of a gun. As Jean Rasczak says, "Violence has resolved more conflicts than anything else."

That, of course, brings us to the other rights that the Supreme Court, in its error, says that aliens have, such as a free public education, the right of resident legal aliens to contribute to political candidates and groups, the right to judicial review of administrative decisions regarding deportation and immigration benefits, etc. The problem is that there is nothing in the Constitution that separates these conclusions by the Court that both grant rights and deny other rights enjoyed by citizens. If aliens can't vote, hold office, or contribute to politicians, then it is clear that they should have no rights at all. Much less that illegal aliens be allowed to exercise the most fundamental right of self-government, the application of violence for political ends.

A year ago, Atlanta-based college graduate Jessica Colotl, 22, caused a firestorm when she was told she would be deported to Mexico, a country she’d left as a child. She’s still here—but possibly not for long.

Last May Jessica Colotl graduated from Kennesaw State University, a small university outside of Atlanta, with a degree in political science. This May a judge will decide whether she stays in the U.S. or gets shipped off to Mexico—a country she hasn’t seen since she was 10 years old.

But that is not true. As this blog has shown, Jessica Colotl has traveled back to Mexico since she first came here at 10. She claims to have a Mexican driver's license and 10 year olds don't get those, even in Mexico. She also has a Mexican passport. No reason to have one of those unless you have been traveling there. Most illegals get matriculas.

Colotl’s own story began when she was 10. Her Mexican parents crossed the Arizona border late one night with her, her brother, and two sisters. They eventually made their way to Atlanta, where Jessica grew up believing she was an American. By high school, she’d pieced together the truth. Her parents didn’t own a car, saying it was too dangerous. (In Georgia, undocumented immigrants can’t get a driver’s license.) At 15, she wanted an after-school job, but she didn’t have a Social Security card—her father said they were only for the “wealthy.” These moments added up. One night as she watched the evening news, a lightbulb went off: “They were always talking about immigration reform, showing people crossing the border. It dawned on me: I did that,” she says. She never broached the subject with her parents. “They were trying to protect us,” she says. “My parents sacrificed so much trying to give us a better future.”

Unlikely, she owned a car, why didn't her parents? All are illegal. How did they get to work in Metro Atlanta without a car? Impossible in that car-centric city. At 10 years old, you certainly know who you are. She did not start speaking English until age 10. And she thought she was American? Lie. She always knew.

In high school, she was a quiet, conscientious student: she went to the prom, took AP classes, and graduated with a 3.8 GPA. (A 1982 Supreme Court decision found that children in America are entitled to a public education, regardless of their legal status.) To get into college at Kennesaw University, she applied with a nonresidents’ application form used by foreign students, and paid with money saved from her parents’ cleaning jobs. Once she arrived, she helped found the school’s first chapter of the Latina sorority Lambda Theta Alpha.

Oh, she was so American she helped found a chapter of a racist Mexican sorority? And, no, she was paying in-state tuition up until her arrest, then no one has presented proof she started paying out-of-state tuition afterward.

Lie after lie. Of course previous stories said she came here at 7. But who is counting. She still hasn't been deported. And she wants to contribute with a Poly Sci degree? Well, she can't be that bright or she would have a STEM degree. That alone is worthy of deportation.

The answer is a resounding Si Se Puede! Yes, we can deport Jessica Colotl!

Muslim Man From Kosovo Charged In Fla. Bomb Plot

TAMPA, Fla. (AP) -- A Kosovo-born man was charged with plotting to attack Tampa-area nightclubs and a sheriff's office with bombs and an assault rifle to avenge wrongs done to Muslims, federal authorities said Monday.

According to a federal complaint, 25-year-old Sami Osmakac recorded an eight-minute video shortly before his arrest explaining why he wanted to bring terror to his "victims' hearts" in the Tampa Bay area. Osmakac is a naturalized American citizen born in Kosovo, then part of the former Yugoslavia in eastern Europe.

The Criminal Complaint confirms that Osmakac is a naturalized citizen.

The defendant, Sami Osmakac, is a 25 year old man who is a naturalized citizen of the United States, born in the former Yugoslavia.

So, despite the fact that terrorists are ICE's number 1 priority, ICE failed to keep this alien outside of the United States, it failed to discover his treason before his naturalization. ICE failed to take the action necessary to denaturalize him, and it failed to discover his terrorist intent before he took steps to execute a terrorist attack. The FBI had to do it. Another ICE fail.

Agents’ Union Stalls Training on Deportation Rules

WASHINGTON — The federal agency in charge of deportations is conducting a far-reaching training course to push immigration enforcement officers and prosecutors nationwide to focus their efforts on removing immigrants convicted of crimes.

The training course is the clearest sign yet that administration officials want to transform the way immigration officers work, asking them to make nuanced decisions to speed deportations of high-risk offenders while halting those of illegal immigrants with clean records and strong ties to the country. The policy is President Obama’s most ambitious immigration initiative before the November elections, senior administration officials said.

But in a new sign of the deep dissension over immigration, the union representing some 7,000 deportation officers of the agency, Immigration and Customs Enforcement, known as ICE, has so far not allowed its members to participate in the training. Without the formal assent of the union, the administration’s strategy could be significantly slowed for months in labor negotiations.

Chris Crane, the president of the union, the National ICE Council, has fiercely criticized the strategy, saying it amounts to orders from ICE officials for agents not to enforce the law. In Congressional testimony, Mr. Crane accused the administration of tailoring its enforcement practices to win support from immigrant communities for Mr. Obama’s re-election.

“Law enforcement and public safety have taken a back seat to attempts to satisfy immigrant advocacy groups,” Mr. Crane told a House Judiciary subcommittee in October.

Department of Homeland Security officials say the training seminar, although only half a day, is central to bringing all ICE officers on board for an effort that they say will significantly raise the numbers of convicted criminals among deportees and is expected to lead in coming months to unprecedented suspensions of deportations of tens of thousands of illegal immigrants.

Virtually all ICE commanding officers and prosecutors have gone through the training course and are working on the new strategy, Homeland Security Department officials said. But because of the silence from the ICE Council, a local of the American Federation of Government Employees, the officials will miss their Jan. 13 goal for completing the nationwide training blitz, which began in November.

You see, the Regime has run into its union thug history. Union members don't do anything outside the contract, and the issue of new policy and practices, as well as the training for said policies and practices, are part of the union contract.

And the Regime's amnesty is definitely outside the contract. And, more importantly, outside the Constitution and the law. There are some patriots using union contracts to slow the amnesty until Mittens becomes President.

Then we shall know the the truth about Mittens.

And perhaps impeachment is the answer. Perhaps Chris Shanahan should be the first ICE manager impeached come November 2nd.

“Our folks understand that we have limited resources and we have to focus more than ever on our priorities,” said Chris Shanahan, the ICE field office director who oversees deportation operations in New York City, where all supervisors have had the training.

The Treason Bar continues to blame U.S. Immigration and Customs Enforcement for the deliberate deceit by Turner. Perhaps she wanted to run away from the incredibly stupid name given to her by her mother.

Immigration Officials Investigate Circumstances Under Which Texas Teen Deported To Colombia

Jakadrien’s family says she left home in November 2010. Houston police said the girl was arrested on April 2, 2011, for misdemeanor theft in that city and claimed to be Tika Lanay Cortez, a Colombian woman born in 1990.

An Immigration and Customs Enforcement official told The Associated Press on Thursday that the teen claimed to be Cortez throughout the criminal proceedings in Houston and the ensuing deportation process in which an immigration judge ultimately ordered her back to Colombia.

The ICE official, speaking on condition of anonymity due to not being authorized to discuss additional details of the case, said the teenager was interviewed by a representative from the Colombian consulate and that country’s government issued her a travel document to enter Colombia. The ICE official said standard procedure before any deportation is to coordinate with the other country in order to establish that person is from there.

Clearly she wanted to be deported and did not want her true identity known. Why, who cares. She made her bed and she lay in it.

Shocking you might say, but the rocket scientist teenager decided when arrested for theft to give a false name, which turned out to be that of a Columbian national wanted for other crimes, presumably in Columbia, but there are no details as yet. The rocket scientist also decided to go through with the criminal and immgiration processes without telling her mother or grandmother that she was arrested, who were allegedly concerned, or tell her attorney her real name.

Mom 'Flabbergasted' Over Daughter's Deportation

DALLAS — Johnessa Turner hasn't seen her 15-year-old daughter Jakadrien in more than a year. "It was definitely a hard time," she said. "This has been going on for so long... it's still hard."

Jakadrien ran away in November 2010 and ended up deported to Colombia by mistake...

Immigration and Customs Enforcement, the federal agency that deported Jakadrien, denies any wrongdoing. ICE said the teen gave police a false name when she was arrested in Houston for theft in April. Not even Jakadrien's defense attorney knew her real name.

ICE said it tried to verify her identity through fingerprints and database searches, and nothing raised a red flag.

But how did a 15-year-old girl fool police, federal officials and a judge?

Her mother is just as puzzled.

Well, since she lied and continued to lie, there is really no surprise.

"She was a mature girl, but Jakadrien was a good girl," Johnessa Turner said. "She was responsible, respectful, started going through regular teenage things."

Mature, but not very bright, unless she really did not want to let mom in on the truth for some reason. Perhaps a trip to Columbia was an escape for her. Or she got caught in her spiral of lies and could not get out even with the truth at the end. Oh what a tangled web we weave when we act to decieve.

Teen's Deportation Stuns Dallas Detective

As News 8 reported, immigrantion officials mistakenly deported the teenager after she gave them the wrong name. That name came back to an illegal immigrant from Colombia who was wanted by international police on warrants.

"They didn't do their work," Lorene Turner asserted. "How do you deport a 15-year-old and send her to Colombia without a passport... without anything?"

Immigration and Customs Enforcement said it is investigating this case and takes it very seriously. The agency said it attempted to verify Jakadrien's identity before she was deported and found nothing that would make them doubt the fake name and age she had provided to authorities.

But let us go through the steps to be arrested, charged, handed over to U.S. Immigration and Customs Enforcement (ICE), and be deported.

First, at her arrest, she gave a name that was not hers. Clearly she did not want to be found out as a juvenile runaway or there was some other reason that caused her to not use her real name.

Why she chose this as yet unknown Hispanic name to give to the police after her criminal arrest, one does not know. Perhaps she has a juvenile criminal record and did not want that discovered? We just do not know.

Next, she was appointed a free attorney in the criminal case. For some reason she did not tell her attorney her real name. That means she was very serious about hiding her identity. Which makes one suspicious that she did not want to go home for some reason. A very serious reason. One can imagine what that was as there is no mention of her father. Perhaps mom's boyfriend...

It is not clear what happened in the criminal case, dismissed, time served, the story just does not say.

Then she is placed in removal proceedings. She is interviewed by an ICE officer, either a Deportation Officer or an Immigration Enforcement Officer. They ask a series of questions mandated by policy and placed in a Form I-867AB, Record of Sworn Statement. On that form they ask the subject their name, date of birth, citizenship, names and citizenship of their parents and grandparents, among other things. Clearly she did not tell the truth for some reason.

Now Houston is in Harris County, a 287(g) Sheriff's Office, so the forms may have been prepared by a Harris County deputy sheriff, but the forms were reviewed by a Supervisory Deportation Officer. Other forms are created summarizing the facts of the case, such as Form I-213, Record of Deportable Alien, which are reviewed by the ICE Enforcement and Removal Operations Deputy Field Office Director before the alien is ordered removed.

Then the subject is give a choice to leave voluntarily or have a hearing before a judge. A judge is mentioned, but it is not clear if the judge was in the criminal process, a judge or magistrate in a criminal court, or a judge in the Executive Office for Immigration Review (EOIR), part of the Department of Justice.

It is clear though that she did not make a claim of being an American citizen in the process. Perhaps because she was in too deep in her web of lies, or more likely she just did not care.

The next part is the actual removal, which, in fact, does require the consent of the Columbian government. Aliens are not removed, except to Canada and Mexico, without travel documents issued by the country to which the alien is removed. So she would have had to affirmed to the Columbian government that she was the the person in question.

Perhaps she thought that she could get out of the criminal charges in the United States by claiming to be an alien and instead of prosecution, just accept deportation.

The important fact is that she did not just tell one lie one time. She created and repeated a whole series of lies. Why, we do not know. But there is a reason. Stupidity is one.

Clearly she is either not very bright, or too clever by half. Time will tell. But this wasn't a result of mistakes by ICE, it is all her own making.

Probe Reveals Feds Pressuring Agents To Rush Immigrant Visas – Even If Fraud Is Feared

Higher-ups within U.S. Citizenship and Immigration Services are pressuring rank-and-file officers to rubber-stamp immigrants’ visa applications, sometimes against the officers’ will, according to a Homeland Security report and internal documents exclusively obtained by The Daily.

A 40-page report, drafted by the Office of Inspector General in September but not publicly released, details the immense pressure immigration service officers are under to approve visa applications quickly, sometimes while overlooking concerns about fraud, eligibility or security.

One-quarter of the 254 officers surveyed said they have been pressured to approve questionable cases, sometimes “against their will.”

The report does not call out any particular officials and indicates that the agency has had a problem with valuing quantity over quality since at least the 1980s.

But high-ranking USCIS officials said the pressure has heightened after the Obama administration appointed Alejandro Mayorkas as director in August 2009 during an effort to pass comprehensive immigration reform, bringing with him a mantra of “get to yes.”

The problem is not new to the Obama Regime, it goes back decades, detailing an agency bias to ignoring fraud and the legal standards to award legal permanent residence. It is though reflected in the push for the Administrative Amnesty at all levels of immigration enforcement. What is not mentioned is that there is no authority to ignore the legal standards for obtaining legal permanent residence, a longstanding problem, where management at all levels of the legacy Immigration and Naturalization Service always claimed that they had the "discretion" to ignore the law when it suited them. Usually when there was political pressure, but also when low level managers wanted to end backlogs or obtain bonuses for "performance." There was the just the lazyness factor as well. It is alot more work to deny a benefit than to approve it. Always a factor. The path of least resistance is as true for bureaucrats as well as electricity.

Negar Azizmoradi, leader of the Iranian branch of the International Raelian Movement (IRM), has been granted religious asylum in the United States after a long struggle that began when she publicly declared atheist/Raelian beliefs in her home country.

“As the leader of the Iranian Raelian Movement and therefore an atheist as well as a political activist, Negar couldn't possibly stay in her country" said Brigitte Boisselier, spokesperson for the IRM, in a statement released this morning. “She was forced to flee Iran when her family received word that she was about to be arrested and thrown into prison.”

The prospect of serving an indefinite sentence in an Iranian prison amounted to a likely death sentence, Boisselier said.

And apparently this cultist needed the help of another from both a more established cult and the new cult of Obama.

Boisselier added that Las Vegas Raelians wish to thank Senator Reid and his staff for their assistance in hastening Negar's asylum application process.

One notes that she is fleeing another cult.

Of interest is why Turkey, a signatory to the U.N. Conventions of 1951 and 1967 on the Status of Refugees, contemplated deporting her to Iran. Most likely because of Turkey's continuing Islamization. But as a signatory Turkey was obliged to grant her at least temporary protection. Even more absurd though is the continuing practice by most countries of foisting their refugees on the United States, much as Nepal does with with its nationals who flee Bhutan.

While the hottie Azizmoradi appears to meet the classic definition of a refugee, a person persecuted for religious or political beliefs, it is quite common for Iranians to falsely claim conversion from Islam to come to the United States. Most make a bogus claim to conversion to Christianity, almost all using the same story, an Armenian friend of mine invited me to church. But they give no specifics and usually mention some street in the Armenian section of town. That's about it.

But do we really want UFO cult leaders in the United States? Do we need a repeat of the Heaven's Gate suicides? Hasn't the cult of self given to us by Marin County and its hot tub culture done enough damage? Do we need these cults at all? We have the Revealed Truth that our Founders acknowledged.

How Israel Helped to Spawn Hamas

Surveying the wreckage of a neighbor's bungalow hit by a Palestinian rocket, retired Israeli official Avner Cohen traces the missile's trajectory back to an "enormous, stupid mistake" made 30 years ago.

"Hamas, to my great regret, is Israel's creation," says Mr. Cohen, a Tunisian-born Jew who worked in Gaza for more than two decades. Responsible for religious affairs in the region until 1994, Mr. Cohen watched the Islamist movement take shape, muscle aside secular Palestinian rivals and then morph into what is today Hamas, a militant group that is sworn to Israel's destruction.

Instead of trying to curb Gaza's Islamists from the outset, says Mr. Cohen, Israel for years tolerated and, in some cases, encouraged them as a counterweight to the secular nationalists of the Palestine Liberation Organization and its dominant faction, Yasser Arafat's Fatah. Israel cooperated with a crippled, half-blind cleric named Sheikh Ahmed Yassin, even as he was laying the foundations for what would become Hamas. Sheikh Yassin continues to inspire militants today; during the recent war in Gaza, Hamas fighters confronted Israeli troops with "Yassins," primitive rocket-propelled grenades named in honor of the cleric...

When Israel first encountered Islamists in Gaza in the 1970s and '80s, they seemed focused on studying the Quran, not on confrontation with Israel. The Israeli government officially recognized a precursor to Hamas called Mujama Al-Islamiya, registering the group as a charity. It allowed Mujama members to set up an Islamic university and build mosques, clubs and schools. Crucially, Israel often stood aside when the Islamists and their secular left-wing Palestinian rivals battled, sometimes violently, for influence in both Gaza and the West Bank.

"When I look back at the chain of events I think we made a mistake," says David Hacham, who worked in Gaza in the late 1980s and early '90s as an Arab-affairs expert in the Israeli military. "But at the time nobody thought about the possible results."

Blow back is a bitch, but the real issue is that not only is Hewitt wrong, Israel did help HAMAS as a counterweight to the PLO, but the issue of Hewitt claiming that if you are wrong on the facts, you are crazy. Well, this first makes Hewitt crazy. But Hewitt is notorious for his support for real crazy people who really do believe in ahistorical facts, specifically his "Smart Guy" Chemerinsky. Chemerinsky thinks that our Founding Fathers and the writers of the 14th Amendment supported abortion. Of course there is nothing in history or law that suggests any such thing. Abortion was a common law crime at the time of the Founding and both a common law crime as well as statutorily prohibited in many States at the time the 14th Amendment was written, passed Congress, and was ratified by the States. Anyone who claims otherwise is lying. And by Hewitt's definition quite crazy. One may support abortion, but one may not claim with honesty that it is protected by the Constitution.

Hewitt has claimed that any talk of Obama being a Marxist is unacceptable and was out in front defending Obama on not releasing his birth certificate. Without any evidence prior to the release of the birth certificate caused by The Donald, Hewitt was absolute on his prohibitions on discussing the issue. Similarly, Hewitt is a big supporter of amnesty, just not for criminals or terrorists. As if the last amnesty did not also have a similar prohibition that was not very effective.

France Makes It Harder To Become French

France will be making it harder for foreigners to seek French citizenship as of January. Critics say the new requirements, which include tough language tests and allegiance to “French values”, are an electoral ploy that panders to the far right.

Foreigners seeking French nationality face tougher requirements as of January 1, when new rules drawn up by Interior Minister Claude Guéant come into force.

Candidates will be tested on French culture and history, and will have to prove their French language skills are equivalent to those of a 15-year-old mother tongue speaker. They will also be required to sign a new charter establishing their rights and responsibilities.

Note that most immigrants applying for naturalization only have to be able to write one very simple sentence in English and pass an examination consisting of 10 questions, of which they only have to get 6 correct. US Citizenship and Immigration Services (USCIS) at various times call the English language requirement knowledge of common words in the English language, or a 2nd, 3rd, or 4th grade command of English. They just are not certain. Unfortunately Congress has been of no help with only a vague "knowledge of English" requirement. A requirement continuously dumbed down over the years. But any immigrant over 50 years of age has no English language requirement.

Unlike in America, where naturalization is considered a right by the courts and USCIS and more designed to avoid deportation and qualify for more welfare benefits, in France it is now a serious political act of import for both the alien and the nation:

“Becoming French is not a mere administrative step. It is a decision that requires a lot of thought”, reads the charter, drafted by France’s High Council for Integration (HCI). In a more obscure passage, the charter suggests that by taking on French citizenship, “applicants will no longer be able to claim allegiance to another country while on French soil”, although dual nationality will still be allowed.

Guéant, a member of President Nicolas Sarkozy’s ruling UMP party, described the process as “a solemn occasion between the host nation and the applicant”, adding that migrants should be integrated through language and “an adherence to the principals, values and symbols of our democracy”. He stressed the importance of the secular state and equality between women and men: rhetoric perceived largely as a snipe at Muslim applicants, who make up the majority of the 100,000 new French citizens admitted each year.

France is also looking to reduce overall immigration by a small, but significant number.

But the interior minister has taken a hard line on immigration, announcing plans to reduce the number of legal immigrants coming to France annually from 200,000 to 180,000 and calling for those convicted of felony to be expelled from the country.

A ten percent reduction in the number of immigrants would be good for the United States as well.

France is showing the way, again. A small start, but significant.

If anyone had any doubts about how the courts’ view of the Second Amendment to the Constitution, it should be quite clear by the recent decision of the Eighth Circuit Court of Appeals, decision which concurred with the Fifth Circuit ruling in United States v. Portillo-Muniz, that Second Amendment protections do not apply to illegal aliens (who are specifically barred from possessing firearms by 18 U.S.C. § 922(g)(5)). I see someone at the back of the class has their hand up…you have a question? You want to know why people who are here illegally should be granted the same rights as citizens? Excellent question…

Illegals should not be granted the same Constitutional rights as citizens for the same reason citizens should not be ‘granted’ these rights: Because our the rights listed in the Bill of Rights are not granted by the Constitution or the government, they belong to us by virtue of being human beings. Anyone remember this bit?

We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness.

According to freedictionary.com, unalienable means “unable to be taken away from or given away by the possessor.” After the Constitution’s ratification, some of those unalienable rights were incorporated into the Constitution as the Bill of Rights, but that document no more created them than dirty underwear and wheat create mice. As the U.S. Supreme Court stated in U.S. v. Cruikshank, 92 U.S. 542 (1875):

The right of the people peaceably to assemble for lawful purposes existed long before the adoption of the Constitution of the United States. In fact, it is, and always has been, one of the attributes of citizenship under a free government. … It was not, therefore, a right granted to the people by the Constitution. The government of the United States when established found it in existence, with the obligation on the part of the States to afford it protection.

The Court then goes on to apply this logic to the Second Amendment as well, stating,

The second and tenth counts are equally defective. The right there specified is that of ‘bearing arms for a lawful purpose.’ This is not a right granted by the Constitution. Neither is it in any manner dependent upon that instrument for its existence. The second amendment declares that it shall not be infringed; but this, as has been seen, means no more than that it shall not be infringed by Congress.

Notice that nowhere in the ruling does the Court state that these pre-existing rights applied only to citizens. Indeed the language makes it clear that the Court felt these were human rights, not mere citizens’ rights...

But even within that citation is the guidance which the Fifth Circuit claimed to be looking for, but chose to ignore when SCOTUS analogizes the use of ‘the people’ in the Second Amendment with its use in all the other amendments. Most of which, as we have seen, have been held directly to apply to illegals. Furthermore, if the Fifth Circuit was actually looking for guidance they could have found it in the first sentences of the very paragraph that they quote, where SCOTUS says,

We know of no other enumerated constitutional right whose core protection has been subjected to a freestanding ‘interest-balancing’ approach. The very enumeration of the right takes out of the hands of government—even the Third Branch of Government—the power to decide on a case-by-case basis whether the right is really worth insisting upon. … [emphasis in original]

With all these precedents it’s hard to see how any court, looking honestly at the Constitution and the law, could fail to conclude that “the freedom to own and carry the weapon of your choice is a natural, fundamental, and inalienable human, individual, civil, and Constitutional right — subject neither to the democratic process nor to arguments grounded in social utility.”

QED. Japanese Army soldiers, Pancho Villa, MS-13, Al Queda, anyone can come to the United States and own a gun. And vote. Participation in self-government is a fundamental right of all human beings. Life, liberty and pursuit of happiness and all that. A Homo sapien sapiens is a Homo sapien sapiens. There are no distinctions between them. Geographic location, citizenship, etc. are racist social constructs, along with borders between nations, designed to keep the black, brown, and yellow, man down. Those evil racist slave owning Founding Fathers thought that every illegal had a right to vote and own a gun. And even water the tree of liberty with somb o' dem evil raciss white crakas.

In fact, if an illegal alien has a right to own a gun in the United States, then clearly deporting that illegal alien is as much a violation of his natural right to life, liberty and happiness. No illegal alien is happy being deported, much less arrested and detained for just being a human being. No human is illegal. Because there can be no distinctions between human beings. Even more interesting is that borders are just a lines drawn on a map, created by the democratic process. Which makes Fast and Furious quite legal, as even Mexican drug lords have a right to own guns. Eric Holder was just supporting 2nd Amendment rights for said Mexican drug lords. Which is also why Eric Holder opposes voter identification laws. He supports illegal aliens voting. Voting for Demoncrats who oppose the 2nd Amendment.

What Krafft does not understand is that only citizens in a polity have rights. Children don't have the right to keep and bear arms, or vote, or speak freely, or own property and they are citizens. Nor do aliens, legal or illegal. What they have is only what the democratic process gives them. Illegal aliens are not part of the commonweal. They are by definition alien to the political community. Therefore they do not enjoy said rights. Clearly the courts were wrong when they extended any rights to aliens. Because if they qualify for one right, then they get them all. Which includes voting. Voting to end the 2nd Amendment. One more Obama nomination to the Supreme Court and the 2nd Amendment is a dead letter. Illegal alien voting will ensure that.

Connecticut Mayor Proposes to Let Illegal Aliens Vote in City Elections

Tapping into a growing trend, the Democratic mayor of New Haven, Conn., wants to allow illegal aliens to vote in local elections.

John DeStefano said he will forward his proposal to the state Legislature for approval.

New Haven, the home of Yale University, has become a haven for illegal immigrants from Central America is recent years -- drawn in part by Connecticut's generous welfare benefits.

As reported in the New Haven Register today, six municipalities in Maryland already extend voting rights to noncitizens, and the city of Chicago permits illegal aliens to vote on school issues.

Besides just being wrong about rights, only citizens have rights in a polity, Krafft is wrong about the impact of his principles as well. Gun rights for illegal aliens will not be a bulwark against future violations of the 2nd Amendment, but mean the end of 2nd Amendment rights for him and the rest of us Homo Sapien sapiens in the United States.

The courts were wrong on their failure to uphold the 2nd Amendment for Americans and they are wrong on rights for illegal aliens. Two wrongs are still two wrongs. The 2nd Amendment and all the rights of our nation apply only to citizens.

In fact, distinguishing between citizens and non-citizens is natural and an important part of being a nation. Krafft may be a universalist and a one world government type. He can be nothing more if aliens enjoy the same rights as Americans. But such people are enemies of liberty. Just go to the Congo or China to see how others see human rights. They should not be allowed to decide the fate of the 2nd Amendment. Obama’s failure to lead on the issue of immigration reform resulted in the Democrats squandering a two-year super-majority. Immigration reform could have been passed without a hiccup in the President’s first 100 days in office. This is what he promised. So why did it happen? Obama expended every ounce of his political capital on his signature health-care legislation, throwing Hispanics under the bus in the process. Specifically, in order to get the votes required for passage, Obama lied to the Hispanic Caucus who was threatening to oppose Obamacare unless racist and anti-immigrant provisions were removed. His promise to the Caucus: to aggressively work with Congress to pass immigration reform. How did that work out?

So for those of you keeping score at home, Obama’s immigration reform efforts to date principally feature a lunch with Shakira and a Desperate Housewife. Change you can believe in?

The apologists respond with the fact that the Administration has recently introduced a “common sense immigration enforcement” policy involving the employment of a prosecutorial discretion memo. The reality is that this is nothing more than a public relations stunt. I know of only a handful of cases nationwide where prosecutorial discretion is being favorably exercised, and those cases are usually attached to embarrassing media coverage of individuals facing deportation to countries they haven’t been to since they were young children. The silent majority receive little, if any, reprieve from the Administration’s 400,000 deportations per year mandate.

As for the Administration’s recent constitutional challenge to Arizona’s immigration law, this President should be careful throwing stones in his glass White House. Persistent human rights violations permeate the Obama Administration’s handling of immigrants.

Here is the bottom line that the Obama apologists don’t want you to know: This President is the worst thing that has happened to the cause of immigrant rights since Eisenhower put Japanese Americans in internment camps. Only Obama’s internment camps are euphemistically called immigration detention centers, but just like Eisenhower’s these camps are being used to abuse immigrants and deny them of their constitutionally protected right to due process.

Someone might point out that it was Comrade Franklin Delano Roosevelt and RINO Earl Warren that hooked up the Japanese residents and a few Japanese-Americans on the West Coast. They also rounded up and interned Germans, Italians, German-Americans and Italian-Americans. That however is not convenient for the whitey hating Treason Bar. Blame everything on Republicans like Joe Arpaio and General Eisenhower. Perhaps Kolken was confusing internment with Operation Wetback. Kolken certainly didn't like that successful operation against illegal aliens. But that seems to be a theme here. No deportations are the Treason Bar goal.

I am certain Kolken is just an idiot, but the mendacity is comparing the legal aliens and Americans of Japanese ancestry who got the boot from the West Coast with actual illegal aliens who have no right to be here. Kolken also perpetuates the lie of the 400k deportees this year. As shown, in fact it was only 378,000 illegal aliens removed. Kolken also accuses the Regime of "persistent human rights abuses" while detaining aliens, meaning being "shoved forcefully" is a persistent human rights abuse. Not getting treatment for a blister is a "persistent human rights abuse." Getting tackled during a foot pursuit is a "persistent human rights abuse."

All though is just two steps forward, one step backward. Demand more than you can get and move the goalposts forward, never letting up on your demands. Now a real visa interview should have included much tougher questions, especially about the alien's intent, ties to his home, etc. But Locke's interview was probably the extent of the interview the recipients of the visas underwent with a Consular Officer. Obviously the Consular Officers are under extreme pressure to increase approvals of visa applications in a desperate attempt to buoy the economy before the election. The morons in the Regime obviously think a few dollars spent by Chinese will save Obama from electoral oblivion.

Of course, RINOs will only be too happy to sell Obama the rope by which they will loose the next election. Visa boosterism for Demoncrat illegal aliens is a common theme for the rent seeking tourism industry that is dependent on illegal alien workers. U.S. Should Ease Visa Access for Tourists Wielding Cash

This holiday season, millions of tourists visited the U.S. Given the economic benefits they bring, the U.S. should be working overtime to welcome their friends and families next year.
An estimated 60 million international visitors arrived in the U.S. in 2011, spending about $150 billion, supporting nearly 2 million American jobs and accounting for more than one-quarter of U.S. service exports. From taxi fares to tchotchke purchases, tourists account for a big chunk of economic activity. States from New York (the most popular travel destination) to Colorado and Wyoming (both of which have a high concentration of jobs in tourism) depend on visitors’ dollars.

The good news for Americans is that the U.S. is still the world’s biggest tourist destination by dollar value. (The U.S. ranks second after France as the world’s most popular destination.) After a fall in 2009, tourist arrivals climbed in 2010 and 2011. Still, as groups such as the U.S. Travel Association point out, the U.S. could be doing much better. Although global long-haul travel grew by 40 percent from 2000 to 2010, the U.S.’s share of the market dropped from 17 percent to 12.4 percent. Even taking into account the U.S.’s declining share of the global economy, that’s a steep dip.

And the good news is that recent legislation ended the policy of mandatory interviews of all visa applicants. The tourism industry seems to have already forgotten 9/11 where 19 tourists almost destroyed the American economy and killed a few people as well. None of them were interviewed.

A few sensible reforms could help break the logjams. These include inserting a corps of visa-adjudication officers in high- growth markets, creating video visa-interview centers for applicants who don’t live near a U.S. consulate, and relaxing the requirement for in-person visa interviews. Happily, all three of these proposals were incorporated in the omnibus budget legislation that President Barack Obama signed last week.

They got the "fast track" to a visa for terrorists. A clear lesson to the next group of jihadis who will commit the next 9/11.

Three of the hijackers in the September 11 terrorist attacks obtained visas in Saudi Arabia through a brand-new program designed to make it easier for qualified visa applicants to visit the United States, an American government official said tonight.

The Visa Express program, put in place just four months before the attacks, allowed the three hijackers to arrange their visas through a State Department-designated travel agency, the official says. Fifteen of the 19 hijackers obtained their U.S. travel visas in Saudi Arabia.

None of the three men, the American government official says, was ever questioned by U.S. consular officers in Saudi Arabia. Each took his travel papers and passport to a commercial travel agency, which submitted the applications to the State Department.

Repeating history. But then Obama thinks this is the U.S. of KKK A. A few more dead Americans means nothing to him. One would think that the WSJ and the tourism industry would know better, but clearly they don't.

Tourism leaders said the decline in foreign visitors over the past decade is costing American businesses and workers $859 billion in untapped revenue and at least half a million potential jobs at a time when the slowly recovering economy needs both.

In fact, that is an out right lie. Travel to the United States has been trending upwards for the last decade according to travel industry statistics.

There was a downward trend from 1999 to 2003, but that trended back up in 2004, with 2009 and 2010 well above 1999.

In fact 2010 was a record year with 59.7 million alien visitors to the United States, with 1999 having 48.5 million visitors.

And don't forget that half of the 11-20 million illegal aliens in the United States arrived ostensibly legally through inspection by an officer of the United States.

Pacific Steel Forced To Lay Off 200 Workers

BERKELEY, Calif. (KGO) -- Over the last few months, an East Bay steel company has been shedding about a third of its work force and it's not because of the economy. Pacific Steel was served with what immigrant advocates call a "silent raid." The company was audited by Immigration and Customs Enforcement to find out how many employees did not have proper work documents.

A spokesperson for Pacific Steel told ABC7 they have been able to slowly replace most of the employees they were forced to fire. Many of those employees have been with the company for years, even decades. Now, those employees are trying to figure out what to do after being let go.

And they are still here, free to find other employment or go on welfare:

Among those who have been fired, was Juan Zaragoza, who has been with pacific steel for 21 years. He said he was told he is no longer eligible to work at the company. David DeHerrera has been with Pacific Steel for 12 years and has two weeks to get his documents in order -- something he knows he cannot do. He says leaving the country is not an option.

"For us it's practically impossible to go back to Mexico because the situation in Mexico is not good," said DeHerrera.

DeHerrera has three children who were born in the U.S. He says they are the major reason why he will stay in the Bay Area.

His 14-year-old daughter worries about having to leave. She said, "I've never actually been in Mexico, I've only been there when I was a baby, so I have no memories whatsoever. I'm not sure how it's going to be over there."

And, guess what? They are suing. It appears that one of the reasons that Pacific Steel hired with a wink and a nudge was that they felt free to violate various labor regulations:

Capping off a tough year for one of the nation's largest steel casting companies, a former employee at Pacific Steel filed a $31 million class-action lawsuit against the Berkeley foundry Friday.

Roberto "Bobby" Rodriguez is suing the company in Alameda County Superior Court on behalf of about 1,000 current and former workers he says have not been getting timely meal and rest breaks.

But it was the firing of about 200 workers this holiday season -- a third of the plant's workforce -- that inspired him to take a stand, he said. The company has said it was forced to fire the workers after a federal immigration audit that began in February found dozens of its workers are suspected of being in the country illegally...

California law requires a 30-minute meal within each five hours of work, but Tim Rumberger, Rodriguez's lawyer, said Pacific Steel workers have been regularly scheduled to work 6½ hours or more without a meal break.

The lawsuit demands an hour of pay for every day without a timely meal break for the past four years -- amounting to about $20,000 in damages per worker, Rumberger said.

Suit: Arizona Authorities Shackled Pregnant Inmate

(CNN) -- A Mexican woman -- a former inmate in Maricopa County, Arizona -- claims in a lawsuit that sheriff's officers mistreated her during and after her pregnancy, including shackling her while she was in labor and after her Caesarean section.

The federal suit filed by Miriam Mendiola-Martinez this week comes days after the U.S. Department of Justice alleged the Maricopa County Sheriff's Office, under the leadership of Sheriff Joe Arpaio, engaged in a pattern of discrimination against Latinos.

Mendiola-Martinez's suit is against the sheriff's office, Arpaio, the Maricopa Medical Center and unidentified male and female officers, doctors and nurses.

Mendiola-Martinez, a Mexican citizen, alleges in the suit she was arrested October 23, 2009, by Scottsdale, Arizona, police, and was booked into Maricopa County's Estrella Jail on charges of identity theft. She was held without bond under Arizona law.

According to the police report filed at the time of her arrest, Mendiola-Martinez was accused of using someone else's name, date of birth and Social Security number to obtain work. She was arrested at her place of employment, a department store, while she was vacuuming the floor...

On December 10, 2009, Mendiola-Martinez pleaded guilty to solicitation to commit forgery under a plea agreement. Her sentencing was set for December 24.

Yet she has still not been deported. Why? Certainly because she is suing Sheriff Arpaio. More evidence of the lawlessness of the Regime.

CBP Falling Down On The Job

U.S. Customs and Border Protection (CBP) continues to fall down on the job. One must start with the fact that half of all illegal aliens enter the United States through inspection at an officially designated Port-of-Entry (POE) and after inspection by a CBP Officer (CBPO). The second half of this problem is the performance failures of CBPOs while performing their duties. The half of illegal aliens who enter legally are not just those who overstay a lawful admission, but includes those who present fraudulently obtained documents, false claims to U.S. citizenship, counterfeit documents, altered documents, imposters, and, most importantly, those who are not properly inspected, including credulity on behalf of the CBPO, failure to use available technology such as US VISIT, and failure to search and interview the applicant for admission.

The Government Accountability Office (GAO) has issued yet another report on the failures of CBPOs to discover fraudulent documents and conduct proper inspections of applicants for admission, centering around the failure of CBP to properly train CBPOs on immigration law, fraudulent document detection, and, more importantly, interviewing of applicants.

Additional Steps Needed to Ensure That Officers Are Fully Trained

CBP has taken some steps to identify and address the training needs of its incumbent CBP officers, but could do more to ensure that these officers are fully trained. GAO examined CBP’s results of covert tests conducted over more than 2 years and found significant weaknesses in the CBP inspection process at the ports of entry that were tested. In response to these tests, CBP developed a “Back to Basics” course in March 2010 for incumbent officers but has no plans to evaluate the effectiveness of the training. Moreover, CBP has not conducted an analysis of all the possible causes or systemic issues that may be contributing to the test results. Further evaluation of the training and causes underlying covert test results could help inform CBP about whether the training is sufficient to address the weaknesses identified by the covert tests or if adjustments are needed.

Note that the failure of CBP has several causes. The first is the leadership of the legacy INS and the current CBP. This is a function of the hostility of management at the senior and political level to the main purpose of CBP, which is to control the entry of persons and goods into the United States. There has been an ongoing Administrative Amnesty for certain classes of illegal aliens at POEs. Both political and professional managers have been more concerned about mollycoddling ethnic pressure groups and the politically connected to fully enforce the Immigration and Nationality Act at the border.

Add to the amnesty mindset the failure of the Homeland Security Act of 2002 (HSA) to improve the administration of the inspection process at POEs. One of the main purposes of the HSA was to have "one face at the border." The problem was that the one face at the border ended up being the mid-level managers of the legacy U.S. Customs Service (USCS) rather than the legacy INS. Previously POEs had two separate agencies conducting separate inspection of arriving persons and goods. The legacy INS inspected arriving persons, the legacy USCS inspected arriving things. The legacy USCS was only interested in imposing duty on arriving goods and discovering arriving contraband, like drugs. They had little or no concern about people. And since the creation of CBP, management of "one face at the border" has been a Customs face, concerned only with the issue of arriving things, not people. This was soon reflected in training of new officers, who received almost no training on fraudulent documents, immigration law, or anything related to the enforcement of immigration law.

Various Red-Team testing by GAO soon after the HSA created CBP showed that the problem of CBP inspection failures were not addressed in 2007 after a major report on the same problem.

Despite Progress, Weaknesses in Traveler Inspections Exist at Our Nation’s Ports of Entry

CBP has had some success in identifying inadmissible aliens and other violators, but weaknesses in its operations increase the potential that terrorists and inadmissible travelers could enter the country. In fiscal year 2006, CBP turned away over 200,000 inadmissible aliens and interdicted other violators. Although CBP’s goal is to interdict all violators, CBP estimated that several thousand inadmissible aliens and other violators entered the country though ports of entry in fiscal year 2006. Weaknesses in 2006 inspection procedures, such as not verifying the nationality and admissibility of each traveler, contribute to failed inspections. Although CBP took actions to address these weaknesses, subsequent follow up work conducted by GAO months after CBP’s actions found that weaknesses such as those described above still existed. In July 2007, CBP issued detailed procedures for conducting inspections including requiring field office managers to assess compliance with these procedures. However, CBP has not established an internal control to ensure field office managers share their assessments with CBP headquarters to help ensure that the new procedures are consistently implemented across all ports of entry and reduce the risk of failed traveler inspections.

An aspect of the CBP failures is that CBP considers itself primarily an anti-terrorism agency rather than an immigration and customs law enforcement agency. From its own website:

CBP is one of the Department of Homeland Security’s largest and most complex components, with a priority mission of keeping terrorists and their weapons out of the U.S. It also has a responsibility for securing and facilitating trade and travel while enforcing hundreds of U.S. regulations, including immigration and drug laws.

In fact the discovery of terrorists or weapons of mass destruction are a minor part of CBP accomplishments or actual responsibilities. Few terrorists have been intercepted at a POEs or crossing the border without inspection. CBP's real mission remains that of the legacy INS and legacy USCS, enforcing customs and immigration law. From their mission statement, immigration and drug laws appear to be an afterthought. And CBP's training and performance failures reflect that.

In fact, of those terrorists who have crossed our borders, CBP has caught almost none of them. Waad Ramadan Alwan and Mohanad Shareef Hammadi, Faisal Shahzad, and Najibullah Zazi are just a few terrorists who routinely entered the United States that CBP failed to intercept.

And things only got worse after the GAO 2007 report. There has been an ongoing purge of legacy INS employees at CBP, their years of knowledge and expertise in immigration law, fraudulent documents and procedure, lost forever, that CBP is desperate to rebuild after another report by GAO emphasizing CBP inspection failures. And CBP management continues to fail at all levels, both at the political level and the professional management levels, lower, mid and upper.

Key failures have been under a series of CBP Commissioners, Robert Bonner, W. Ralph Basham, and Alan Bersin, who have been either lawyers with no immigration or customs law enforcement experience or in the case of Basham, a former U.S. Secret Service manager, still with no experience in either immigration or customs law enforcement. As an example, to this day under their direction CBP continues to refuse to use US VISIT on the Mexican border, actively enabling the entry of illegal aliens. The primary reason is that using US VISIT on the land borders will cause a further delay in the entry of persons over the land border. And that will violate one of the cardinal sins in CBP today, and of yesteryear as well, a long wait time. Border wait times are how CBP managers are judged and the sine qua non of CBP performance. CBP even has an app for that. But it does not use the most important app for catching imposters and fraudulent documents at the land border, US VISIT. Because that was not and is not a concern of CBP. Border commerce and cheap housekeepers for the border rich and powerful are more important. Interior enforcement by the U.S. Border Patrol is not.

The failure on CBP's part has been continuous since 9/11. And the failures are mounting and they are systemic. And yet nothing is done, deliberately.

Agents Have “No Confidence” In New U.S. Customs And Border Protection Chief

Homeland Security Secretary Janet Napolitano has just named former Border Patrol Chief David Aguilar as the new head of U.S. Customs and Border Protection (CBP), the agency that overseas the Border Patrol as well as other law enforcement entities.

Aguilar will replace outgoing CBP Commissioner Alan Bersin who will retire on December 30.

Note that Bersin is not retiring, he was unable to get a vote in the Senate for confirmation and was given a recess appointment that expired.

Perhaps, Napolitano was not aware that Aguilar’s “leadership” abilities became somewhat questionable when the National Border Patrol Council (NBPC), the union which represents all of the U.S. Border Patrol’s rank-and-file agents unanimously gave a no-confidence vote to Chief Aguilar in 2007.

Shortly after the vote, then NBPC president, T.J. Bonner told The Washington Times: “Front-line Border Patrol agents who risk their lives protecting our borders have every reason to expect that the leadership of their own agency will support them. When this does not occur, and instead they are undermined by their so-called leaders, no one should be surprised when they express a loss of confidence in those managers.”

A few months ago, the Liberty News Network has just released a video which shows U.S. Border Patrol Chief David Aguilar being taken to task by one of his own agents on the chief’s stated support for ‘Comprehensive Immigration Reform’ (amnesty for illegal aliens).

Chief Aguilar is visibly agitated as he stands before a gathered group of agents in what was billed as a sort of ‘town hall meeting,’ as the agent continues to repeat Aguilar’s quotes over the years on the issue of amnesty...

Aguilar’s support for the prosecution of several Border Patrol agents by the Bush administration for so-called civil rights violations against illegal aliens (even drug smugglers), such as those of Agents Ignacio Ramos and Jose Compean have also contributed to the lack of support the rank and file agents have in their own boss.

It is unlikely that Aguilar will be confirmed. One should also note that the Obama Regime nominee for DHS Inspector General, Roslyn Mazer, is also on hold because of opposition from Senator Susan Collins. But Obama is getting accustomed to using recess appointments to implement policy.

MCSO At Odds With ICE Over Illegal Immigration

PHOENIX -- The Maricopa County sheriff and U.S. Immigration and Customs Enforcement are at odds over an incident involving suspected illegal immigrants Wednesday night.

MCSO deputies pulled over a truck with 12 suspected illegal immigrants along Interstate 17 near Anthem. Deputies said they were able to detain six of them on state human-smuggling charges.

Sheriff Joe Arpaio said the other six, including two children, admitted they were in the country illegally and had each paid $3,000 to $4,000 to be brought from Mexico to New York.

In cases like this, in which being in the country illegally is the person's only crime, MCSO routinely turns the suspected illegal immigrants over to federal ICE agents. However, when deputies called ICE Wednesday night, they say ICE agents refused to respond to the scene.

"It's unprecedented," Arpaio said.

For some reason, ICE is granting amnesty to illegal aliens captured by Maricopa County, as if that excuses their crimes.

"Following DOJ's finding of unlawful police practices by the MCSO, ICE dedicated 50 officers to provide 24/7 coverage of the Maricopa County jail," ICE spokeswoman Amber Cargile said in a written statement." Accordingly, ICE enforcement focuses first on serious criminal aliens who present the greatest risk to public safety, such as individuals charged with or convicted of serious crimes. ICE also prioritizes the arrest and removal of immigration fugitives and criminal aliens who have been previously deported and illegally re-entered the country."

The last laugh though is on ICE and John Morton. The U.S. Border Patrol picked up the illegal aliens and deported them to Mexico.

Arpaio's deputies convinced the Border Patrol in Casa Grande to take the six suspected illegal immigrants in question.

Cleary even the Department of Homeland Security components like the Border Patrol don't believe the Department of Justice lies about Sheriff Arpaio.

WASHINGTON -- Time's up for the head of the U.S. Customs and Border Protection, who announced Thursday he is stepping down at the end of the year when his recess appointment expires.

Alan Bersin served as the administration's Southwest "border czar" on undocumented immigration and drug smuggling. President Obama nominated him to be CBP commissioner in September 2009, and appointed him commissioner in March 2010 after the Senate failed to confirm him...

Bersin was one of 15 officials to be given temporary recess appointments in 2010 after their nominations stalled in the Senate. In November, Don Berwick, head of the Centers for Medicare and Medicaid Services and a lightening rod in the battle of health care reform, resigned from his temporary job before it expired at the end of the year.

Bersin was singularly inappropriate for the position of Commissioner of Customs and Border Protection, as like Zoe Baird, he was a serial employer of illegal alien nannies. But it was the continued use of lawyers for positions that call for professional law enforcement executives that is the most concern. All of the failures of involving immigration enforcement involved a cadre of shysters, Chertoff, Bersin, Napolitano, Myers, Morton. Every single one a shark with a sheepskin from an expensive law school. And nary a single one ever made an arrest.

Nary a word from “Say Anything” Mitt about the “payroll tax” fight, in which the inept Republican leadership has been sandbagged by Obama and the Democrats not once but twice. Mr. Bain Capital has bigger fish to fry.

In an interview with Boston radio host Howie Carr on Wednesday, Romney said “yes” when asked if Onyango Obama should be deported. Romney at first did not recognize the name, but said the nation’s immigration laws should be enforced.

Onyango Obama is the 67-year-old half-brother of the president’s late father. His case is pending in Framingham, Mass., District Court.

A Vandalized Valley

I am starting to feel as if I am living in a Vandal state, perhaps on the frontier near Carthage around a.d. 530, or in a beleaguered Rome in 455. Here are some updates from the rural area surrounding my farm, taken from about a 30-mile radius. In this take, I am not so much interested in chronicling the flotsam and jetsam as in fathoming whether there is some ideology that drives it.

Last week an ancestral rural school near the Kings River had its large bronze bell stolen. I think it dated from 1911. I have driven by it about 100 times in the 42 years since I got my first license. The bell had endured all those years. Where it is now I don’t know. Does someone just cut up a beautifully crafted bell in some chop yard in rural Fresno County, without a worry about who forged it or why — or why others for a century until now enjoyed its presence?

The city of Fresno is now under siege. Hundreds of street lights are out, their copper wire stripped away. In desperation, workers are now cementing the bases of all the poles — as if the original steel access doors were not necessary to service the wiring. How sad the synergy! Since darkness begets crime, the thieves achieve a twofer: The more copper they steal, the easier under cover of spreading night it is to steal more. Yet do thieves themselves at home with their wives and children not sometimes appreciate light in the darkness? Do they vandalize the street lights in front of their own homes?

In a small town two miles away, the thefts now sound like something out of Edward Gibbon’s bleaker chapters — or maybe George Miller’s Road Warrior, or the Hughes brothers’ more recent The Book of Eli. Hundreds of bronze commemorative plaques were ripped off my town’s public buildings (and with them all record of our ancestors’ public-spiritedness). I guess that is our version of Trotskyization.

The Catholic church was just looted (again) of its bronze and silver icons. Manhole covers are missing (some of the town’s own maintenance staff were arrested for this theft, no less!). The Little League clubhouse was ransacked of its equipment.

Problem identified. And the perpetrators?

There is, of course, a vague code of silence about who is doing the stealing, although occasionally the most flagrant offenders are caught either by sheriffs or on tape; or, in my typical case, run off only to return successfully at night. In the vast majority of cases, rural central California is being vandalized by gangs of young Mexican nationals or Mexican-Americans —
...

Perpetrators identified. Yet, perhaps out of fear, fear of the Brimelow or Sullivan treatment, or even the Federale treatment from Kevin Williamson, VDH backpedals. Its not a big problem or an overwhelming number of people who are the problem. Just a teny, tiny, subset of a certain group, who are also conveniently victims as well, and not the sea in which the criminal swims:

...in the latter case, a criminal subset of an otherwise largely successful and increasingly integrated and assimilated near majority of the state’s population. Everyone knows it; everyone keeps quiet about it — even though increasingly the victims are the established local Mexican-American middle class that now runs the city councils of most rural towns and must deal with the costs.

Yet he touches on the problem briefly, the racist mindset of Mexican immigrants. But VDH calls it "ethnic favoritism:"

Perhaps because illegal immigration poses so many mind-boggling challenges (e.g., probably over $20 billion lost to the state in remittances, the undermining of federal law, the prejudice shown against legal immigration applicants, ethnic favoritism as the engine of amnesty, subterfuge on the part of Mexico, vast costs in entitlements and subsidies), talking about it is futile.

But the fear is there, fear of what happened to others at NR, or what happened to Samuel Francis.

So most don’t, in fear of accusations of “racism.”

The fear is there. But VDH is coming to the obvious conclusion. Will he finally gain the courage to stand up to the raza hustlers? Stay tuned for any upcoming purges led by Kevin Williamson.

Gay Immigrant Couples Eye a Reprieve Under New Policy

When John Brandoli met his future spouse in the summer of 005, he did not care that he was falling in love with an immigrant who had arrived from Trinidad with only a tourist visa. They became inseparable, and in March of 2010 they wed...

Brandoli and his husband, Michael Thomas, faced a higher hurdle. Their marriage is recognized in Massachusetts, one of seven states to have legalized same-sex marriage. But under the Defense of Marriage Act, Thomas is not entitled to the federal benefits that marriage confers -- including the ability to update his immigration status.

While similar cases have ended with bi-national couples sundered by the federal prohibition of same-sex marriage, Thomas and Brandoli defied that outcome. Thomas was facing deportation for remaining in the country illegally -- he had been misled by a fraudulent immigration services provider that advised him against applying for asylum -- but Immigration and Customs Enforcement moved last week to close his case.

However, ICE has plenty of time and resources to apply to the Pink Mafia, assigning an Undersecretary of Homeland Security to deal with homosexual issues:

When asked by a Metro Weekly reporter whether same-sex couples would qualify, a senior administration official responded "yes." Nelson Peacock, an assistant secretary in the Department of Homeland Security's Office of Legislative Affairs, wrote in response to a question from Rep. Jerrold Nadler, D-N.Y., that "LGBT [lesbian, gay, bisexual and transgender] individuals' ties and contributions to the community are taken into account" in assessing whether their cases should be considered low priority.

Meanwhile, back on the border, ICE is unconcerned that the Sinaloa Cartel has been unaffected by arrests in November that were hyped in the media and continues its business of drug smuggling. One of ICE's "priorities" alleged is drug smuggling. It fights ongoing turf battles with the Drug Enforcement Agency (DEA) over the issue. It is a long standing battle that goes back decades, back to when the U.S. Customs Service claimed exclusive jurisdiction over drug smuggling. However, ICE appears to have surrendered their jurisdiction in drug smuggling investigations to the Tempe Police Department and the DEA.

TEMPE, Ariz. — Arizona authorities have arrested some 200 people, and seized $7.8 million in cash and more than 1,200 pounds of drugs following an investigation they say has dismantled an “extensive” drug trafficking cell tied to the powerful Sinaloa cartel, federal and state authorities announced Tuesday.

Authorities announcing the 15-month-long investigation said that although the Sinaloa cartel almost immediately regenerates after one of its cells have been taken down, their investigation certainly struck a blow.

“Arresting a drug dealer is one thing but if we can actually follow that backwards and take out the head of the snake of this organization, we exact a lot of pain on those cartels and those folks putting their distribution networks in Arizona,” Tempe police Cmdr. Kim Hale said at a news conference announcing the bust.

The 203 people arrested ranged all the way from street dealers and buyers to family members and friends of Sinaloa cartel members who were well-trusted in the organization, Hale said.

The 43 search warrants conducted as part of the investigation led to the seizure of 44 guns that included assault rifles, 650 pounds of marijuana, 435 pounds of methamphetamine, 123 pounds of cocaine and 4.5 pounds of heroin. Combined the drugs are estimated to be worth $12.5 million...

Separately, Phoenix agents with the Drug Enforcement Agency had been investigating the ring, so the two joined forces, along with other agencies.

Doug Coleman, acting special agent in charge of the DEA in Arizona, said that he expects further arrests in the case as the investigation continues.

It appears that ICE's "priority" is not stopping the Sinaloa Cartel, but imposing homosexual marriage on the United States. Not surprising given Barak Hussein Obama's history of drug use and lies about his opposition to homosexual marriage.

There Is No Power and No Reason to Subpoena Federal Judges

For now, though, I just want to address a bad part that is getting most of the attention — as Kate’s post from yesterday indicates. That’s the business about issuing congressional subpoenas to federal judges to coerce them into explaining themselves before lawmakers. As many commentators have suggested, this proposal would violate separation-of-powers principles. The judiciary is a peer of the political branches. It would be no more appropriate for Congress to subpoena a federal judge (or that judge’s clerks) about the reasoning of one of the judge’s rulings than it would be for Congress to subpoena the president (or his top advisors) about a controversial decision that was within the president’s constitutional authority, or for a judge or the Justice Department to issue a subpoena to a member of Congress (or the lawmaker’s staff) to question that member about the deliberations over some legislative act that arguably went beyond Congress’s enumerated powers.

Perhaps McCarthy should consult Eric "Black People" Holder about that subpoena power. He has been subpoenaed or threatened with subpoenas numerous times and testified even more times before a committee of Congress. H. R. Haldeman and John Erlichman, both Presidential advisors, have testified under threat of subpoena or were actually subpoenaed.

Sitting Supreme Court Justices and the Chief Justice have testified numerous times, mostly complaining about work load and pay, but they still have testified.

And how does McCarthy compare a podunk District Court Judge to a Constitutional officer like the President? I suppose the President could refuse, since he commands the U.S. Marshal's Service, the agency who enforces Congressional subpoenas. But a District Court Judge is a creature of Congress. District and Circuit Court of Appeals judges are created and disposed of by Congress. The Constitution created the Presidency and he is co-equal with Congress as a body. And co-equal to the Supreme Court as a body. A District Court Judge is not even the equivalent of a Cabinet Secretary. At best a District Court Judge is the equivalent of the lowest level of political appointee, or other who is confirmed or receives a commission from Congress, perhaps the equivalent of a commissioned officer of the U.S. Public Health Service, or other commissioned services. A sub-cabinet officer would be the equivalent of an Appeals Court Judge. A sitting Justice of the Supreme Court would be the moral and political equivalent of a Cabinet Officer, the Chief Justice somewhere inbetween a Cabinet Officer and the President and Vice-President, if only because he does have some prestige as the chief administrator of the courts.

But claiming any employee of the courts, such as a Clerk of the Court, a personal cerk of a judge, or the numerous administrative employees of a court or the judiciary in general, cannot be called to testify?

What inanity. But then, McCarthy's greatest achievement was that of Assistant United States Attorney. Not all that great. In fact they are notorious for the laziness, declining many more cases than they actually prosecute. Such power to determine their own workload engenders a certain lassitude that combined with a superior attitude results in Gingrichisms. Basically they are conceited jerks with delusions of grandeur, like Gingrich.

But there is nothing in the Constitution that prohibits any person from being subpoenaed by Congress McCarthy's claim not withstanding. Just ask Eric Holder who will be spending the rest of the term of Barak Hussein Obama in front of various committees.

If he is not careful McCarthy will end up as another Erwin Chemerinsky. In the end the purpose of Gingrich's scheme is to force judges to defend their writings under questioning. McCarthy seems to think that just writing a badly reasoned opinion is enough just because it is similar to a law school exercise. He thinks that just giving an opinion is talismic. No need to defend an opinion in a Socratic manner under questioning. Another aspect of the conceit of judges. They don't like questions. Being in a courtroom once or twice shows that judges, especially District Court Judges, don't like hard questions. They run their courtrooms with an iron fist in an iron glove. No one questions or challenges them. Not a good atmosphere for getting at the truth of a question. Questioning before a committee will bring a little humility and force them to defend their opinions with challenges to their assumptions and inconvenient facts that they either ignored, discarded, or discounted. And if an adversary system is good enough for the opposing counsel in a courtroom, then it is good enough for a Judge as well. It might also help with their humility. Nothing like a little public criticism, something that judges dish out every day to witnesses, defendants, litigants, and lawyers every day.

But in the end it all comes down to one thing, is the subpoening of judges to testify as to their official actions and decisions prohibited by the Constitution? There is no such prohibition in the Constitution. That, in the end, is all that one has to know. Of note, if the Chief Justice can testify under oath voluntarily to a Committee of Congress, why cannot he be forced to? It appears that the issue of testifying to a Committee has already been settled in Congress's favor. All that is at issue is the voluntaryness of the testimony.

In addition to ongoing efforts to keep visa wait times low, the United States is encouraging the Chinese government to extend visa reciprocity to allow both U.S. and Chinese travelers longer validity visas, which is in the interests of both nations.

But the real issue is that the Regime is engaging in its policy of encouraging illegal immigration and voter fraud, and electing a new people, by this program of massive issuance of non-immigrant visas to Chinese nationals, most of whom will not return. Half of the illegal aliens in the U.S. enter with a non-immigrant visa.

Note that while the press release uses the term "adjudication," what it really means is approval. In adjudicating, one just reviews and decides. Part of that can mean a denial of an application, but the boosterism signifies that the purpose of adjudicating is in reality approving Chinese non-immigrant visa applications. This is reminiscent of Al Gore's Citizenship USA where millions of aliens were naturalized illegally, without criminal and intelligence checks and legal standards were relaxed, resulting in the naturalization of millions of aliens unlawfully so they could vote for Clinton in 1996.

Lafferty was circled by several members of Secretary Clinton’s staff before being approached by a member of the security detail, demanding Lafferty follow him. When asked why she was being removed from the reception hall, the security detail announced that a phone call had identified Lafferty as a “security threat” to Secretary Clinton.

Clearly there was no basis for the detention under Terry v. Ohio. Lafferty represented no threat and no reasonable agent could conclude otherwise. Terry gives a law enforcement officer the authority to stop and temporily detain a person based on reasonable belief based on articulable facts that the person detained has commited, will commit or is committing a crime. Clearly a public figure at the public eye and at a public event where the access was controlled and the attendees searched clearly represented no threat, and hence there was no authority to detain her.

Now this is a civil rights violation that the Department of Justice Civil Rights Division should be investigating, rather than the trumped up lies in a recent report on Sheriff Joe Arpaio. But then we no longer live in a nation of laws, but in that of incipient Stalinist dictators.

All this to the eternal shame of DSS, a once proud and professional law enforcement agency, and, who never lost a protectee, unlike the USSS.

Homeland Security Limits Ties With Arizona's Sheriff Joe Arpaio

The Department of Homeland Security reacted quickly Thursday to news that the Justice Department had accused Joe Arpaio, the Arizona sheriff known for his tough policies on illegal immigration, of a “pattern of misconduct” that permitted unlawful arrests and excessive force against Latinos.

In a statement, Homeland Security Secretary Janet Napolitano said her department was ending one agreement with Arpaio’s Maricopa County Sheriff’s Office and restricting the office’s access to another Homeland Security program.

“Discrimination undermines law enforcement and erodes the public trust,” Napolitano said. “DHS will not be a party to such practices. Accordingly, and effective immediately, DHS is terminating MCSO's 287(g) jail model agreement and is restricting the Maricopa County Sheriff's Office access to the Secure Communities program.”

Under the 287(g) program, Arpaio’s deputies could question jail inmates about their immigration status. Under Secure Communities, fingerprints collected by state and local police are shared with immigration authorities to identify and deport tens of thousands of people each year.

The main complaint of DOJ CRD was that Arpaio's deputies were arresting too many "Latinos." By which they mean Mexican illegal aliens and other Mexican criminals in Maricopa County. Well, just as the Oakland Police Department, the New York City Police Department, the Los Angeles City Police Department, and the Los Angeles County Sheriff's Office all arrest "too many" blacks and "Latinos" as well. Not to mention ICE and the U.S. Border Patrol (USBP) who arrest lots of "Latinos" as well. In fact illegal alien boosters complain that ICE arrests too many Latinos as well.

Report: Immigration Raids Violated Rights

(AP) Immigration agents raiding homes for suspected illegal immigrants violated the U.S. Constitution by entering without proper consent and may have used racial profiling, a report analyzing arrest records found.

Latinos made up a disproportionate number of the people arrested who were not the stated targets of the raids, and many of their arrest reports gave no basis for why they were initially seized, said the report, which was based on data from raids in New York and New Jersey.

So, why isn't DOJ CRD threatening Janet Reno Napolitano for her race based arrests? Why, because Sheriff Joe has not been cooperating with the Obama Regime Administrative Amnesty.

And why hasn't DOJ CRD arrested Dearborn Police Chief Ronald Haddad, who ordered the arrest of Christians for daring to preach the Gospel of Christ in Dearborn? Because the DOJ CRD does not care about the civil rights of Christians, whites, heterosexuals, or gun owners. In fact Attorney General Eric Holder is a rabid racist who considers blacks "his people."

To the Regime, the law is nothing more than a Stalinist construct, the sole purpose of which is to serve the ideology of the Regime. And in this particular case, civil rights means hammering down any one who has opposed the Administrative Amnesty. The end result will be a Show Trial, but the one wrench in the works is that the Regime will have to hold a trial in Maricopa County. A conviction is unlikely given the jury pool there where Arpaio always wins re-election hands down. Therefore Arpaio should watch his back and avoid people who own ice axes. One might consider that in jest, but nothing is beyond this Regime. Just ask Brian Terry.

But in the end one must not forget that ICE issued a report on Arpaio and gave him a clean bill of health on 287(g).

Six months prior to this investigation the Immigration and Customs Enforcement agency (ICE) had already conducted its own investigation of sheriff Arpaio’s office and not only gave it a clean bill of health, they actually gave a raving review. The report said things like “The OI and DRO supervisors consider the conduct and performance of the MCSO … officers to be professional and meeting the requirement of the MOA.” And that they considered the working relationship between the feds and the sheriff’s office to be “excellent” and that cases brought by the sheriff’s office to be “high quality.”

There we have it. The DOJ CRD report is nothing more than lies designed to support the amnesty.

Admitted noncitizens and 'very conscientious voters' could face prison, deportation

A Waukegan couple who are Iranian immigrants could face up to five years in prison and deportation if found guilty of falsifying documents on voter applications.

Mahmoud Vakili, 67, and his wife Parvin Vakili, 62, pleaded not guilty in Lake County on Wednesday to charges of perjury of the election code and mutilation of election material. They were charged in early November, officials said.

During Wednesday's hearing, Judge John Phillips asked the couple if they were U.S. citizens, to which each responded: "No, sir, I am not." Both said they were born in Iran.

According to the Lake County Clerk's office, Mahmoud Vakili first registered to vote in Lake County in 1988 and his wife in 1992.

Since then, Mahmoud Vakili has voted five times and Parvin Vakili seven times, Clerk Willard Helander said. They most recently voted in 2010.

"They were very conscientious general-election voters," Helander said.

Law enforcement officials were tipped off after the Vakilis' son requested a letter from the clerk's office to confirm his own voter registration status, Helander said.

Of more import is that U.S. Citizenship and Immigration Services (USCIS) is ignoring the law and allowing the two to continue their naturalization applications:

As part of the citizenship process, if someone admits to or is suspected of having registered to vote without being a U.S. citizen, that person is required to submit a letter certifying his or her voter registration status, a spokesman for the U.S. Citizenship and Immigration Services said. Foreign nationals are forbidden by law to vote in national or state elections.

As previously documented, U.S. Citizenship and Immigration Services continues to ignore the law. Any alien who votes in an election is deportable and prohibited from naturalization. Instead, USCIS informs said aliens that their application for naturalization will be held in abeyance until the contact their Registrary of Voters and have their names removed. USCIS is supposed to deny the application and then place the alien in removal proceedings either itself or report the aliens to U.S. Immigration and Customs Enforcement (ICE) for removal. However, neither has occurred and the two illegal aliens appear to be beneficiaries of the administrative amnesty.

Immigration and Customs Enforcement has released prominent researcher, consultant, and business owner Atanas Entchev and his son from detention after his wife Mayia started a campaign on Change.org that garnered more than 1,000 supporters...

"We are thrilled the Entchevs were released from detention,” added lawyer Eric Mark. “However, the Stay of Removal is a temporary and insufficient solution. We will begin immediately to work on a permanent solution to keep this talented, hard-working, and beloved family in the United States where they can continue to contribute to this country as they have for 20 years.”

But hold on. Reading carefully one gets to the truth, with alot of shading of the facts by the press.

Atanas Entchev, a prominent expert in geographic information systems and owner of New Jersey-based consulting firm Entchev GIS Architects, legally immigrated to the U.S. 20 years ago after he was awarded a prestigious fellowship by Rutgers University to expand knowledge in a specialized architectural field. His son and wife arrived two years later. After obtaining an exchange visitor visa, the family applied for asylum from Bulgaria but were denied. Atanas was then approved for a visa as an Outstanding Professor/Researcher but received faulty legal advice that led to the case not being reopened.

It appears that Entchev pere entered on either a student visa or exchange visitor's visa, F-1 Student visa or J-1 Exchange visa, in 1991, well after the fall of communism in Eastern Euriope. And he did not immigrate, he entered as a non-immigrant temporary visitor. Wife and child then arrived two years later, that makes it 1993, well into the change that had swept the former Soviet Bloc.

Then there was some sort of visa change, perhaps he entered on a B-1 business visa for the fellowship, but unlikely, but in any event he attempted to change visas presumeably from F-1 to J-1. So add a year for that. Then he and family apply for political asylum, perhaps sometime in 1994 or 1995. Obviously that was denied for fraud. There was no tyranny to be an asylee from regarding Bulgaria. Perhaps if this had been 1984 or 1985. But not well after the fall of communism.

Generally it takes several years for an asylum claim to be denied, but the Entchev family was enjoying employment authorization at that time. So, after asylum is denied, sometime in approximately, say 1998-2000, they then apply for an immigrant visa, EB-1(b) visa for pointy headed intellecutals. Its approved, but for some reason a treason bar member tells him not to accept the visa after it is approved? Perhaps because by this time the children have aged out and can no longer be on the visa? Who knows. More likely there was some issue of material factual mistatement on the visa application? All at this time he is running a successful company. Hardly the work of an academic. Perhaps that is the issue.

So then his case in removal proceedings is finished and he gets an order of removal. For what effective date, who knows. Obviously there were some appeals, but U.S. Immigration and Customs Enforcement, Enforcement and Removal Opertations (ICE ERO) is not know for moving swiftly on said orders despite the fact that the Entchevs are not hiding. So, from perhaps 2005 to today there has been an outstanding remvoal order.

But basically the Entchevs were not "here legally" for 20 years. They were here legally for perhaps only 2-3 years. For most of that time the Entchevs were gaming the system and continue to do so. Also of interest, ICE ERO was aiding and abetting this game by failing to timely arrest the Entchevs, but also administering their own amnesty by failing to arrest Mayia Entchev. They let her remain free with the same removal order outstanding that they used to arrest Atanas and Enislav. This was deliberate, as they knew Mayia would do just what she did, work hard to get the administrative amnesty.

“This is a clear example of Change.org’s platform serving its purpose: to empower anyone, anywhere to take action on the issues they care about,” said Gabriela Garcia, an organizer at Change.org. “The progress that Mayia Entcheva has seen with her campaign in just a matter of weeks, even as her husband has been held in detention and her family’s consulting firm has struggled as a result, demonstrates how possible it is for everyday people to make a difference.”

Had ICE ERO also arrested Mayia, there would have been no campaign to get them administrative amnesty. Had all three been arrested, they most likely would have had to submit to deportation because they would have been without the access to the communist run network and the funds to organize and administer the pressure campaign.

This is typical of ICE ERO, they almost never arrest the whole family, always leaving wife or minor children free to thwart the system.

There we have it, a story of lies and failure on behalf of a lying family of illegal aliens. All aided and abetted by ICE ERO.

Owner of La Verne Flight School Arrested in Visa Fraud Scheme

LA VERNE, Calif. (KTLA) -- A woman who operates a flight school that trains foreign nationals was arrested Wednesday morning in a visa fraud scheme.

Investigators say the woman oversaw a scheme that allowed foreign nationals from Egypt, Sri Lanka and Taiwan to enter the United States for commercial pilot training at her school, even though the flight school was not approved to train foreign students.

Karena Chuang, 28, of Lake Elsinore, the owner of Blue Diamond Aviation, was arrested Wednesday morning without incident, according to Thom Mrozek of the U.S. Attorney's Office.

Authorities say the investigation into Chuang began in June 2010 when visa security officers in the ICE Attaché Office in Cairo reported that two Egyptian nationals who had received visas to attend a northern California flight school admitted in an interview that they had in fact planned to enroll at Blue Diamond Aviation.

Unlicensed drivers without prior convictions would be given the chance to avoid having their vehicles impounded under new rules outlined Tuesday by the Los Angeles Police Department.

The proposed changes to the impound procedures are a potentially explosive issue because LAPD Chief Charlie Beck designed the reforms to remedy what he believes is the unfair burden that impounds place on illegal immigrants. Since immigrants who are in the country illegally cannot get driver's licenses in California and most other states, they make up the majority of the drivers who have their cars impounded for the infraction.

Beck contends that the hundreds of dollars in fees and fines that must be paid to retrieve an impounded car and the disruption to illegal immigrants' often tenuous hold on jobs deal a disproportionate blow to people "who are a valuable asset to our community and who have very limited resources."

Beck's statements to the press are of great interest because they present both sufficient probable cause for an arrest or grand jury indictment of Beck for violation of Title 8 United States Code, Section 1324, Bringing and Harboring Certain Aliens.

(iii) knowing or in reckless disregard of the fact that an alien has come to, entered, or remains in the United States in violation of law, conceals, harbors, or shields from detection, or attempts to conceal, harbor, or shield from detection, such alien in any place, including any building or any means of transportation;

(iv) encourages or induces an alien to come to, enter, or reside in the United States, knowing or in reckless disregard of the fact that such coming to, entry, or residence is or will be in violation of law;

Beck establishes not only the violation, but the mens reas for the crime, knowledge and intent to violate the statute. His statements include knowledge that a person is an illegal alien and that this policy knowingly aids and assists the illegal aliens to remain in the United States.

The remarks by CBP Commissioner Alan Bersin came at a news conference in at which he announced statistics showing that apprehensions of illegal border-crossers in Arizona fell to 129,118 in the fiscal year ending Sept. 30 - a 41-percent decline over the previous year and the lowest level in 17 years.

Nationwide, U.S. Border Patrol apprehensions are down 53 percent since 2008, and Bersin gave a large part of the credit to an unprecedented increase in manpower (the Border Patrol has more than doubled in size since 2004, to 21,444 agents), as well as to new technology and infrastructure.

Bersin said the $11.8-million, 23-to-30-foot-high fence in Nogales, completed at the end of last summer, has helped keep fence-jumpers outside the city, where it is easier for them to blend in and escape detection.

If it is effective then why hasn't this fence been extended to the whole 2,000 miles of border with Mexico? Why, because some don't want it.

Jonah’s post this morning was the first I had ever heard of the TLC show All American Muslim, so I have nothing to say about the show or its content. But a story on Politico this morning caught my attention. A Democratic legislator in California has announced a personal boycott of Lowe’s home-improvement stores in his district because, according to the story, Lowe’s has pulled advertising from the TLC after complaints about the show from a group called the Florida Family Association. The lawmaker decried the “bigotry” involved in the store’s decision to pull advertising.

That California lawmaker is Ted Lieu, who is a former law-school classmate of mine and someone I have long considered a friend. =[sic.] Ted is an honorable guy who served [sic.] his country as an Air Force JAG officer. He’s also a very smart and capable guy, having served as president of Georgetown’s main law review. But Ted is grandstanding just a tad here.

Coffin was an attorney on Dick Cheney's staff and the arch typical beltway denizen, having abandoned residence in a State for the District of Columbia and a revolving door career in government and lobbying, now working for the insider and traditionally Demoncrat white shoe law firm of Dewey, Cheatem, and Howe....I mean Steptoe and Johnson, LLP. Sort of the Newt of Republicrats, feeding off the beast, part of the problem rather than the solution.

Why any nominal conservative and Republican would be associated with Lieu for any reason is beyond belief. Lieu was the token Asian on the big lie report about the alleged scandal at the Rampart Division of the LAPDogs. The Rampart report was a lie from start to finish. In fact, the Rampart scandal revolved around one corrupt affirmative-action Hispanic officer, Rafael Perez, who lied about innocent officers in the CRASH unit in order to obtain a lighter sentence for his theft of drugs from an evidence locker. And Coffin's good friend Lieu participated in the cover-up of the lies from Perez. Yet Lieu is still Coffin's friend.

Such lies against white police officers was not enough for Coffin to see the truth. He tells us Lieu was a Judge Advocate General officer. Coffin seems to forget about Benedict Arnold and Nidal Hasan, who also were officers, and so was the nut job Erik Scott. Coffin even excuses Lieu's treason to the Constitution and his attempt to criminalize not supporting radical Islam and the propaganda to white-wash it.

Make it clear, Ted Lieu wants to punish people in the United States for not supporting radical Islam. He wants to fine or jail those who do not kowtow to Islam. And I do mean kowtow. Kowtowing to the Imperial Person of the Emperor of the Middle Kingdom was a symbol of the submission of inferiors to the superior. It was demanded of tributaries. It is quite similar to the manner of prayer of that Muslims practice to the moon-god Al-Ilah who's black stone lies in the Kabba at Mecca. An Satanic alliance of the Chinese and Islam against America. Rightly American diplomats refused to kowtow to either the Emperor or officials inferior to him. And in days of yore, American diplomats refused to submit to Sharia, its adherents, or their dictatorship. But not anymore.

Coffin sets a different example, toadying, kowtowing, submitting, to his Demoncrat friends who are destroying the nation and themselves bowing to Saudi royalty, the Japanese Emperor, and even the President of Red China.

Which is no surprise, as Lieu, though born in Taiwan, has abandoned the honor of Chiang Kia-shek for the typical subservience of the mainland born, attacking freedom and perpetuating lies at every opportunity. And that is a man that Coffin calls a friend. An enemy of the Constitution and the freedoms that our Founding Fathers bequeathed to us. A Republic if you can keep it, but not if it interferes with Republicrat friendships. Such fighting words are not for beltway shysters.

But it is no surprise that an immigrant from China (There is but one China and Taiwan is a province thereof, but it is the Republic of China.) is an enemy of the Constitution. Lieu is much like Goodwin Liu, another immigrant from the Chinese province of Taiwan, another rabid racist law school graduate and Demoncrat (they always go together) who hates America's freedoms. Liu also opposes free speech and supports discrimination against white Americans.

And don't forget another Demoncrat, Wen Ho Lee, another immigrant from the Chinese province of Taiwan. A traitor through and through. An agent of Red China. An enemy of America.

Immigrants all. Enemies of American freedom all. Vile traitors. And what attorney remains at the Bar when he commits such a blatant violation of his oath to the Constitution as an attorney, a commissioned officer of our Armed Forces, and as State Legislator? Clearly much professional courtesy from Coffin, much like sharks. His many oaths clearly mean nothing, but NRO again apologizes and tut-tuts about this assault on the Constitution. And no mention by Coffin that this traitor is an immigrant. Part of the NRO embargo on criticism of minorities and immigrants.

_ Detainees at Jefferson County Jail were told they had to pay for medical treatment, reported excessively cold conditions where they had to share blankets and said they only got a hot meal once every one to two weeks.

_ Detainees at Boone County Jail said it was almost impossible to contact attorneys. One detainee said a doctor had told him that a growth on his neck required further testing and might be cancerous, but the detainee was repeatedly denied requests to see a doctor. Another HIV-positive detainee was not allowed to see a doctor for more than six weeks.

_Detainees at Tri-County Detention Center said there is only one phone for every 50 detainees, making it difficult to call attorneys.

"For many of the individuals in those facilities, they're not able to make a connection with an attorney and are not aware of their legal rights," McCarthy said.

For all the wailing and nashing of teeth, this is all that these communist run pressure groups have found, not enough telephones. That is all they could find. It sounds like these facilities are well run. The illegals should be thankful that they are not in custody of Sheriff Joe, living in tents in the desert. But even that is legal.

But of course the facts aren't the important part of the reports by these communist groups. It is the allegation that counts. Most will not even read the story, but only the headline. Man On Dialysis Deported, Then Let Back In US

A Mexican man who was deported while undergoing dialysis will be allowed back in the country on humanitarian grounds.

Immigration and Customs Enforcement officials said Wednesday they have granted humanitarian parole to 43-year-old Francisco Cortez Lopez. He was removed from the country in November and has spent the last three weeks in Tijuana.

Immigration officials say a judge issued a voluntary departure order for Cortez in 1998 but he failed to leave the country.

ICE officials say authorities arrested Cortez last month and offered him an opportunity to be released under an order of supervision so he could complete his treatment and arrange for follow-up care in Mexico but he declined.

Of course, why cooperate when you can demand better treatment.

Cortez and his attorney, Meredith Brown, say he wasn't given the choice.

I am certain that is a lie, but equally shocking. Whose responsibility is it to provide free medical care to Mexican citizens? Mexico or the United States? And why are we rewarding someone who openly and flagrantly reneged on an agreement to leave voluntarily. The arrogance of these criminals is beyond belief.

And, of course, once this treatment is finished, he will not go back to Mexico. He will remain, again defying any agreement to leave, if ICE conditioned this parole at all, which is unlikely. He will remain at least for another 10 years illegally. It is clear that ICE has no interest in enforcing American law, but aiding and abetting aliens to remain illegally.

Customs and Border Protection (CBP) is working to employ new metrics that will be used to estimate the numbers of illegal aliens crossing the southern border into the United States and the likelihood of their apprehension by Border Patrol. These new metrics also will be used to help to determine Border Patrol staffing levels in the future.

The new initiative to gauge the security of the southwest border follows Department of Homeland Security (DHS) sources having told Homeland Security Today in May that policymakers are considering whether, as a matter of official policy, metrics could be used to justify an acceptable level of illegal migration into the United States and a possible reduction in the CBP workforce due to the reduction in illegal border
crossers.

Although sources familiar with the matter said officials have had discussions about whether an acceptable level of illegal migration could be tolerated as a matter of policy, no such policy has been implemented. They acknowledged that such a policy would be radical and difficult "to sell," as one put it.

And BPAs will be twiddling their thumbs rather than arresting the illegals U.S. Immigration and Customs Enforcement refuses to arrest:

CBP officials familiar with the matter had earlier told Homeland Security Today that the decrease in apprehensions of illegals has triggered officials to consider whether some Border Patrol stations, outposts and CBP operations along the southern border are “over-manned” because they’re not as busy as they’d been in recent years when the numbers of illegal aliens entering the United States had hovered around 1 million annually, give or take roughly one or two-hundred- thousand some years.

Some of the officials said "things" have had to be "found ... to [keep some agents] busy."

In years past, the U.S. Border Patrol exercised wide and far ranging interior duties, with stations well within the United States, such as Tracy, CA, on the outskirts of the San Francisco Bay Area. From there they enforced the law, keeping employers and illegals on their toes, prohibiting the establishment of long term illegal presence, but that ended with Jorge Bush. NEW YORK — The U.S. government has dropped its New York deportation case against an Argentine lesbian who married a U.S. citizen, marking an improvement in the treatment of cases of same-sex couples involving a legal alien and a U.S. citizen, a lawyer for the woman said Tuesday.

The Argentinean, Monica Alcota, was supposed to be in U.S. Immigration Court in Manhattan Tuesday, but her lawyers were notified Monday that Immigration Judge Terry Bain signed an order Nov. 30 dismissing the case because “good cause has been established,” said Alcota’s Los Angeles attorney, Lavi Soloway.

Soloway based the request to dismiss the case on Alcota’s marriage to her U.S. citizen spouse, Cristina Ojeda, her deep ties to her community, the absence of any adverse factors and her activism against the Defense of Marriage Act, signed into law in 1996.

There we have it, come to the United States, violate the law, publically agitate against the same law that was violated, and then gain amnesty. No consequences, just rewards for violating American law.

“A 32-year-old Mexican national charged with a felony and traffic offenses after running a red light and then punching the police officer who arrested him, sending the officer to the hospital. On Sept. 7, 2011, he was released from Cook County despite an immigration detainer.

“A 28-year-old Mexican national arrested in September and charged with criminal trespass to vehicles (misdemeanor), aggravated battery of a peace officer (felony), and battery-cause bodily harm (misdemeanor). She was released from Cook County two days after her arrest despite an immigration detainer.

“A 33-year-old Mexican national arrested in September and charged with felony possession of cocaine. He was previously deported by the Border Patrol on Feb. 27, 2009 under an expedited removal order; that removal order would have been reinstated by ICE. He was released from Cook County on the day after his arrest despite an immigration detainer. Re-entry after deportation is a felony punishable by up to 20 years in federal prison...”

However, ICE is not all that concerned. In a nonchalant response, ICE did not request help from the public locating these illegal aliens for arrest, but put it off on Cook County:

In an October statement to WorldNetDaily about immigration detainers, ICE said it “has not sought to compel compliance through legal proceedings.”

“Jurisdictions that ignore detainers,” the agency added, “bear the risk of possible public safety risks.”

So much for ICE leaping into action to protect Americans from dangerous, felonious, illegal alien criminals. Instead they do nothing and pass the buck, not paying attention to their own so-called "priorities."

MEXICALI, Mexico — Arrests of illegal migrants trying to cross the southern U.S. border have plummeted to levels not seen since the early 1970s, according to tallies released by the Department of Homeland Security last week, a historic shift that could reshape the debate over immigration reform.

The Border Patrol apprehended 327,577 illegal crossers along the U.S.-Mexico border in fiscal year 2011, which ended Sept. 30, numbers not seen since Richard Nixon was president, and a precipitous drop from the peak in 2000, when 1.6 million unauthorized migrants were caught.

More than 90 percent of the migrants apprehended on the southwest border are Mexican. The number of illegal migrants arrested at the border has been dropping over the past few years but appears to be down by more than 25 percent this year.

What is needed now is for the U.S. Border Patrol to return to its interior enforcement responsibilities long exercised in the past but neglected of late, including farm and ranch inspections, employer sanctions raids, interior transportation hub checks, and a reopening of interior Border Patrol Stations, such as Tracy, CA, that were closed down during the Jorge Bush Administration.

But as reported, the Obama Regime has ended both U.S. Immigration and Customs Enforcement and U.S. Border Patrol interior enforcement. Combined with EVerify, interior enforcement will support the small but real success at the border.

"I didn't want to put 'Asian' down," Olmstead says, "because my mom told me there's discrimination against Asians in the application process."

For years, many Asian-Americans have been convinced that it's harder for them to gain admission to the nation's top colleges...

Amalia Halikias is a Yale freshman whose mother was born in America to Chinese immigrants; her father is a Greek immigrant. She also checked only the "white" box on her application.
"As someone who was applying with relatively strong scores, I didn't want to be grouped into that stereotype," Halikias says. "I didn't want to be written off as one of the 1.4 billion Asians that were applying."

Her mother was "extremely encouraging" of that decision, Halikias says, even though she places a high value on preserving their Chinese heritage.

"Asian-American is more a scale or a gradient than a discrete combination . I think it's a choice," Halikias says.

Some hate, others are just in denial of their white heritage.

But leaving the Asian box blank felt wrong to Jodi Balfe, a Harvard freshman who was born in Korea and came here at age 3 with her Korean mother and white American father. She checked the box against the advice of her high school guidance counselor, teachers and friends.

"I felt very uncomfortable with the idea of trying to hide half of my ethnic background," Balfe says. "It's been a major influence on how I developed as a person. It felt like selling out, like selling too much of my soul."

Note that their mothers' instinctively knew that white culture treated them better as women that Asian culture. Hence they stepped up in life marrying a white American. It is sad though that White America built Black Run America, where colleges and universities practice racism to protect BRA. But as half-castes their lives in Asia would not be nice. While some like Brenda Walker at VDare think that California is just trying to get the amnesty in before Obama is removed, it is more likely that this State amnesty is part of the Obama Regime Amnesty.

The clue is that just as the Regime is implementing the DREAM Act, a piece of legislation repeatedly defeated in Congress, the Regime will similarly have no qualms on implementing a State amnesty as the Constitution is no bar to their misconduct.

1 Million Undocumented Immigrants Could Live And Work In California Under Newly Introduced Measure

Nearly 1 million undocumented immigrants could live and work openly in California with little or no fear of deportation under an initiative unveiled Friday by a state legislator and others.

Assemblyman Felipe Fuentes, a Democrat, is helping to spearhead the measure, called the California Opportunity and Prosperity Act...

Fuentes called the measure a "moderate, common-sense approach" necessitated by the federal government's inability to pass comprehensive immigration reform.

"I hope this shows Washington, D.C., that if they fail to act, California will take the lead on this critical issue," Fuentes said in a written statement.

Another clue to the perfidy of the Regime is that as in the case of the Utah State Amnesty, the Regime is challenging the enforcement aspects of Utah's amnesty, not the amnesty itself.

While the DOJ freely criticized the State's enforcement measures, the DOJ also stated it would not be challenging two Utah guest worker bills signed into law last spring, H.B. 116 and H.B. 469, despite acknowledging in its release that federal law "clearly" preempts these measures. "Given that the provisions do not take effect until 2013, and in light of the constructive conversations the department continues to have with Utah officials about these provisions pursuant to the Justice Department's long-standing policy of exploring resolution short of litigation before filing suit against a state, the department is not challenging these provisions today," the press release read.

It is perhaps a case of the States' tail wagging the Obama Regime dog, but the Obama Regime is perfectly capable of being led around by the nose by the left on amnesty. The Regime will accept and support the California Amnesty.

Johannes Mehserle, Four Others Cleared In BART Police Brutality Trial

Former BART police officer Johannes Mehserle and four others were cleared by a federal jury on Thursday of using excessive force during a 2008 confrontation with an Oakland man, sparing the transit agency from a costly payout.

Kenneth Carrethers alleged that Mehserle and four other BART police officers unlawfully hog-tied, kicked and punched him after he confronted them verbally at the Oakland Coliseum BART station. The incident occurred about six weeks before Mehserle shot and killed Oscar Grant III, an unarmed passenger, on Jan. 1, 2009.

The seven-person jury deliberated for about six hours over two days before delivering its verdict in the civil case at the U.S. District Court in San Francisco. When the verdict was read, Carrethers slumped and shook his head. Mehserle and the four other defendants later hugged each other and their lawyer, Dale Allen...

And the whining racist mau-mauing begins:

Dolan said the makeup of the jury played a factor in the verdict. There was not one black juror, and the sole minority person on the panel asked to be dismissed earlier in the trial. Carrethers is black.

“It’s unfortunate that Mr. Carrethers did not have a jury of his peers,” said Dolan. Allen said the jury was selected from a pool vetted by both lawyers.

The jury “weighed all the evidence and found that Mr. Carrethers did not meet the burden of proof for his claims,” Allen said.

And this looser ain't too bright. He attacked cops because someone else burglarized his car:

Carrethers conceded that he verbally berated Mehserle and the four officers, claiming he was upset that his car had been broken into twice in the past month and that BART police weren’t doing enough to prevent such crimes. However, he said he never physically threatened the officers. That claim was disputed by Mehserle, who testified that he was certain that Carrethers raised his fist in an attempt to hit Officer Frederick Guanzon.

Stupid is as stupid does. But it does show that fighting these lawsuits is better than settling.

More Shenanigans On The Obama "Record" Deportations

The Christian Science Monitor reports that Matthew Kolken of the Treason Bar is questioning the Obama deportation numbers for FY 2011. Not questioning the actual number of deportations, or that 19,000 of the alleged 297,000 deportations were actually from FY 2010, though the premise of his complaint is that Obama is deporting record number of illegal aliens, but questioning the alleged emphasis on criminal aliens while letting other illegal aliens remain in the Obama Regime Administrative Amnesty.

Illegal Immigration: Are Obama Deportations Truly Aimed At 'Criminals'?

US says it deported a record 216,000 'criminal aliens' in fiscal 2011, but immigration court statistics show a drop in criminal deportation proceedings from the Bush years. How do those square?

Immigration attorney Matthew Kolken is openly questioning the forthrightness of the Obama administration these days.

He knows the Obama administration is in a tough spot. Congress is refusing to take up immigration reform, and the president is being squeezed between Republicans who claim he is soft on border crossers and Hispanics who say he has not done enough to resolve the status of longtime illegal immigrants.

Yet it is the administration's response that has left Mr. Kolken suggesting that the government "is not being truthful." Immigration officials say they are cutting a "common sense" middle path – ramping up deportations of criminal illegal immigrants but also granting prosecutors discretion to have compassion on law-abiding illegal workers who have close ties to the United States...

Statistics from an independent clearinghouse for federal data, however, appear to contradict some of the government's claims. Moreover, the Transactional Records Access Clearinghouse (TRAC) at Syracuse University in New York says the administration has been hesitant to release details behind a record 400,000 deportations in the past year.

The result has been growing concern among critics on the left and right that the Obama administration is playing politics – holding back data that might upset the Hispanic community, which is seen as crucial to the president's reelection prospects. Obama officials refute that assertion, but Kolken, for one, is skeptical.

"What I have seen coming out of TRAC, this administration is not being truthful with regards to the data they're releasing, or at least with regard to the public-relations spin they're putting on policies," says Kolken, who works in Buffalo, N.Y. "Every time they say something, TRAC looks at the cold, hard data, and it contradicts the press releases. It's a repeating pattern..."

The problem is that immigration court statistics obtained by TRAC show that actual criminal deportation proceedings have dropped below Bush administration levels. So how are deportations of criminal aliens up 89 percent over 2008?

Well, we know that the Regime is dishonest and Kolken has continued his jihad on the Regime for daring to deport favored illegal aliens. But more importantly he has refused to acknowledge that the total numbers are a fraud as well.

Of course Kolken's purpose is the end immigration enforcement, so any lie will do. His usual pattern is to select some illegal alien about to be deport and conspire with others to publicize that deportation, resulting in that alien being released. A kabuki theater of immigration enforcement and the corrupt dance the Treason Bar and MSM play with the Regime, as occured here. But he does do a service in pointing out that the Regime has been falling down on the job of deporting criminal aliens. But that failure is also a part of dismantling of immigration enforcement in general. But recent professional experience has told me that the Regime's policy of not touching non-criminal illegal aliens has been fully implemented at the Field Office level by U.S. Immigration and Enforcement, Enforcement and Removal Operations (ICE ERO). But is also clear that removals are in free fall. But then that was the purpose of the Administrative Amnesty. It just ain't happening quickly enough for the Treason Bar.

America hating radical Chuck Schumer and RINO Mike Lee have teamed up and finally introduced legislation to sell America to aliens for a measley price that was previously reported here. Just purchase a residential property and an alien can live here. Supposedly the alien and his family cannot work or received "federal" benefits. But what about "State" benefits? No restriction on that. But many aliens are not supposed to receive federal benefits, but do in ways both legal and illegal. And it won't be long before they start working illegally, or complain that they can't afford to live here in their new home without working or welfare.

Give Me Your Gucci-Clad Masses

“GIVE me your tired, your poor, your huddled masses,” reads Emma Lazarus’s ode to immigration inscribed on a plaque beneath the Statue of Liberty. More than a century later, however, it is the jet-lagged and rich who are receiving the warmest welcome at America’s borders.

Two senators, Charles Schumer, a Democrat, and Mike Lee, a Republican, recently introduced legislation to fast-track visas for foreigners spending $500,000 on residential property. Their Visit USA Act would allow purchasers and their families to live in America for as long as they owned their houses, though not to work there or receive any federal benefits.

But The Economist also points out that the EB-5 program, where immigrants get a green card with the right to work and welfare, has deteriorated to the point that they can purchase $500k in State or local bonds to get legal permanent residence and eventually citizenship.

Although the act is unlikely to become law anytime soon, would-be immigrants with half a million dollars in hand need not despair: America has a visas-for-cash scheme up and running. The Immigrant Investor Programme, also known as EB-5, was set up in 1990 to lure in foreigners by giving them the right to live and work there permanently if they created jobs.

Initially EB-5 came laden with stringent conditions: immigrants had to invest $1m either in a new enterprise that would create at least ten full-time jobs, or in a failing one to preserve the same number. They were required to manage the business themselves, and even to dedicate some of the jobs to exports. If a company failed in its first two years, investors would lose both their money and their green cards.

With the exception of the two-year rule, these restrictions have now melted away. Investors today can choose to buy into all sorts of packaged projects, created by regional centres that oversee their day-to-day management. Many projects qualify for a minimum investment of only $500,000, designed to push investment to rural regions and areas of high unemployment. Crucially, the required ten jobs no longer need to be in direct employment. This permits investment in limited partnerships whose purpose is to lend money to companies that do employ workers, reducing investors’ risk.

The logical conclusion is that immigrants could qualify for permanent residency simply by buying local government bonds—and that is exactly what did happen in October. A group of 95 investors, mostly Chinese, bought $48m of Washington state bonds to help finance a replacement for the longest floating bridge in the world, near Seattle.

60% Of Adult Illegal Immigrants In U.S. For 10 Years Or More, Report Says

More than 60% of adult illegal immigrants in the U.S. have lived here for at least 10 years and nearly half have minor children, according to a report published Thursday by the Pew Hispanic Center.

The analysis based on data from the March 2010 Current Population Survey and the Pew Hispanic Center’s 2010 National Survey of Latinos shows a marked increase in the long-term duration of illegal immigrants in the U.S. compared with a decade ago.

Currently, about 35% of illegal immigrants adults have been in the U.S. for 15 years or more; in 2000 only about 16% had been in the country for that long, says the report, titled “Unauthorized Immigrants: Length of Residency, Patterns of Parenthood.”

An additional 28% have been in the country for 10 to 14 years, a percentage has not changed since 2000. Meanwhile, the percentage of illegal immigrants who have lived in the country for fewer than five years dropped from 32% in 2000 to 15% in 2010. According to the report, the increased duration of unauthorized immigrants in the country reflects a surge in illegal immigration in the late 1990s and early 2000s but has since slowed due to the sputtering U.S. economy and increased border enforcement.

In addition, relatively few of those who have been in the United States for a long time are now returning to their home countries. There are about 10.2 million unauthorized adults living in the country and an additional 1 million children under the age of 18, according to the report.

There we have it, 63% of illegal aliens have been here 10 years or more. This tells us that immigration enforcement ended long before Obama. Thanks Jorge Bush and Billyjeff Bentpecker.

Sowell lost me right there. What “American people” is he talking about? As a forty-year resident of Southern California, I can attest… indeed would even swear on the proverbial dead grandmother… that the vast majority of the middle and upper middle classes of my state — Democrat, Republican, or independent — have been knowingly employing illegal aliens for decades. They may have felt guilty or ambivalent about it, but they voluntarily used illegal aliens to build their houses, pick their fruit, mow their lawns, wash their laundry, babysit their kids, etc., etc.

Until relatively recently, when the economy went sour, everyone I knew employed illegal aliens one time or another, except for those who planned on running for office. (And many of them, as it has turned out, did too.)

So Sowell is asking us to believe in some mythological “American people.” In the real world it was something else again. There was an entente cordiale between the illegal aliens and those that employed them. It was all a big wink.

Just as the Obama Regime has nothing but contempt for the Constitution, so does Simon and his fellow criminals. Laws are for the petty folk, those yokels who can't afford servants. Americans express their collective decision making power through our national legislature, created by the Constitution. That is the American people expressing themselves. We are not a myth. I wonder what Simon would say if some said the "Jewish people" were a myth? He would blow a gasket. I bet if someone said "Hispanic people" were a myth, he would blow a gasket. As a matter of fact he endorses the existence of the "Latino people:"

And this is without even going near another obvious truth — that a Republican proposal to deport eleven million illegal aliens would throw the entire Latino vote to Obama, virtually reassuring his reelection.

DOJ Aides Visit Alabama Over Immigration Law

Two top Justice Department officials traveled to Alabama on Monday to gather information on the impact of the state’s controversial immigration law and said they are concerned the toughest-in-the-nation crackdown has run afoul of federal rights.

“The more we hear, the more we are concerned about the impact of Alabama’s immigration law on a wide range of federal rights,” said Tom Perez, who heads the Justice Department’s Civil Rights Division as an assistant attorney general, at a press conference in Birmingham, Ala.

But first, what is with Politico's style book? Who abbreviates the States with three letter and a period? WTF? Why isn't Politico using the standard Post Office abbreviations?

But back to the lies:

As written, the laws’ provisions allow police officers to arrest anyone they suspect of being an illegal immigrant during routine traffic stops, make it a crime to transport an illegal immigrant and require schools to report on the immigration status of its students.

In fact, there is nothing in the law that allows Alabama law enforcement officers, which, Tim Mak, includes Troopers from the Department of Public Saftey, Highway Patrol, sheriff's deputies, and the Alabama Bureau of Investigation Special Agents, not just "police officers." The law states that persons who are found to be driving without a driver's license are no longer permitted to be cited and released with a notice to appear before a magistrate, but are required to be taken into custody and brought before a magistrate. Previously those who found to be driving without a license were given what is commonly called a ticket and sent on their way. This was good for illegal aliens, who could give any name and address and not have to worry about appearing or paying the citation. Now illegals are out of luck in Sweet Home Alabama. And that is Politico's, Mak's, West's, and Perez' concern.

Law enforcement officers may also now make probable cause arrests of persons for being aliens unlawfully present. Now I am cetain that Mak knows nothing about Alabama's law and he also knows nothing about criminal law. Law enforcement is not permited to make any arrest based on mere "suspicion." Law enforcement officers must have either probable cause or a warrant to make an arrest. Nothing the Alabama H.R. 56 says anything different. But Mak and Politico have an agenda and that is a deliberate campaign of lies about the law designed to frighten Americans and present them with some sort of Cheka arresting people willy nilly. Of course, what the radical left projects on its enemies is most often the truth about them. And not surprising coming from a most likely Chinese immigrant well aquainted with the MSS.

Now establishing probable cause for driving without a license is quite easy to establish, being an alien unlawfully present a little harder. But since establishing probable cause in the driving w/o offense, it has become the dagger aimed at the heart of illegal aliens in Alabama and that is why Politico and Mak are on the warpath against this minor change in Alabama law. And also the section of the law most clearly in the pervue of a State. It does not touch on immigration directly, but does get an illegal alien in the Secure Communities net, as it is now a mandatory arrest offense, not a cite and release infraction. That is why Mak and Politico are lying about it.

Now to the Checkists at the DOJ. Perez has been a common theme here, but West is a less visible Checkist. But he is just as much a petty tyrant and a liar.

Tony West, who is leading the federal government’s legal case, said that the Alabama laws fail the same test as similar strict immigration regulations in Arizona, South Carolina and Utah.

“They fail to recognize the primacy of the federal government to regulate immigration, and they all attempt to replace Congressionally-enacted immigration laws and federal policies with state immigration laws,” said West.

West added that the patchwork approach to immigration policy only drew resources from the federal government’s priority of targeting dangerous and criminal illegal immigrants.

“A state by state approach, with each state adopting its own version of immigration regulation, a version that is inconsistent with other states and at odds with the federal government - that only makes our immigration problem worse,” he said. “It makes it harder for us to focus limited resources on federal immigration priorities, like criminal aliens who pose a threat to national security or public safety.”

The lie is that Alabama H.R. 56 is at odds with Federal law. Nothing in the Alabama statute, or the Arizona statute, are at odds with Federal law. Both support and work with Federal law, as opposed to the Obama Regime Administrative Amnesty, itself an open assault on the Constitution where the Regime is thwarting Acts of Congress. What the Regime objects to is the assistance the State of Alabama is giving to the discovery and arrest of illegal aliens, most of whom will come to DHS' attention because of Secure Communities. Once arrested and processed for driving without a license, the illegal aliens become a political liability for the Regime. What they fear is the illegl aliens that are released that end up as serial killers, DUI killers, or terrorists. In fact it is not the States that are replacing "Congressionally-enacted immigration laws" but the Regime that is replacing said laws with a policy that usurps those laws. So, it is the same story, what the left accuses others of, is in fact what they are guilty of.

San Francisco police released a videotape Sunday of the man who deliberately ran over a state firefighter at a Geary Boulevard gas station on Thanksgiving Day...

The seasonal firefighter for the California Department of Forestry and Fire Protection, whose name was not released, suffered life threatening injuries when he was intentionally struck by a car at 2:45 a.m. Nov. 24 on Ninth Avenue and Geary Boulevard, police said.

The victim and suspect had gotten into a fight inside a restaurant at 11th Avenue and Geary Boulevard just before the incident, police said. The two were eventually separated, and both left the restaurant. The victim walked to a gas station at 11th Ave., and the suspect was seen getting into a black Mazda CX sport utility vehicle with 12-spoke sports rims, driving into the gas station and intentionally running over the victim, police said. He then fled the scene...

The suspect was described as a mixed race or Latino male, 18 to 24 years old, with short black hair and a manicured beard.

Thomas Perez is apparently unconcerned about this hate crime. One wonders why...Not really. We know why Perez and the Department of Justice Civil Rights Division is unconcerned about crimes directed against white people. For one he is too busy investigating the State of Alabama for assisting in arresting illegal aliens.

SWAT Team's Shooting Of Marine Causes Outrage

TUCSON, Ariz. (AP) — Jose Guerena Ortiz was sleeping after an exhausting 12-hour night shift at a copper mine. His wife, Vanessa, had begun breakfast. Their 4-year-old son, Joel, asked to watch cartoons.

An ordinary morning was unfolding in the middle-class Tucson neighborhood — until an armored vehicle pulled into the family's driveway and men wearing heavy body armor and helmets climbed out, weapons ready.

Quite a dramatic intro the Guerena shooting. But the real fireworks follow:

They were a sheriff's department SWAT team who had come to execute a search warrant. But Vanessa Guerena insisted she had no idea, when she heard a "boom" and saw a dark-suited man pass by a window, that it was police outside her home. She shook her husband awake and told him someone was firing a gun outside.

A dark-suited man...are we talking a Man in Black here? We don't know, but what we do know is that the police officers and sheriff's deputies at Guerena household that day were not "dark-suited." They were wearing standard tactical uniform for law enforcement in the area, a light olive drab, closer to a light or medium green. Nothing of that uniform says "dark-suited."

Also of interest is the "boom." What boom. Go to the video. The closest thing to a "boom" is the sound the ram made on the Guerena front door. A noise that was preceeded by a siren from a police car, an announcement from the SWAT team that it was the "Police" with a "Search Warrant." None of that sounds like a "boom." But what it does sound like is the last nail in the coffin of the Guerena myth.

But just in case that was enough, here the nail in the coffin of Guerena "model citizen" myth:

A shotgun found in the home was reported stolen in Tucson in 2008.

In the affidavit, sheriff's Detective Alex Tisch laid out the case against Guerena's family. It details two instances of drug seizures, one in April 2009 in which Jose Guerena was found in a home with other people who had just dropped off 1,000 pounds of marijuana at a separate residence, and another in October 2009 in which a man who had met with Guerena's brother was found with drugs and weapons.

How does an innocent man become involved in two drug seizures. Hardly the behavior of a upstanding former Marine and hard working family man.

It looks like Jose Guerena is just another Erik Scott. Remember kids, drugs kill and the life lost might be your own.

Mixed Messages?

Phoenix Federal Office Designed To Better Serve Legal Immigrants

A new federal office in Phoenix provides green cards and similar services without the presence of immigration-enforcement operations, eliminating what officials say had been an uncomfortable atmosphere for legal immigrants.

The Department of Homeland Security has been slowly opening such stand-alone immigration offices since 2003, when the former Immigration and Naturalization Service was dissolved. The services and enforcement duties of the former INS were divided into separate agencies, Citizenship and Immigration Services, the agency now responsible for processing immigration applications for green cards and naturalization, and Immigration and Customs Enforcement, the agency responsible for arresting and deporting illegal immigrants.

Because of the divergent missions, housing the two agencies in the same building creates an awkward atmosphere and sends a "mixed message," said John Kramar, a CIS district director...

"There will be no confusion in this location," said Kramar, standing outside the 50,000-square-foot immigration office.

The benefits of the new office go beyond separating immigration services from immigration enforcement.

More evidence of the attitude of USCIS to enforcement and fraud detection. They want to give out benefits, not protect America. Of course there are no real benefits to separating immigration services. What it does is discourage immigration enforcement. In fact, much fraud exists in immigration benefits, and separating benefits from enforcement discourages USCIS officers from finding and reporting fraud. It also gives a free pass to illegal aliens and fraud perpetrators who in the legacy INS days were quickly arrested when they attempted to obtain immigration benefits. Adjudicators of immigration benefits only had to make a quick telephone call to other officers in the same building to come and arrest illegals and frausters.

Now, under the new Regime, there is no downside to fraud. If you get denied, no worries because there is no enforcement or arrests at USCIS offices.

Illegal Aliens Challenge The Obama Regime

The charade of the Obama Regime enforcement strategy and administrative amnesty for illegal aliens is again being challenged. But not by RINOs, who apparently have come to terms with it. It is again being challenged by the radical left. But perhaps challenge is too strong a word. More accurately it is part of the kabuki theater between the Regime and the left opposition. Not that the Regime will be putting an ice ax in the heads of its left wing opponents. But it is managing the crisis much like Stalin, giving it cover to move further left, implementing and expanding the amnesty.

But back to the story. Two Mexican illegal aliens purposely had themselves arrested. They turned themselves in to a Border Patrol station in Alabama. At first one would think that these two clowns are the perfect immigrant to deport, not too bright. But there is a method to their madness.

Alabama Immigration Arrests Highlighting Obama Policy

Two men visiting Alabama to protest the state's tough new law on illegal immigration walked into a U.S. Border Patrol office and said they were in the country illegally, resulting in their arrest. They remain in federal custody more than two weeks later awaiting deportation proceedings.

And abject embarrassment from the Border Patrol for arresting two illegals.

Border Patrol officials said they were only doing their job in arresting Isaac Barrera, 20, and Jonathan Perez, 24, Mexican men who lived in California before coming to Alabama to demonstrate against the state law.

"We'd be violating the law if we didn't," said Randall Baldwin, an assistant chief in the New Orleans office.

But activists are trying to use the cases of Barrera and Perez to highlight what they say are unjust immigration practices at the federal level as demonstrations and lawsuits continue over the state's controversial crackdown.

And yes they are. Two potential beneficiaries of the Obama Regime Administrative Amnesty, these two DREAMsters are the perfect candidate for the administrative amnesty. Young, been here years, probably high school graduates. Like Rosa Parks sitting on a bus, these two are a deliberate challenge to the Obama Regime, which will have to decide whether to go left and release them, or make an example of them for the upcoming Presidential contest. We will learn much about the regime when that decision is made. Most likely they will soon be released. Stay tuned.

No Amateurs Allowed

Discretion Not Amnesty

All he said was, “Let’s be humane in enforcing the law.” That was my reaction last night when Newt Gingrich argued that the federal government should refrain from deporting illegal immigrants who had been in the U.S. for many years if the effect would be the break up of a family.

I did not take him to be proposing a new law conferring amnesty. To do what the former Speaker proposed would require no change in U.S. law. All you’d need is the sensible application of prosecutorial discretion.

A successful immigration enforcement policy, easily implemented under current law, would secure the borders; use the capability we have to track aliens who enter on visas to ensure that they don’t overstay; and target our finite law enforcement resources at (a) illegal immigrants who violate federal or state criminal laws (i.e., other than the laws against illegal entry), and (b) employers who knowingly hire illegal aliens and therefore provide the incentive that induces them to come. (An even better policy would deny illegal immigrants various social welfare benefits, but some of that would involve changes in the law so I put it to the side for present purposes.)

On the face of it, this is nothing more than the Obama Amnesty. Like Gingrich and McCarthy, the Obama Regime amnesty consists of a sole emphasis on criminal aliens and a half-hearted employer sanctions policy, and like the Obama amnesty, a concentration on the employer, allowing the illegally employed alien to remain. There is certainly nothing in this that will attrit the population of illegal aliens, since the overwhelming majority of illegal aliens don't have criminal convictions, but they do commit many crimes, such as identity theft, which Mssrs. Gingrich and McCarthy studiously ignore.

But enough of the McCarthy-Gingrich Administrative Amnesty, on to the amazing ignorance of McCarthy. Like many current and former Assistant United States Attorneys (AUSAs), McCarthy thinks he is brilliant and all-knowing.

However, he seems to think that the Department of Justice prosecutes illegal aliens. Well, they do when they are charged with criminal offenses, but illegal aliens are generally "prosecuted" by the Department of Homeland Security, Immigration and Customs Enforcement, Office of Counsel in each district office. No illegal aliens are ordered removed or deported by AUSAs or the Department of Justice. Generally, the DOJ's sole responsibility in immigration enforcement is the representation of DHS before Federal courts when aliens appeal decisions by ICE, the Executive Office for Immigration Review (EOIR) and the Board of Immigration Appeals (BIA). While the BIA and EOIR are DOJ agencies, they do not "prosecute" aliens, they are the administrative appeal system for aliens. ICE remains the "prosecuting" agency representing the government. The only involvement of the DOJ in "prosecuting" aliens, is the decision making to prosecute for criminal offenses, such as Re-entry After Deportation or Identity Theft. The number of those prosecutions is in the few thousand, compared to the hundreds of thousands of aliens in removal proceedings "prosecuted" by ICE.

McCarthy appears not to understand that. He thinks the Attorney General and the DOJ should be more generous to illegal aliens:

Obviously, if an alien has been here illegally for a number of years but has been essentially law-abiding (again, ignoring the fact that it is illegal for him to reside and work in the U.S.), and if his deportation would have the effect of ripping apart an intact, law-abding family, you don’t bring that case. Such a case is not worth the Justice Department’s time when there are plenty of more serious criminals, including more serious immigration offenders, to pursue.

This is not a radical concept. The Obama administration currently exercises its discretion by not only refraining from any meaningful enforcement of the immigration laws but also preventing states (e.g., Arizona) from enforcing the laws. In stark contrast, the Speaker indicated that a Gingrich administration would enforce the law against illegal aliens — it would arrest and deport many of them. I’m betting that he’d also direct his Attorney General to drop the Obama Justice Department suit against Arizona. And Newt was quick to point out last night that he was talking about a humane enforcement policy. He was not proposing that the illegal aliens who were not prosecuted be given citizenship. They just wouldn’t get prosecuted as long as they didn’t make a nuisance of themselves.

McCarthy also needs to be reminded that it is DHS, and its Secretary, that removes illegal aliens, not the Attorney General. Any direction for leniency would be directed from there. He also contradicts himself, stating that Gingrich would not "prosecute," e.g. deport any illegal alien who "didn't make a nuisance of themselves." But then claims that Gingrich would be deporting many more illegal aliens than Obama. Hardly likely as most illegal aliens "don't make nuisances of themselves." Well, other than being illegal, driving down wages, taking jobs from the poorest of Americans, etc. Few are involved in major crime, except tax evasion and identity theft. But murder, rape, robbery, and burglary are not mere "nuisances," they are serious crimes. Use of "nuisances" to describe criminal aliens tells us that neither Gingrich or McCarthy are serious about immigration law enforcement. Of course the criminal class of aliens needs the larger community of illegal aliens to hide among, like the guerrilla who swims in the sea of a sympathetic population. Unless the general population of illegal aliens are removed, the "nuisances" will be able to remain.

But it tells us that even "smart guys" like McCarthy can't even get important facts concerning who removes aliens, the DOJ or DHS, correct. Which explains his endorsement of the Gingrich Amnesty, the same as the Obama Amnesty.

Also of interest is that McCarthy and Gingrich implicitly accept the Obama Regime claim that 400,000 is the maximum number of illegal aliens that can be removed annually. That is incorrect, even under the current DHS budget, they could easily expand that number by 400,000. But without E-Verify, which Gingrich and McCarthy studiously ignore, there will be no end of the jobs magnet. Half-hearted civil suits against employers like Chipotle are ineffective without the arrest of the illegal alien employees. There certainly is nothing in Gingrich's or McCarthy's "humane" enforcement that includes work-site raids, especially since if that is their only crime, they get a free pass. Even more of interest, the illegals get to remain under the Gingrich Amnesty, so what is the point of any enforcement action against employers? No explanation from McCarthy or Gingrich.

In the U.S. so far this year almost 3,000 Chinese citizens have applied for investor visas, up from 270 in 2007. That’s 78 percent of the total applicant pool for this type of visa, according to U.S. Citizenship and Immigration Services (USCIS). The U.S. investor visa, also known as the EB-5, requires a minimum investment of $500,000 by the applicant in a commercial project in the U.S. that employs at least 10 Americans within two years. If the Chinese applicants can’t generate those jobs, they and their family may have to leave the U.S...

Buying Maybachs and Maserattis aren't helping our economy much. And it is unlikely they will be deported given that they are not a "priority" for U.S. Immigration and Customs Enforcement.

It appears that residency or citizenship are just for convenience. No loyalty or love of an adopted country, just a bolt-hole in an emergency:

Instead, the most common model is that of Li Weijie: Wife and child get foreign passports and live abroad, husband gets a residency permit but spends most of his time in China. “If you think of emigrating like Russians, it is because they are afraid and so are leaving their country,” says Hurun’s founder, Rupert Hoogewerf. “This is not true of the wealthy Chinese at all. They still have their businesses in China and most of their assets are in yuan...”

Moving a family abroad and obtaining foreign residency cards could also prove useful in case of sudden legal or policy shifts that hurt entrepreneurs, or if social unrest reaches a boiling point...

It must be noted, that those with residency in the United States must actually live here, not commute or use a green card as an escape mechanism. Residency and citizenship here are supposed to be something more than a bolt-hole.

And, they are tax cheats and criminals in China, as reported, and can be expected to continue their cheating ways in the United States as well. As well as remain unassimilated.

A serious issue for both the Chinese applicants and their prospective host countries is the origin of their wealth. To ensure that those with criminal backgrounds aren’t let in, and to make sure they’re truly affluent, officials of the U.S., Canada, and other countries want thorough documentation of their assets. That can be difficult. “Wealthy Chinese almost all have a history of evading taxes,” says Gao Tong, who emigrated to Boston six years ago and is now setting up his own immigration services company called Harmonia Capital USA, with his brother, a wealthy Shanghai businessman. “They fear getting caught if they have to report their income globally.”
Some middlemen collude with clients to forge documents, say Well Trend executives,
since many émigrés don’t have papers to prove the origin of their finances, or they may have gotten rich through illicit means. “There are more than a few bad apples,” says Victor Lum, a vice-president at Well Trend and a former Canadian visa official. “USCIS takes allegations regarding EB-5 program malfeasance very seriously,” USCIS spokesman Christopher Bentley wrote in an e-mail...

And a clear statement of patriotism to their adopted country:

And while rich Chinese still crave Canadian or U.S. degrees for their children, they may see less reason to emigrate. “When I first went to Canada, I thought China was very backward and it would take 50 years for us to catch up,” says Li. “After 10 years, we can all see that China will absolutely surpass the rest of the world.”

And Hugh Hewitt and the WSJ think these people will grow the economy out of the recession. They are only in it for themselves. Such greedy crooks are not going to be building much here if they really want to go back to China.

The Uselessness Of REAL ID

The radical left has chosen a new target, one on their radar screens for a while, the REAL ID Act. The Act, which besides regulating the materials and appearance of State issued identification cards and driver's licenses, also regulates who may obtain those IDs. Many States have failed to adhere to the requirements of the program, many for ostensibly libertarian or States Rights principles. But the left is on the warpath against the Act because it interfers with the ability of illegal aliens to live, work and receive welfare in the U.S.

Of course they don't always cop to that motivation, they usually find some sob-story and use that.

Real ID Blocks Some From Any ID

Strict federal rules aimed at keeping terrorists off planes are blocking some Americans from renewing their driver's licenses or getting other state-issued IDs.

The consequences can be staggering. Without an ID, people cannot change jobs, drive legally, collect Social Security or Medicare, get through airport security or open a bank account.

It's "a persistent problem across the country," says Chris Calabrese at the American Civil Liberties Union.

The problems stem from the Real ID Act, passed by Congress in 2006 in the aftermath of the 9/11 attacks, when terrorists used easily obtained driver's licenses to carry out their plans.

The law says that by 2013, only IDs from states that require applicants to present proof of citizenship or legal residency will be accepted to board an airplane or enter a federal building. In most states that have begun to comply, that proof means a birth certificate or immigration papers.

The ACLU and others predicted that the law's documentation requirements would be a burden to many Americans, and the issue becomes more pressing as the deadline nears. Sometimes birth certificates are incomplete, inaccurate, missing or were never recorded.

When corrections officer Charles Lust, 46, of West Palm Beach, Fla., tried to renew his driver's license in February 2010, he was shocked to discover his birth certificate said his name was Bell. A court, establishing paternity when he was 14, changed his name from Lust, his mother's name, to Bell, his father's name.

After his license expired, he couldn't open a bank account, cash a check or change jobs. He had to make special arrangements to pick up his kids from school because the school requires ID.

Bonnie Cohen, a paralegal at the Legal Aid Society of Palm Beach County who helped Lust, says her office has handled more than a dozen similar cases this year, most of them elderly minorities born in rural parts of Florida, Georgia and Alabama. Their records were lost or damaged in natural disasters, birth certificates were never issued or they were issued with errors, and some people were raised under a different name than what's on the birth certificate.

While the stories about elderly people with ID problems are probably true, the problem appears to be small and easily overcome. Any person over the age of 65, the retirement age, already has satisfactorily proved to the Social Security Administration their identity. But in any event, records destroyed in natural disasters can be recreated by administrative action or the order of a local court in most States. But reading the story closely, one sees that while some had difficulties obtaining identification, in the end, all got the identification they needed.

And in the case of Lust, the whole story makes no sense. He was hired for a law enforcement position by a State or locality. He has government issued credentials and passed fingerprinting and a background check. Didn't he present a birth certificate as part of that. Something stinks there. But in any event, the problem was solved. And as time progresses the number of persons without identification will decrease. The only likely significant number of persons without identification will be the homeless mentally ill.

But back to the Act. It was, as usual, badly crafted and not solving the problem of aliens and fraudulently obtained identification.

First, the law could have been better written. The problem were aliens obtaining State identification, much of it with fraudulent information. A simpler course, and more Constitutionally based, would have been for Congress to prohibit the issuing of identification by States or their political subdivision to any alien other than an alien lawfully admitted or paroled and authorized employment in the U.S. No alien not authorized employment needs any identification other than their treaty compliant passport. This is especially important for making it more difficult for aliens admitted legally, but overstaying their period of admission. Temporary visitors such as tourists or business visitors do not need State issued identification or driver's licenses. Only those here in catagories that include employment authorization need such things as driver's licenses. Another obvious restriction would be that no alien may be issued identification for a period longer than that of their admission to the United States. Another part of the law would be making it a criminal offense for a State to violate the law, especially for supervisors, managers, and State Constitutional officers to order any subordinate to violate the law. Also needed is a prohibition on aliens possessing State issued identification. What must be stopped is States using identification to create their own process to assist illegl aliens to remain in the U.S. such as some States do; Washington, New Mexico, and Utah.

There would be no other burdensome requirements on the States other than they not issue any identification to aliens without verifying with the Federal government the lawful presence and employment authorization of the alien applying for a State document. That is currently a quickly completed review of computerized databases and presents no burden to the State issuing authority.

But instead the Republicans in Congress created a Rube Goldberg scheme that is costing States billions and still not prohibiting illegal aliens from obtaining State issued identification. So, it is time to repeal REAL ID, but replace it with much simpler and Constitutional legislation.

State Reports 104 Voters Not Citizens

SANTA FE (KRQE) - More than 100 noncitizens may have registered to vote over the last eight years, and of those 19 may have actually cast ballots, according to a report released Thursday by the Secretary of State's office.

Earlier this year, Republican Secretary of State Dianna Durán said she found 37 cases of foreign nationals, including illegal immigrants, who may have cast ballots in New Mexico. That came as she was verifying registrations for people without Social Security numbers who received New Mexico driver's licenses.

"The public record provides critical evidence that noncitizens with and without driver's licenses have registered to vote and that noncitizens have voted in New Mexico elections," Durán told News 13 in March.

A few months later, Durán said she identified 64,000 possible cases of possible voter fraud. She forwarded those to the Department of Public Safety for review.

Another reason for voter ID laws.

Mercedes-Benz Manager From Germany Arrested Under Alabama’s Strict New Immigration Law

TUSCALOOSA, Ala. — A German manager with Mercedes-Benz is free after being arrested for not having a driver’s license with him under Alabama’s new law targeting illegal immigrants, authorities said Friday, in an otherwise routine case that drew the attention of Gov. Robert Bentley.

And since the German visitor was legal, the problem was quickly solved.

Mercedes-Benz spokeswoman Felyicia Jerald said the man is from Germany and was visiting Alabama on business. The company’s first U.S. assembly plant is located just east of Tuscaloosa.

“This was an unfortunate situation, but the incident was resolved when our colleague ... was able to provide his driver’s license and other documents to Tuscaloosa police,” Jerald said.

The only people who have anything to fear are illegal aliens. Read and weap ACLU and La Raza. The law is directed against illegals, not people of color.

Import Teachers Who Can’t Speak English—Alienate Reagan Democrats

In general, African-Americans don't like Spanish. They find being forced to study it is just a reminder of their demographic displacement as the biggest minority group. And blacks don't like people speaking Spanish around them. It makes them uneasy it makes them feel less street-smart. The strangers could be conspiring out loud in Spanish to jump them and they wouldn't be able to tell.

Maybe this isn't a realistic fear, but that's how a lot of lower class blacks feel.

In fact it is a deadly and real occasion when Hispanics target blacks for death and ethnic cleansing.

Two examples from The City of Angels come to mind courtesy of this blog, the two decade ongoing ethnic cleansing directed against blacks in the City of Azusa:

“The Azusa 13 gang waged a campaign of hate during a two-decade crime spree in which African-Americans were harassed and attacked,” said United States Attorney André Birotte Jr. “We hope that this federal case will signal the end of this racist behavior and will help vindicate all of the victims who have suffered over the years.”

However, the real threat to Americans, black and white, comes from Mexican and Salvadoran immigrants who are lawless, violent, and racist. And ICE, which has primary jurisdiction over illegal immigration enforcement, did nothing over a number of years, starting with George H.W. Bush, and continuing through Clinton, George W. Bush, and, now, with the Obama Regime.Ethnic cleansing is not an uncommon crime committed by Mexican and Salvadoran immigrants. Many once white or black areas of southern California are now dominated by illegal and legal immigrants from Mexico. Hawaiian Guardens was not unusual. As a matter of fact, the alleged gang responsible, Varrio Hawaiian Gardens gang is not really a gang, but a loose association of like minded Mexicans who hate all who are not Mexican, and specifically blacks, but whites are victims as well, but mostly as taxpayers who fund the welfare and law enforcement that deal with the Mexican influx. But it has been more deadly for blacks, who live closer to Mexicans. Whites either keep Mexicans out by using property price, or move out once Mexicans move in, because they know what will happen next.The tragedy is that black leaders, like Maxime Waters, Jesse Jackson and Al Sharpton have done nothing about this ethnic cleansing and attempted genocide that was going on in Los Angeles and elsewhere. They spend too much time attacking the mythological KKK or the very real Korean grocers as threats to blacks, while blacks were being killed by their fellow people of color, and, as this story showed, really killed and really run out of neighborhoods.

In both, U.S. Immigration and Customs Enforcement, under both Republican and Demoncrat administrations were unconcerned and took no actions over a period of years.

The Amnesty For Criminal Aliens

Despite claims that the ongoing Obama Regime Administrative Amnesty does not include criminal aliens, in fact, criminal aliens, in one way or another, will benefit.

A story from New York is an example. An illegal alien, here an unknown amount of time, was convicted of assaulting his ex-girlfriend, and her current boyfriend. He has since been released, but in a desultory manner, placed in removal proceedings. Clearly this criminal alien, released into the community, but still in removal proceedings is not a high priority for U.S. Immigration and Customs Enforcement (ICE) Enforcement and Removal Operations (ERO).

ERO is required by law to hold criminal aliens, but Congress, including the current allegedly Republican Congress, the same one that has still yet to defund Obamacare, has not appropriated monies necessary to hold all criminal aliens. We don't know if this is the case in the current controversy, but we also know that the Obama Regime Administrative Amnesty has in the past been extended to criminals, for example Jose Manuel Gonzalez-Sandoval or Edwin Ramos, among other less violent criminals, such as student visa fraudsters.

The question is whether our current illegal alien criminal in Long Island will meet ICE's "priorities" for removal:

II. Criteria for Review

The following removal cases are enforcement priorities for the Department of Homeland Security and should generally be pursued in an accelerated manner before EOIR. These cases involve an alien-

• who is a suspected terrorist or national security risk;
• who has a conviction for -
• a felony or multiple misdemeanors,
• illegal entry, re-entry, or immigration fraud, or
• a misdemeanor violation involving-
• violence, threats, or assault,
• sexual abuse or exploitation,
• driving under the influence of alcohol or drugs,
• flight from the scene of an accident,
• drug distribution or trafficking, or
• other significant threat to public safety;
• who is a gang member, human rights violator, or other clear threat to public safety;
• who entered the country illegally or violated the terms of their admission within the last three years;
• who has previously been removed from the country;
• who has been found by an immigration officer or immigration judge to have committed immigration fraud; or
• who otherwise has an egregious record of immigration violations.

A cursory review would tell us that someone with a two year time in the State pen would be a candidate for custody and removal. However, it appears that our violent Don Juan has been released. This tells us that he might have won the Jose Manuel Gonzalez-Sandoval Criminal Amnesty. And since criminal aliens are also supposed to be held in custody, the likelihood of a criminal amnesty in this case is highly likely. No custody means ICE ERO isn't serious about this criminal alien. Just as it isn't interested in the fraud aspect of the UNV and Tri-Valley University criminals.
